POLICIES AND STANDARDS FOR NEIGHBORHOOD ENTRY SIGNS IN
SINGLE FAMILY NEIGHBORHOODS

SUMMARY
On March 5, 2008, the City Council initiated a Zone Text Amendment at the request of
representatives of the Sunmor Neighborhood Association to allow neighborhood entry
signs in single family neighborhoods. Presently, there is no provision in the Palm
Springs Zoning Code for such a sign. Following a public hearing on June 25, 2008, the
Planning Commission adopted a recommendation to allow such signs, subject to certain
standards summarized in this memo. A draft ordinance for Council consideration has
been prepared based on the Commission's recommendation. A public hearing is
required.
RECOMMENDATION:
1. Open the public hearing and receive public testimony;
2. Waive the reading of the ordinance text in its entirety and read by title only; and
3. Introduce on first reading ordinance no. _, "AN ORDINANCE OF THE CITY
OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 93.20.03 AND
93.20.10.0 OF THE PALM SPRINGS ZONING CODE RELATING TO
NEIGHBORHOOD ENTRY SIGNS."
ANALYSIS:
There are no provisions in the Palm Springs Zoning Code to allow the placement of
neighborhood entry / identification signs in established single family neighborhoods.
However, some neighborhoods do have such signs which are usually constructed by
the original developer as a marketing tool to assist the development during initial sales.

Such signs are also found at the entries of multi-family projects. Following a review by
the Planning Commission, staff has prepared a draft set of standards which would allow
any qualified single family neighborhood to place such signs at key entry points'.
All signs in the City of Palm Springs are regulated by the Palm Springs Zoning Code.
The Code essentially limits signs in single family neighborhoods to address numbers
under eight (8) inches in height. No other signs, except for emergency signs and
constitutionally protected speech (political signs), are allowed. However, as noted
below, the 2007 update of the General Plan does envision entry signage, as follows:
General Plan Policies— Community Design Element
CD 2.4 Strengthen the identity of neighborhoods / districts through the
addition of community gateway features, special street signs or
monuments.
CD 9.5 Place distinctive signage to identify principal entries to the City,
unique districts, neighborhoods, locations, public buildings and parks.
Staff believes that the General Plan provides a basis for allowing neighborhood entry
signs, such as that proposed by the Sunmor residents.
In considering if neighborhood entry signs should be allowed, planning staff met with
members of the Sunmor neighborhood along with the City Attorney, Director of Public
Works and others to discuss related issues and concerns. It was staffs belief that a
number of questions needed to be answered as part of a possible zone text amendment
and before such signs are installed, including:
1. Number/Location. How many signs should any particular neighborhood
have? Should there be a limit? Are there any criteria that should be established
for locating signs? Should the number/ location be subject to City approval?
2. Sign Design. Does the City want multiple entry signs within a
neighborhood to be a common design? Should any property owner be able to
put up whatever design they wanted? Should their design be subject to City
approval?
3. Long-term Maintenance. What happens if the property owner on whose
land the sign sits decides to remove it, but the neighbors want it kept? What if
the owner wants to change it or doesn't maintain it, and refuses to allow the
neighbors to 'trespass' to keep the sign In good repair?
The initiative behind this ,Zone Text Amendment came from residents of the Sunmor neighborhood
seeking permission for an entry sign. The Sunmor Neighborhood is located just west of City Hall, and is
generally bound by Andreas Road, Farrell Drive, Alelo Road and Civic Drive

Staff was concerned that the City is often called upon to be the broker between one
owner and his / her neighbors, and that some assurances needed to be developed to
avoid potential disagreements.
Following consideration of staffs analysis, the Planning Commission held its hearing
and recommended a set of standards for neighborhood identification signs, including
the following provisions:
1. Only a single-family neighborhood association organized under the City's
Office of Neighborhood Involvement can propose a Sign Program for
neighborhood identification signs. The program must be comprehensive
regarding number and locations, but the location(s) may only be within the
official boundaries of the neighborhood association.
2. The program would be subject to review by the Architectural Advisory
Committee and approved by the Directors of Planning and Public Works, to
include:
a. Proposed number and location(s)
b. Proposed size, design, color and materials
3. Any individual property owner on whose property a sign is proposed must be
a signatory to the sign program application. Signs may also be proposed in
the public right-of-way, subject to an approved Encroachment Agreement.
A. Certain legal documents as determined by the City Attorney must be
executed prior to the approval or installation of any sign. Such documents
would address long-term maintenance, liability protection and other
provisions.
Based on the Commission's action, the attached draft Ordinance has been prepared for
Council consideration.
ENVIRONMENTAL DETERMINATION
Staff has evaluated the potential environmental impacts of the proposed Zoning
Ordinance text amendment and determined that it is Categorically Exempt under
Section 15305 — Minor Alterations in Land Use Limitations — of the Guidelines for the
Implementation of the California Environmental Quality Act. The proposed amendment
to allow neighborhood entry signs does not result in any changes in land use or density.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ORDAINS:
Section 1. Section 93.20.03 shall be amended to include the following definition, with
all subsequent definitions in the Section renumbered accordingly:
19. "Neighborhood entry sign" means a sign located on private property that
identifies a defined single family neighborhood.
Section 2. Subsection C.9 of Section 93.20.10 is hereby added to read, as follows:
9. Neighborhood Entry Signs. Neighborhood entry signs may be allowed in
existing or proposed single family neighborhoods in the G-R-5 or any R-1
zone, subject to the following provisions:
a. The sign or signs shall only represent and may only be applied for by
Neighborhood Associations organized under the auspices of the City's
Office of Neighborhood Involvement or subsequent department.
b. The sign(s) shall only be allowed as part of a Sign Program approved by
the Planning Commission, including the following information:
i. Number, location and placement
ii. Dimensions, design, materials and colors
iii. Authorization from owners on whose property sign(s) would be
located
c. The signs shall only be allowed within the boundaries of the
neighborhood association but may be located in the adjacent public
right-of-way.
d. The signs shall be subject to approval by the City for potential traffic
visibility and other safety issues.
e. Prior to installation of any neighborhood entry sign, the property
owner(s) shall execute an agreement regarding long-term maintenance,
subject to review and approval by the City Attorney.

Section 3. The Mayor shall sign and the City Clerk shall certify to the passage and
adoption of this Ordinance and shall cause the same, or the summary thereof, to be
published and posted pursuant to the provisions of law and this Ordinance shall take
effect thirty (30) days after passage.

Mr. Ewing provided background information as outlined in the staff report dated June 25,
2008.
Discussion occurred on the details of a maintenance agreement, private signs on the
public right-of-way, removal of the signs and neighborhood boundaries.
Vice Chair Hochanadel suggested adding a sunset provision for the opportunity to review
at a later time.
Commissioner Conrad concurred with Commissioner Scott regarding the allowance of a
sign in a public right-of-way.
Chair Marantz opened the Public Hearing:
-Ron Marshall, addressed concerns from the Commission and provided further details
regarding the sign design and maintenance.
There being no further appearances the Public Hearing was closed.

RESOLUTION NO. 7143
OF THE PLANNING COMMISSION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, RECOMMENDING THAT THE
CITY COUNCIL AMEND SECTIONS 93.20.03 AND
93.20.10.0 OF THE PALM SPRINGS ZONING CODE
RELATING TO NEIGHBORHOOD ENTRY SIGNS.
WHEREAS, on March 5, 2008, the City Council voted unanimously to direct staff to
initiate a Zoning Ordinance Text Amendment (Case No. 5.1206) to consider how
"neighborhood entry signs" may be established in single family residential
neighborhoods within the City, and
WHEREAS, on June 25, 2008, the Planning Commission conducted a duly noticed
public hearing on the proposed amendment, at which hearing the Commission carefully
reviewed and considered all of the evidence presented in connection with the project,
including but not limited to the staff report and all written and oral testimony presented,
and
WHEREAS, the Planning Commission has evaluated the potential environmental
impacts of the proposed Zoning Ordinance text amendment and determined that it is
Categorically Exempt under Section 15305 _ Minor Alterations in Land Use Limitations
— of the Guidelines for the Implementation of the California Environmental Quality Act in
that the proposed amendment does not result in any changes in land use or density.
THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS,-
Section 1: The Planning Commission hereby finds that adoption of the proposed
Zoning Text Amendment would:
a. Allow for the development and placement of well-designed signs which would
identify established single family neighborhoods,
b. Provide opportunities for residents of single family neighborhoods to enhance
neighborhood identity and promote neighborhood relations, and
C. Assure that neighborhood entry signs remain positive additions to the
community and minimize conflicts or disagreements over long-term
maintenance-
Section 2: The adoption of the proposed Zone Text Amendment would be consistent
with the intent of the Zoning Ordinance and the City's General Plan because it provides
for the establishment of neighborhood entry signs, in keeping with the following General
Plan Community Design Element policies:

PROJECT DESCRIPTION
The project is an amendment to the Palm Springs Zoning Code regarding the
establishment of standards and regulations for "neighborhood entry signs" in single
family neighborhoods- The single family neighborhood zones include:
- G-R-5 (Guest Ranch), and
- R-1 (Single Family), including -AH, -A, -B, -C, and -D zones
This report provides an analysis of neighborhood entry signs and options for their
regulation, including a recommendation for allowing the use in selected zones. A public
hearing is required.
RECOMMENDATION
That the Planning Commission conduct a public hearing and forward to the City Council
its recommendation for the establishment of standards and regulations for
"neighborhood entry signs" in the G-R-5 and all R-1 zones. A draft resolution is
attached.

PRIOR ACTIONS
On March 5, 2008, the City Council initiated a Zone Text Amendment to establish
standards and regulations for "neighborhood entry signs" in single family residential
zones.
BACKGROUND
On August 3, 2007, representatives of the Sunmor Neighborhood Association submitted
a request for approval of a free-standing monument sign with the word "SUNMOR".
The sign was proposed on private property — at the corner of 2639 Livmor Avenue. At
that time, staff indicated that there was no provision in the Palm Springs Zoning Code
for such a sign, and the application was not approved.
The applicants and staff have since met to consider options for allowing such signs, and
following a review of the issues, the City Council initiated a Zone Text Amendment to
allow consideration of new standards and regulations for "neighborhood entry signs".
ANALYSIS
It is not uncommon for single family residential neighborhoods to have a sign facing
major entry points displaying the name of the subdivision or project. However, such
signs are usually constructed by the original developer as a marketing tool to assist the
development during its initial sales. Such signs are also very common at the entries of
multi-family projects.
The City has been approached by residents of the Sunmor neighborhood seeking
permission for a new sign at this established single family neighborhood. (The Sunmor
Neighborhood is located just west of City Hall, and is generally bound by Andreas Road,
Farrell Drive, Alejo Road and Civic Drive.) We have also received questions from
residents in other neighborhoods regarding entry signs.
All signs in the City of Palm Springs are regulated by the Palm Springs Zoning Code.
The Code essentially limits signs in single family neighborhoods, such as Sunmor, to
home address numbers less than eight (8) inches in height. No other signs, except
emergency signs, are allowed. However, as noted below, the General Plan does
envision entry signage, as follows:

concerns regarding implementation of these policies, as discussed below.

Staff has met with members of the Sunmor neighborhood along with the City Attorney,
Director of Public Works and others to discuss how the City might address

program would be subject to review by the AAC and approved by the
Directors of Planning and Public Works, to include:
a. Proposed number and location(s)
b. Proposed size, design, color and materials
2. Any individual property owner on whose property a sign is proposed must
be a signatory to the sign program application. No signs may be allowed
in the public right-of-way.
3. Certain legal documents as determined by the City Attorney must be
executed prior to the approval or installation of any sign. Such documents

provisions.
The following zone text amendment language has been prepared based on the above
concepts:
Add a definition of"neighborhood entry signs" to Sign Ordinance (Section 93.20.03):

Add standards for such signs within the Sign Ordinance's General Provisions — Other
(Section 93.20.10.C):

zone, subject to the following provisions.-

Staff believes that limiting entry signs to those neighborhoods organized under the Office
of Neighborhood Involvement promotes these neighborhood's boundaries, which have
already been established and agreed to. Further, organized neighborhoods have
leadership groups and communication structures in place to assure that entry signs are
supported at the neighborhood level prior to making application to the City.
The use of the Sign Program would allow for full consideration of the overall plan for
signing a single family neighborhood. Sign programs are first reviewed by the
Architectural Advisory Committee for their comments and recommendation, and then
reviewed for action by the Planning Commission.

Request to Construct a Neighborhood Identification Sign
Mr. Marshall,
Thank you for submitting the neighborhood identification sign for the Sunmore
subdivision. Unfortunately, these types of signs are not presently permitted within
single-family zones by the Palm Springs Zoning Code.
Planning staff is working with the Office of Neighborhood Involvement and the Director
of Public Affairs to determine what policies and provisions might be appropriate for
these types of signs- Staff notes that the Community Design Element of the recently
adopted General Plan, specifically CD2.4 and CD9.5, envisions these kinds of signs- A
discussion will be held by the ONI Committee at a meeting on December 13, 2007. The
meeting will begin at 5:30 a.m. in the Large Conference Room at City Hall, 3200 East
Tahquitz Canyon Way, Palm Springs, CA 92262. The meeting is open to the public and
your presence is welcome.
Please be aware, however, that until the Palm Springs zoning Code has been
amended, staff is unable to process your sign request. We will keep you informed with
the City's progress regarding these types of signs.

Subj: SUNMOR Neighborhood Sip-RESUBMITTAL
On August 3,2007,we submitted a request for approval for a"SUNMOR"neighborbood sign to be placed at
the comer of N.Farrell Drive and E.Livmor Avenue. After some consultation we were referred by the
Planning Department(Mr.Chris Ison)to the Engineering Department(Mr. Felipe Primers). On October 5's,
Mr.Primera made a very helpful site visit to the corner intended for the sign. Mr.Primera confirmed the
accuracy of our submitted site plan,and confirmed that an encroachment agreement with the city was not
required. However,measurements did confirm the intended sign placement falls within the"traffic line of
sight"triangle at this corner and hence the sign can he no higher than 30 inches. We have modified the sign
design to comply with this height restriction and are re-submitting;our request along with photographs of the
site(attachment i). we request that the Planning Department review our resubmitted request and forward it
to the Planning Commission for approval(sec attachment 2).
We also understand that even though the sign falls on private property,there may be city concern that the
sign will not be adequately cared for. in our original request(attachment 3)we included both the property
owner and neighborhood organiration's endorsement. Within the SUNMOR Neighborhood Organization
(SNO)we have discussed the importance of maintaining the sign,to include quick reactions to vandalism
(e.g.,graffiti),etc. Additionally,the current property owner has verbally agreed to append the necessary
documents to the re-sale of his property to ensure that future property ovmcrs understand their obligation
regarding the continued existence of the sir.
Recognizing there are no city guidelines and policies regarding neighborhood signs of this sort,we greatly
appreciate the efforts of the Planning and Engineering Departments to date.

Notional Design for SUNMOR Neighborhood Sign
Sign design consistent with other Palm Springs neighborhood signs, for example, "Park Imperial South"and
'Twin Paims Estates." Sign design echoes 9"Wx8" concrete blocks used in SUNMOR homes and throughout
Palm Springs. Notional sign is 8 feet long and 30"high (with first block course submerged 2 inches), Sign may
be straight, or slfghtly convex or concave, depending upon site considerations and painted in "desert colors" in a
retro palette. Letter font will he mid-century. Sign will read simply"SUNMOR".
