CONVENTION CENTER PROJECT CONSTRUCTION MANAGER AGREEMENT
AMENDMENT NO. 4.
RECOMMENDATION:
It is recommended that City Council approve Amendment No. 4, to Construction
Management Agreement No.4577, with Turner Construction Company, Convention Center
Expansion Project, to add seven and one half months of additional Superintendent support.
SUMMARY:
This action would add seven and one half months,of field superintendency to the staff at the
Convention Center Project at a cost of$96,000.
BACKGROUND:
The Convention Center Expansion project is now more than 50% through the construction
phase and is progressing well. It is at this phase of the work that the project is actually two
separate building projects; the East and the West projects. The project schedule from the
beginning has been very aggressive and as in any complicated remodel job there have been
some delays that the project staff continues to find ways to absorb in the existing time frame
as we know the completed building is sold out on September 26, 2005.
The City Council has previously granted the project administrative staff the ability to provide
completion bonuses from the contingency to Trade Contractors if it helps insure a timely
completion. To ensure the newly compressed schedule is kept, the project staff must
manage multiple overlapping trades. With both sides of the building going simultaneously
it is difficult if not impossible to manage the trades without additional field staff. The attached
amendment would authorize the expenditure of $96,000 from the contingency (current
contingency balance is$2.8m)for seven and one half months of additional superintendency
on the project. City Council approval is sought; a Minute Order approving the Amendment
is attached for consideration.

AGREEMENT NO. 4577 - CONSTRUCTION MANAGEMENT SERVICE
PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II
THIS FOURTH AMENDMENT to Agreement No. 4577 for contract services, (herein
"Agreement") made and entered into on the day of 2004, by and
between the CITY OF PALM SPRINGS, (herein "City') and TURNER CONSTRUCTION
COMPANY, (herein "Construction Manager') is hereby amended effective December 16,
2004, as follows:
Section 1. Exhibit"C" Schedule of Compensation, General Conditions, Phase II, is hereby
amended by adding a Superintendent to the project staff for seven and a half months ,
December 18, 2004 through July 30, 2005, to read as follows:
"Construction & Closeout Expenses Staff Fee
Additional Superintendent $0 $96,000 $0
(Seven and one half months Staffing, with cost to be paid monthly based on an hourly rate
of$75, not to exceed $96,000)"
Section 2. Due Execution. The person(s)executing this Amendment on behalf of the parties
hereto warrant that(i)such party is duly organized and existing, (ii)they are duly authorized
to execute and deliver this Amendment on behalf of said party, (iii) by so executing this
Amendment, such party is formally bound to the provisions of this amendment, and (iv) the
entering this Amendment does not violate any provision of any other agreement to which said
party is bound.
Section 3. Full Force and Effect. The parties further agree that, except as specifically
provided in this Amendment, the terms of the Agreement shall remain unchanged and in full
force and effect.

SUPERINTENDENT TO THE CONVENTION CENTER PROJECT
AND INCREASING COMPENSATION TO COVER THE ADDED
MANPOWER.
I HEREBY CERTIFY that this Minute Order approving Amendment No. 4 to Agreement No.
A4577, with Turner Construction Company, adding a superintendent to the Convention
Center Project staff and increasing compensation to cover the added manpower cost, was
adopted by the City Council of the City of Palm Springs, California in a meeting thereof held
on the 151h day of December 2004.
