HomeMy WebLinkAbout1/5/2005 - STAFF REPORTS (14) DATE: January 5, 2005 TO: City Council FROM: Director of Strategic Planning ARCHITECTURAL ADVISORY COMMITTEE-LICENSED LANDSCAPE ARCHITECT RESIDENT AND REGISTERED VOTER REQUIREMENT RECOMMENDATION The Planning Commission recommends that the City Council approve by Resolution to allow a non- Palm Springs resident, and non-Palm Springs registered voter licensed landscape architect to serve on the Planning Commission Architectural Advisory Committee. SUMMARY Section 94.04.00.0 (Planning Commission Architectural Advisory Committee)of the Palm Springs Zoning Ordinance requires that one California licensed landscape architect be appointed. The Planning Commission just completed a call for applications and after a review determined that no such applications were filed. Additionally, staff has been unable to locate any California licensed landscape architects who reside in Palm Springs. BACKGROUND The Municipal Code allows the appointment of non-residents/non-registered voters provided it is allowed by law, or by ordinance, or resolution. The Architectural Approval Ordinance was specifically written to require a California licensed landscape architect. This position is needed to review landscape plans prepared by licensed landscape architects. The Planning Commission on December 8, 2004, appointed five(5) licensed architects as regular members and two (2) designers as alternates (interior and landscape). The Ordinance requires one (1) California licensed landscape architect. It appears that there are no practicing/licensed landscape architects who are Palm Springs residents and registered voters. The recommendation is to modify the resident/registered voter requirement in order to recruit a California licensed landscape architect. The Municipal Code allows Council to modify this requirement by Resolution. The new Architectural Advisory Committee(AAC)will have its first meeting on December 20, 2004. The City has historically had non-residents/non-registered voters appointed to the Design Review Committee and AAC. WHEREAS, Section 94.04.00.0 of the Zoning Ordinance requires that the Planning Commission appoint technical advisors to assist in reviewing detailed plans and that three(3)California licensed architects and one (1) California licensed landscape architect are required by the Ordinance; and WHEREAS, the City Council finds that appointment of residents and registered voters in the City is preferred and that under the City Council by law, Ordinance or Resolution may allow non- residents and non-registered voters to be appointed to boards and commissions, and committees; and WHEREAS, the Planning Commission called for applications for the Planning Commission Architectural Advisory Committee and received numerous applications; and WHEREAS, the Planning Commission reviewed all applications for qualifications and determined that there were no applications filed by California licensed landscape architects; and WHEREAS, the Planning Commission, at its December 8, 2004, meeting appointed five (5) California licensed architects and two (2) designers to the Planning Commission Architectural Advisory Committee; and WHEREAS,the Planning Commission recommends that it is in the best interest of the City to have a California licensed landscape architect on the Planning Commission Architectural Advisory Committee; and WHEREAS, the City Council is in agreement with the Planning Commission; NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs approves and authorizes the Planning Commission to appoint a California licensed landscape architect who is a non-Palm Springs resident and non-Palm Springs registered voterto the Planning Commission Architectural Advisory Committee.
