A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, IN OPPOSITION TO
PROPOSITION 8, THE CALIFORNIA MARRIAGE
PROTECTION ACT, FOR THE NOVEMBER, 4, 2008,
CALIFORNIA GENERAL ELECTION.
WHEREAS, on the November 4, 2008, California General Election Ballot, will be
an initiative Proposition 8; and
WHEREAS, according to the Secretary of State, this measure shall be known
and may be cited as the "California Marriage Protection Act;" and
WHEREAS, the initiative measure would add Article I, Section 7.5, to the
California Constitution as follows: "Sec. 7.5 Only marriage between a man and a woman
is valid or recognized in California;" and
WHEREAS, equality under the law is a fundamental Federal and California
constitutional guarantee; and
WHEREAS, on September 17, 2007, the City Council approved joining an
amicus curiae brief in support of the City of San Francisco's lawsuit regarding the
constitutionality of California's marriage laws in the In re Marriage Cases, before the
California Supreme Court.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council does oppose Proposition 8, the "California Marriage
Protection Act."
