HomeMy WebLinkAbout1/5/2005 - STAFF REPORTS (19) . EXECUTIVE ORDER NO. 1 EXECUTIVE ORDER PROCLAIMING EXISTENCE OF A LOCAL EMERGENCY (BY CITY MANAGER). WHEREAS, Ordinance No. 2.20 of the City of Palm Springs empowers the Director of Emergency Services (City Manager) to proclaim the existence or threatened existence of a local emergency when said city is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, the Director of Emergency Services (City Manager) of the City of Palm Springs does hereby find; That conditions of extreme peril to the safety of persons and property have arisen within said city, caused by excessive rainfall and prolonged flash flooding occurring on December 28th and 29th, 2004; and That the City Council of the City of Palm Springs is not in session (and cannot immediately be called into session); NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said city; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions and duties of the emergency organization of this city shall be those prescribed by state law, by ordinances, and resolutions of the City of Palm Springs, SEMS and the Multihazard Functional Plan, as approved by the City Council on March 3, 2004. ADOPTED this day of , 2005 AYES: NOES: ABSENT: ATTEST: CITY OF PALM SPRINGS, CALIFORNIA By City Clerk City Manager RESOLUTION NO. �F/ ; OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RATIFYING THE EXISTENCE OF A LOCAL EMERGENCY, PROCLAIMED BY THE CITY MANAGER ON DECEMBER 29, 2004 WHEREAS, Ordinance No. 2.20 of the City of Palm Springs empowers the Director of Emergency Services (City Manager) to proclaim the existence or threatened existence of a local emergency when said city is affected or likely to be affected by a public calamity and the City Council is not in session, subject to ratification by the City Council within seven days; and WHEREAS, conditions of extreme peril to safety of persons and property have arisen within this city caused by excessive rainfall and prolonged flash flooding commencing on December 28 and 29`h , 2004, at which time the City Council of the City of Palm Springs was not in session; and WHEREAS, said City Council does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency; and WHEREAS, the Director of Emergency Services (City Manager) of the City of Palm Springs did proclaim the existence of a local emergency within the city on the 291h day of December, 2004; NOW THEREFORE, IT IS HEREBY PROCLAIMED AN ORDERED that said local emergency shall be deeded to continue to exist until its termination is proclaimed by the City Council of the City of Palm Springs, California. IT IS FURTHER RESOLVED that John Hardcastle, Emergency Services Coordinator, is hereby designated as the authorized representative of the City of Palm Springs for the purpose of receipt, processing and coordination of all inquiries and requirements necessary to obtain available state assistance.
