O�pA-LM Sp? ti � iy c+ e 9`If;0 CITY COUNCIL STAFF REPORT DATE: October 15, 2008 PUBLIC HEARING SUBJECT: CASE RSPB #59 A, B, and C: APPLICATION FOR DESIGNATION OF THE PROPERTIES KNOWN AS "THE CASA CODY HOTEL" LOCATED AT 141 SOUTH CAHUILLA ROAD, 175 SOUTH CAHUILLA ROAD, AND 300 WEST ARENAS ROAD AS CLASS 1 HISTORIC SITES, INCLUDING DESIGNATING THREE ELEMENTS WITHIN THE HOTEL COMPLEX AS CLASS 2 HISTORIC SITES. Ready, City Manager BY: The Planning Department SUMMARY Under Section 8.05 of the Palm Springs Municipal Code (Historic Resources), the City Council may designate properties as Class 1 or Class 2 historic sites. The City Historic Site Preservation Board (RSPB) has recommended such designations for the three parcels that comprise "The Casa Cody Hotel", including 'The Winter Residence." It is noteworthy that two of the sites have both Class 1 and Class 2 potential designation recommendations. The three properties are addressed as 141, and 175 South Cahuilla Road and 300 West Arenas Road. The Council will conduct a public hearing and determine if these sites and certain buildings and structures on them should be designated. Class 1 and Class 2 designation would place the sites under the guidance of Municipal Code Section 8.05 "Historic Preservation". RECOMMENDATION Adopt Resolution No. : "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DESIGNATING THE STRUCTURE THE WINTER HOUSE AND THE MCCALLUM ERA STONE WALL AT 141 SOUTH CAHUILLA ROAD AS CLASS ONE HISTORIC SITE #59A." APACHE LODGE AS CLASS TWO SITES. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DESIGNATING THE ORIGINAL ADOBE WALLS AND WOOD SHUTTERS OF THE ADOBE HOUSE AT 300 WEST ARENAS ROAD AS CLASS ONE HISTORIC SITE #59C, AND DESIGNATING THE SOUTH PORTION OF THE EL RINCON HOTEL AND APARTMENT BUILDINGS AS A CLASS TWO HISTORIC SITE. BACKGROUND AND SETTING The Casa Cody Hotel is comprised of three parcels located at the northwest corner of South Cahuilla Road and West Arenas Road in the Historic Tennis Club Neighborhood. There are a total of eight structures constructed over a period of time from the 1900's through the 1950's dispersed throughout the three sites as well as other potentially historic objects including a stone perimeter wall and a fragment of a stone-lined irrigation ditch. The structures vary in age, style, and basis for consideration of their historic significance. Each structure is identified and analyzed in the HSPB staff report. The three parcels, originally part of the Judge John McCallum land holdings, have been operated as a series of small "boutique hotels" for many decades; The Adobe Lodge, The El Rincon Apartments, and The Casa Cody Inn. These small hotels were consolidated over time and are now operated as one business, with the recent addition of the Winter Residence at 141 South Cahuilla Road. They are taken from the HSPB Staff Report as potential sites and other specific structures for Class 1 Designation as follows: 141 South Cahuilla Road, 0.36 acres Lots 5 and 6 Structures on this parcel: The Winter House and the McCallum era stone wall. 175 South Cahuilla Road, 0.76 acres, Lots 7, 8, 9 and 10 Structures on this parcel: The Apache Lodge, The Casa Cody Building, the north addition to the El Rincon Apartment Building, the Cottage from the 1932 LA Olympics, and a portion of the McCallum era stone wall. 300 West Arenas Road; 0.43 acres, Lots 11, 12, and 13 The south half of the El Rincon Apartment Building, the Adobe House, a c.1940's cottage and a fragment of the McCallum era, irrigation ditch. On April 27, 2007, Mr. Frank Tysen, owner of The Casa Cody filed an application requesting The Casa Cody Hotel be designated a Class I historic site. Such designation would: 1. Place the subject property/ies under the guidance of Municipal Code Section 8.05 ..-�- 22 City Council Staff Report October 15,2008 Case, HSPB No.59/The Casa Cody Hotel Page 3 of 7 2. Require present and subsequent owners to maintain the site(s) consistent with that ordinance, 3. Grant passible property tax reduction opportunities to the owner under the State of California Mills Act. The Class 1 designation proposal was presented to the Historic Site Preservation Board (HSPB) at the September 11, 2007 meeting. More descriptive information can be found in the attached HSPB staff report and attachments. PRIOR ACTIONS In 2004, a professional historic resources consultant, The Architectural Resources Group (ARG) in a Citywide Historic Resources Survey, identified the Casa Cody site. It notes: "The Casa Cody possesses sufficient historic importance to deem it eligible for individual listing on the National Register of Historic Places, or the California Register of Historical Resources at a local level."ARG also noted that in 1981, The Casa Cody and the Winter Residence were listed on the Riverside County Historic Resources Survey, and in 2001, The Casa Cody and the Winter Residence were identified in the City's 1981 Inventory of Historic Structures. On April 27, 2007, the City received an application by Mr_ Frank Tyson, owner, for the historic designation of the Casa Cady Hotel. On May 8, 2007, the Historic Site Preservation Board initiated study and investigation of the site for possible recommendation to City Council for Class 1 designation. On September 11, 2007, the Historic Site Preservation Board evaluated the application and elected to make individual recommendations to the City Council on each legal parcel that comprises the Casa Cody Hotel. • The Board voted 5-0-2 to recommend that the City Council designate the structure called The Winter House and the McCallum era stone wall at 141 South Cahuilla Road as Class I Historic Site #59A. • The Board voted 5-0-2 to recommend that the City Council designate the structure called The Casa Cody Hotel, and the McCallum stone wall at 175 South Cahuilla Road as Class 1 Historic Site #59B. The vote also included recommending the Olympic Cottage and the Apache Lodge as Class 2 designations. • The Board voted 5-0-2 to recommend that the City Council designate the original adobe walls and wood shutters of the structure called The Adobe House, and the McCallum era irrigation ditch at 300 West Arenas Road as Class 1 Historic Site #59C. The vote also included recommending the south portion of the El Rincon Hotel and Apartments as a Class 2 designation. • HSPB Resolutions #59A, #59B and #59C are attached. City Council Staff Report October 15,2008 Case: HSPB No. 59/The Casa Cody Hotel Page 4 of 7 ANALYSIS The Board evaluated Casa Cody as three individual parcels, which allows the Board and the Council to evaluate each parcel and the structures therein on its own merit for potential designation without lot mergers and without a requirement for collective period or aesthetic commonality that would be required if considered as a historic district. REQUIRED FINDINGS Definition of a Historic Site and a Historic District. Section 8.05.020 of the Municipal Code provides the definition of an historic site and historic district as follows; (a) Historic Site. A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect and: 1. That is associated with events that have made a meaningful contribution to the nation, state or community; or 2. That is associated with lives of persons who made meaningful contribution to national, state or local history; or 3. That reflects or exemplifies a particular period of the national, state or local history; or 4. That embodies the distinctive characteristics of a type, period or method of construction; or 5. That presents the work of a master builder, designer, artist, or architect whose individual genius influenced his age; or that possesses high artistic value; or 6. That represents a significant and distinguishable entity whose components may lack individual distinction; or 7. That has yielded or may be likely to yield information important to national, state or local history or prehistory. During the nomination process, the HSPB discussed the buildings and specific structures on each of the three parcels. The Board agreed on specific items located in each parcel for potential Class 1 Designation in addition to the specified structures on site. Three sites are also nominated for potential Class 2 Designation. The nominated addresses, building names and specific items for potential designation by the HSPB are listed below: • HSPB 59A-141 South Cahuilla Road, "The Winter House"- Designate the exterior only of the Winter House and the McCallum era stone wall as Class 1 Historic site #59A and add the defining characteristics as shown on page 16 of the HSPB Staff Report: The entire McCallum stone wall, and the exterior clay tile roof, the smooth stucco exterior walls, the exposed wood timbers of the porch structure, and the wood shutters of the Winter House." The owner's pursuit of historic designation of the Winter House at 141 South Cahuilla would also satisfy a condition of sale placed upon that property by the previous owner in the sales agreement between Ms. Winter and Mr. Tyson requiring preservation of the exterior of that structure (copy of agreement attached). • HSPB 5913-175 South Cahuilla Road, "The Casa Cody Hotel"- Designate the entire McCallum stone wall and exterior only of the Casa Cody Hotel (Inn) as a Class 1 Historic Site #59B and the defining characteristics as shown on page 16 of the HSPB Staff Report: The clay tile roof, the smooth stucco exterior walls, and the exposed wood timbers of the original porch structure only of the Casa Cody. Structures on this parcel include The Apache Lodge, The Casa Cody Building, the north addition to the El Rincon Apartment Building, the Cottage from the 1932 LA Olympics, and a portion of the McCallum era stone wall. The Board's recommendation is to designate the Olympic Cottage and the Apache Lodge, as Class 2. Supporting arguments as to why these two buildings do not meet Class 1 status are discussed on pages 7 through 11 of the HSPB Staff report. • HSPB 59C- 300 West Arenas Road; "The Adobe House" Designate as Class 1 Historic Site #59C the Adobe House, and the defining characteristics as shown on page 16 of the HSPB Staff Report: the McCallum era irrigation ditch, the original adobe walls and wood shutters, only of the adobe house excluding the clay roof tiles, roof and porch structure. Structures on this parcel include the south half of the El Rincon Apartment Building, the Adobe House, a c.1940's cottage and a fragment of the McCallum era irrigation ditch. The Board's recommendation is to designate the McCallum era irrigation ditch as a Class 1 site and the south portion of the El Rincon Apartment Building City Council Staff Report October 15,2008 Case: HSPB No. 59/The Casa Cody Hotol Page 6 of 7 as Class 2. Supporting arguments as to why these three buildings do not meet Class 1 status are discussed on pages 11 & 12 of the HSPB Staff Report. OWNER PARTICIPATION During public testimony at the HSPB meeting of September 11, 2007, the owner stated it was his desire to designate the Casa Cody as a historic site, but also to leave open the possibility of merging the lots and constructing future infill of additional hotel units on the subject parcels. This was discussed and analyzed in detail in the HSPB Staff Report. After recently speaking with the owner, Mr. Frank Tyson regarding combining the sites, future construction and density, he has changed his mind and stated he is not interested in expanding at this time. ENVIRONMENTAL ASSESSMENT In accordance with Section 15331 (Historical Resources Restoration/Rehabilitation) of the California Environmental Quality Act (CEQA), the proposed designation is categorically exempt from environmental review as the proposed designation meets the conditions outlined for preservation of a historic resource. RECOMMENDATION Staff recommends that the City Council designate: • The structure called The Winter House and the McCallum era stone wall at 141 South Cahuilla Road as Class I Historic Site #59A. • The structure called The Casa Cody Hotel, and the McCallum stone wall at 175 South Cahuilla Road as Class 1 Historic Site #59B. Also, designate the Olympic Cottage and the Apache Lodge as Class 2. • The original adobe walls and wood shutters of the structure called The Adobe House and the McCallum era irrigation ditch at 300 West Arenas Road as Class 1 Historic Site #59C. Also, designate the south portion of the El Rincon Hotel and Apartments as Class 2. NOTIFICATION Pursuant to section 8,05.140 of the Municipal Code of Palm Springs, all property owners within four hundred (400) feet of the subject property have been notified and notice was published in a newspaper of general circulation. As of the writing of this report, staff has not received any inquiries on this proposed designation. The Casa Cody Hotel is a small resort hotel comprised of several buildings of varying architectural styles and ancillary structures built over several decades on three lots in the Historic Tennis Club Neighborhood. 2. The structures on the three lots at the Casa Cody site have been individually identified and evaluated against the findings of Chapter 8.05 of the City of Palm Springs Municipal Code: 3. The structures located at 141 South Cahuilla Road include: Object 1: The Winter House, and Object 2: The McCallum era stone wall. 4. Separate resolutions will be made for 175 South Cahuilla Road and 300 West Arenas Road. THE CITY COUNCIL DOES HEREBY RESOLVE: Section 1: Pursuant to CEQA, the City Council finds that the designation of the building at 141 South Cahuilla Road as a Class 1 historic site is categorically exempt from environmental review pursuant to Section 15331 whereby this designation is for the preservation of a historical resource. Section 2: The Winter House meets the definition of a Class 1 historic site in the following ways: (a) A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The Winter House meets this definition of a historic site because it is a fairly good example of a modest Spanish Colonial Revival style residence. The defining characteristics are its two piece clay barrel roof tiles, heavy timber roof beams and porch columns, smooth stucco exterior walls, and low gable style roof. The structure has steel hinge pins at the windows and doors on which original wood shutters were hung. CC Resolution October 15 2008 Page 3 o1 A (b) That reflects or exemplifies a particular period of the national, state or local history; or The Winter House is an example of the early period of resort development in Palm Springs from the 1920's through the 1940's when many affluent and notable families from the Los Angeles area and elsewhere built modest homes for weekend and vacation get-a-ways. (c) That embodies the distinctive characteristics of a type, period or method of construction; or The Winter House embodies the characteristics of the typical wood frame and stucco homes built during the 1920's through the 1940's using picturesque revivalist architectural styles. Section 2: The McCallum era stone wall located on the western side of 141 South Cahuilla Road meets the definition of a Class 1 historic site in the following ways: (a) That is associated with lives of persons who made meaningful contribution to national, state or local history. The stone wall is historically significant because it is identified as having been constructed for Judge John G. McCallum, who owned this parcel as part of a much larger land holding. Judge McCallum historically significant because he is credited as being the first non-Indian settler in Palm Springs, having arrived in the 1880's and encouraged many other settlers to come to Palm Springs in an effort to develop an agricultural community. (b) That reflects or exemplifies a particular period of the national, state or local history. The stone wall is historically significant because it reflects a built element from the earliest period of non-Indian settlement of Palm Springs. Section 3: Based upon the foregoing, the City Council does hereby designate 141 South Cahuilla Road, Palm Springs, California "The Winter House", as a Class 1 Historic Site subject to the following conditions; 1. The property owner shall permit the City to demark the building as a historic site with a marker of the City's choosing. The historic marker shall be placed in a location visible from the public right-of-way. The owner shall maintain the J CC Resolution October 15,2008 Page 4 of 4 marker in the location installed and pay for the replacement cost if the marker is lost, stolen, or otherwise removed from the property. 2. All future exterior modifications including but not limited to building, site, landscaping, lighting, walls, and fences shall require Architectural Approval pursuant to Section 94.04.00 of the Palm Springs Zoning Ordinance and Historic Site Preservation Board review pursuant Municipal Code Ordinance 8.05.180. 3. No permit for the alteration of the exterior, including signage and any and all of the defining elements and characteristics shall be issued without prior approval by the Historic Site Preservation Board. 4. That the City Clerk submits the Council Resolution to the County recorder for recordation within 90 days of the effective date of this resolution. 5. All existing or previously approved alterations shall be considered acceptable. 6. Only designate the entire McCallum era stone wall, the smooth stucco exterior walls, the exposed timbers of the porch structure, and the wood shutters of the Winter House in the Class 1 designation. THE CITY COUNCIL DOES HEREBY RESOLVE: Section 1: Pursuant to CEQA, the City Council finds that the designation of the building at 175 South Cahuilla Road as a Class 1 historic site is categorically exempt from environmental review pursuant to Section 15331 whereby this designation is for the preservation of a historical resource. Section 2: The Casa Cody Hotel meets the definition of a Class 1 historic site in the following ways: (a) A historic site is any real property such as, a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The Casa Cody is an example of a modest Spanish Colonial ranch style building. Its defining characteristics are its wide covered porches, entry to the various rooms taken from the covered porch, the smooth stucco walls and the roof of two piece clay barrel tile. (b) That is associated with lives of persons who made meaningful contribution to national, state or local history. CC Resolution October 15,2008 Page 3 of 5 Casa Cody is historically significant because it is associated with persons who made meaningful contributions to local history. Harold and Harriet Cody arrived in Palm Springs in 1916. Harold Cody was the cousin of "Buffalo Bill" Cody, a well known wild- west performer. Harriet Cody's entrepreneurial spirit made her a notable figure in the early years of Palm Springs development as a resort town. She was encouraged to enter the hotel business by close friend Nellie Coffman who owned the Desert Inn. Mrs. Cody established the Casa Cody after Harold Cody's death. Harriet Cody also owned and operated a "dude" stable in the south end of Palm Springs. Horseback riding was one of the most popular pastimes in Palm Springs during the early 1900's. She became a prominent, well known and respected person in the Palm Springs community whose business enterprises were directly associated with the early development of Palm Springs as a resort destination. (c) That reflects or exemplifies a particular period of the national, state or local history. Casa Cody is historically significant because it exemplifies the type of residential development common in Palm Springs in its earliest years of non-Indian settlement. The French doors and trellis structures are not defining characteristics of this structure. Section 3: The McCallum era stone wall located on the western side of 141 South Cahuilla Road meets the definition of a Class 1 historic site in the following ways: (a) That is associated with lives of persons who made meaningful contribution to national, state or local history. The stone wall is historically significant because it is identified as having been constructed for Judge John G. McCallum, who owned this parcel as part of a much larger land holding. Judge McCallum historically significant because he is credited as being the first non-Indian settler in Palm Springs, having arrived in the 1880's and encouraged many other settlers to come to Palm Springs in an effort to develop an agricultural community. (b) That reflects or exemplifies a particular period of the national, state or local history. The stone wall is historically significant because it reflects a built element from the earliest period of non-Indian settlement of Palm Springs. Section 3: The Apache Lodge meets the definition of a Class 2 historic site in the following ways: CC Resolution October 15.2008 Page 4 of 5 The Apache Lodge was owned for several years by actress Polly Bergen. Although Ms. Bergen is identified as a recognized name in the movie and film industry, her association with the Apache Lodge is limited to a short period of ownership. Ms. Bergen's career development or achievements are not directly associated with the Apache Lodge, thus its historic importance due to association with a person of significance is minimal. The Apache Lodge is typical of countless small motor lodges constructed during and after World War II. It is a simple utilitarian structure without any particular aesthetic effect. Thus, while it typifies the type of accommodation built during that period, it does not stand as a particularly notable or outstanding example of such construction. Section 4: The Olympic Cottage meets the definition of a Class 2 historic site in the following ways: The Olympic Cottage was relocated from the grounds of the 1932 Olympic Village in Los Angeles. Although significant because of its association with this 'first of its kind' Olympic Village, it has been significantly altered and deteriorated and lacks adequate historic integrity to merit higher historic classification. Section 5: The north addition of the El Rincon Apartments does not meet the definition of a historic site. It is defined as a "non-contributing" object on the site and no historic classification is assigned this structure. Section 6: Based upon the foregoing, the City Council designates 175 South Cahuilla Road as Class 1 Historic Site 59B subject to the following conditions; 1. The property owner shall permit the City to demark the sites with historic markers of the City's choosing. The historic markers shall be placed in a location visible from the public right-of-way. The owner shall maintain the historic markers in the location installed and pay for the replacement cost if the markers are lost, stolen, or otherwise removed from the property. 2. All future exterior modifications to the site including but not limited to building, lighting, walls, and fences shall require review and approval by the Historic Site Preservation Board pursuant Municipal Code Ordinance 8.05.180_ 3. No permit for the alteration of the exterior, including any and all of the defining elements and characteristics shall be issued without prior approval by the Historic Site Preservation Board. 4. That the City Clerk submit the Council Resolution to the County recorder for recordation within 90 days of the effective date of this resolution. 5. All existing or previously approved alterations shall be considered acceptable. 6. Only designate the entire McCallum era stone wall, exterior of the Casa Cody Hotel, the clay tile roof, the smooth stucco exterior walls and the exposed wood timbers of the original porch structure of Casa Cody. The Casa Cody Hotel is a small resort hotel comprised of several buildings of varying architectural styles and ancillary structures built over several decades on three lots in the Historic Tennis Club Neighborhood- 2- The structures on the three lots at the Casa Cody site have been identified as follows and evaluated individually against the findings of Chapter 8.05 of the City of Palm Springs Municipal Code: 3. The structures located at 300 West Arenas Road include: Object 7: The El Rincon Apartments, Object 8: The 1940's Cottage, Object 9: The Adobe House, Object 10: The McCallum era irrigation ditch, and Object 11: The 1940's east wall of the El Rincon Apartments. 4. Separate resolutions will be made for 141 South Cahuilla Road and 175 South Cahuilla Road. THE CITY COUNCIL DOES HEREBY RESOLVE: Section 1: The Adobe House meets the definition of a Class 1 historic site in the following ways: (a) A historic site is any real property such as. a building, a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The adobe house is historically significant because it is a unique and surviving example of a vernacular adobe structure. The estimated date of construction of around 1910 or 1916 makes this one of the earliest structures built in Palm Springs that is still standing. (b) That reflects or exemplifies a particular period of the national, state or local history. --�_ 2 0 CC Resolution October 15,2008 Page 3 of 5 The adobe house was constructed using local labor prior to the period when Palm Springs experienced its first boom years as a resort destination in the 1920's and 1930's. At the time of its construction, Palm Springs was still a very small desert village comprised mostly of early settlers who pursued agricultural pursuits or fledgling businesses related to the mineral springs and the provision of treatment of visitors seeking relief from illnesses such as tuberculosis. The adobe house is historically significant because it reflects or exemplifies a building type from the earliest period of Palm Springs non-Indian settlement. (c) That embodies the distinctive characteristics of a type, period or method of construction. The adobe house embodies the distinctive characteristics of the adobe method of construction, using sun-dried clay masonry units laid up in thick walls by hand in an un- reinforced manner. Adobe construction, now rare, was a common construction method for early settlers through the southeastern United States in the late 1800's and early 1900's. The defining characteristics of the Adobe House are the exterior walls and wood shutters. The clay tile roof, wood timbers and steel porch columns are not from the historic period and are not considered defining characteristics of the Adobe House. Section 2: The McCallum era stone-lined irrigation ditch meets the definition of a Class 1 site in the following ways. (a) That is associated with lives of persons who made meaningful contribution to national, state or local history. This section of stone lined irrigation ditch is a remnant of a large network of irrigation channels and ditches built under the direction of Palm Springs first non-Indian settler, Judge John G. McCallum- (b) That embodies the distinctive characteristics of a type, period or method of construction. Throughout Palm Springs history, the conveyance and availability of water from either mountain streams or underground aquifers has been an important part of the development of the City. This stone-lined ditch represents the earliest example of man- made redirection of water flow from the adjacent mountains into the valley floor for irrigation of newly planted agricultural fields. Later systems of steel pipes and storage tanks would replace this early form of water conveyance. (c) That reflects or exemplifies a particular period of the national, state or local history. The irrigation channels such as this one constructed by local labor for Judge John G. McCallum reflect the earliest efforts of non-Indian settlers to capitalize on the natural ____ 21, CC Resolution October 15,2008 Page 4 of 5 resources of the Palm Springs area for purposes of development. Judge McCallum's vision was of Palm Springs as the center of a vast agricultural center that would supply early produce to the growing population of Las Angeles. His enterprise was dependent on a reliable water source feeding the valley floor through stone lined channels and ditches such as this one. McCallum's dream was ruined by torrential rains in 1893 that washed out most of the channels and ditches followed by a ten year drought that forced most of the settlers to abandon Palm Springs. Section 3: The El Rincon Apartments meet the definition of a Class 2 site in the following ways: The El Rincon Apartments are said to have been designed by John Porter Clark. No evidence has been provided to support this assertion. The El Rincon Apartments were built by Francis Crocker. Francis Crocker is recognized locally as one of the driving forces behind the development of the Palm Springs Tram, however the El Rincon Apartments do not have any relationship to Mr. Crocker's involvement with the Tram, thus while he was the owner of the property when it was built, this association is not sufficient to merit higher historic classification. Section 4: The 1940's cottage does not meet the definition of a historic site. It is defined as a "non-contributing" abject on the site and no historic classification is assigned this structure. Section 5: The 1940's era east brick wall of the El Rincon Apartments does not meet the definition of a historic site. It is defined as a "non-contributing' object on the site and no historic classification is assigned this structure. A draft resolution is attached for consideration. PRIOR ACTIONS In 2004, the Casa Cody site was identified in the Citywide Historic Resources Survey as possessing significant historic importance. On April 27, 2007, the City received an application by Mr. Frank Tysen, owner, for historic designation of the Casa Cody. On Tuesday, May 8, 2007 the Board initiated the study and investigation of this site for possible recommendation to City Council for Class 1 designation. BACKGROUND AND SETTING Definition of an Historic Site and a Historic District. Section 8.05.020 of the Municipal Code provides the definition of an historic site and historic district as follows; (a) Historic Site. A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect and: 1. That is associated with events that have made a meaningful contribution to the nation, state or community; or 2- That is associated with lives of persons who made meaningful contribution to national, state or local history; or 3- That reflects or exemplifies a particular period of the national, state or local history; or 4- That embodies the distinctive characteristics of a type, period or method of construction; or 2 _. _ 25 Historic Sile Preservation Board Staff Report Page 3 of 17 Case HSPe-59 Date September 11,2007 5. That presents the work of a master builder, designer, artist, or architect whose individual genius influenced his age; or that possesses high artistic value; or 6. That represents a significant and distinguishable entity whose components may lack individual distinction; or 7. That has yielded or may be likely to yield information important to national, state or local history or prehistory. The definition above is used to evaluate sites for possible Class 1 historic designation. (b) Historic District. Any area of the city of Palm Springs containing a number of structures, natural features or sites having historic, architectural, archaeological, cultural or aesthetic significance and designated as an historic district under the provisions of this chapter. (Ord. 1320 § 1, 1988; Ord. 1140 § 1 (part), 1981) The Casa Cody site, because it is comprised of several parcels, numerous buildings and other historic elements and natural features, may be capable of being evaluated as a historic district. A Class 1 Historic Site or Historic District may also qualify for historic designation at the federal, state and/or county level. Designation of Historic Sites and Districts. The City Council is authorized to designate Historic Sites and Districts. The Historic Site Preservation Board may recommend to the City Council that certain sites or districts be designated as 'Historic' in accordance with Section 8.05.136 of the Municipal Code. The Board may initiate studies, surveys and investigations it deems necessary to adequately gather information in consideration of a recommendation. Conditions that apply to Class 1 Historic Districts. According to Section 8.05 of the Municipal Code, the following shall apply to a Historic District; 1. It shall meet the definition of an historic district as outlined in Municipal Code Section 8.05.020. 2. An archival file shall be maintained on the property by the City including a map delineating contributing and non-contributing structures or sites. 3. Contributing structures/sites shall be subject to Class 1 regulations until such time that they may be reclassified. 4. Noncontributing structures/sites shall be subject to review by the HSPB before demolition or construction (alteration or new construction). 5. A specific plan, containing special regulations pertaining to the subject area may be adopted for each district. 7. A historic preservation combining zone may be created pursuant to Zoning Ordinance Section 92.24.00. 8. Compliance with all rules and regulations for Historic Sites and Historic Districts under Article IV of Chapter 8,05 of the Municipal Code shall be required. DESCRIPTION AND ANALYSIS The structures that comprise Casa Cody are developed on three parcels located at the northwest corner of South Gahuilla Road and West Arenas Road in the Tennis Club Neighborhood. The subject structures are eight modestly scaled buildings constructed over a period of time from the 1900's through the 1950's, surrounded by open lawn and pool areas and perimeter stone and masonry walls. The area, originally part of [he Judge John McCallum land holdings, has been operated as a series of small "boutique hotels" for many decades. These small hotels were consolidated over time and are now operated as one business- The structures associated with each of the lots are noted as follows: 141 South Cahuilla Road, 0-36 acres Lots 5 and 6 Structures on Lhis parcel: The Winter House and the McCallum era stone wall. 175 South Cahuilla Road, 0.76 acres, Lots 7, 8, 9 and 10 Structures on this parcel: The Apache Lodge, The Casa Cody Building, the north addition to the El Rincon Apartment Building, the Cottage from the 1932 LA Olympics, and a portion of the McCallum era stone wall. 300 West Arenas Road-, 0.43 acres, Lots 11, 12, and 13 The south half or the El Rincon Apartment Building, the adobe house, a CA 940's cottae and a fragment of the McCallum era irrigation ditch. Since each lot contains multiple structures, each structure or object on the site will be separately identified, described and evaluated against the findings of Municipal Code Section 8.05.020 below. For reference, Staff has numbered and identified the structures (objects) from north to south as follows. 1 141 South Cahuilla: The Winter House (identified on Map "B" page 13 of the application as building "IV"); a Spanish Revival style building of approximately 2,100 sf. Constructed in 1932 and purchased in 1936 by Francis Winter of Beverly Hills as a vacation home. 2 The McCallum era stone wall. An approximately 2,750 sf structure and adjacent swimming pool built in the 1940's. 4 175 South Cahuilla: Casa Cody Hotel (identified on Map "B" page 13 of the application as building "II"); The original home, an adobe structure, was built in the 1920's but was demolished after it was heavily damaged after an earthquake in 1948. The current structure is comprised of an original structure from the 1930's with additions added through the 1930's and 1940's. 5 The cottage relocated from the 1932 LA Olympic Village (identified on Map "B" page 13 of the application as "'imported'cottage from the L.A. 1932 Olympics"); 6 The north addition to the El Rincon Apartment Building (identified on Map "B" page 13 of the application as "1950'built after earthquake'); Approximately 2,600 sf; built circa 1951. 7 The south part of the El Rincon Apartment Building (identified on Map "B" page 13 of the application as "V; "The original El Rincon Hotel'); The El Rincon Hotel and Apartments was constructed in the 1940's by Francis Crocker. 8 The 1940's cottage (identified on Map "B" page 13 of the application as "#18 Cottage 1940'); 9 The Adobe House (identified on Map "B" page 13 of the application as "I, The adobe house'); Approximately 1,200 sf. Built around 1910 in a vernacular style with a two piece clay barrel tile roof that is not original and adobe style brick walls. 10: Fragment of the McCallum era irrigation ditch. (identified on Map "D", page 15 of the application as "section of original whitewater irrigation system'); 11: The 1940's era east wall of the El Rincon Apartment site. (identified in Map "D" page 15 of the application as "original (1940's) brick walls') REQUIRED FINDINGS The Casa Cody site is unique in that it is comprised of several separate parcels with individual assessor parcel numbers, as well as separate structures and historic elements from varying periods and conditions. In light of this, Staff has determined that each structure or object on the site should be evaluated individually against the definition of a historic site in order to determine those elements are contributing or noncontributing and the level of possible historic classification for each. Following is Staffs evaluation of each object and the relative findings and recommendations. The Casa Cody may be designated as a single site, multiple individual sites, or as a historic district. 5 ?, 3 Historic Site Preservation Board Staff Report Page G of f 7 Case HSPB-59 Date September 11,2007 Object 1 141 South Cahuilla: The Winter House Findings: The Winter House may meet the definition of a Class 1 site in the following ways: (a) Historic Site. A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The Winter House may meet this definition of a historic site because it is a fairly good example of a modest Spanish Colonial Revival style residence. The defining characteristics are its two piece clay barrel roof tiles, heavy timber roof beams and porch columns, smooth stucco exterior walls, and low gable style roof. The structure has steel hinge pins at the windows and doors on which original wood shutters were hung. The owner reports to have the shutters but they were not present upon inspection of the site. To increase the sites' historic integrity, these wood shutters should be reinstalled. That is associated with lives of persons who made meaningful contribution to national, state or local history Although the Winter House is associated with Mr. and Mrs. Francis Winter, Staff does not believe they represent individuals who made meaningful contributions to national, state or local history, Mr. Winter was a mortgage broker from Beverly Hills and bought the home in 1936. It is noted that Mrs. Winter was known locally for her preservation efforts in the Tennis Club neighborhood.' That reflects or exemplifies a particular period of the national, state or local history; or The Winter House is an example of the early period of resort development in palm Springs from the 1920's through the 1940's when many affluent and notable families from the Los Angeles area and elsewhere built modest homes for weekend and vacation get-aways. That embodies the distinctive characteristics of a type, period or method of construction; or The extent of her individual contribution to preservation of the Tennis Club neighborhood appears to have been limited to refusing to sell the Winter home for inclusion in a redevelopment district and a suit against the City in 1984 preventing the Winter property from being condemned as part of the establishment of a redevelopment district in the area. The suit resulted in the City gaining first right of refusal in the event the Winters sold the property and yielded a development agreement allowing density transfer from the Winter parcel to the adjacent parcels to the north. 6 __ _ , _ 29 Historic Site Preservation Board Staff Report Page 7 of 17 Case HSPB-50 Dale September 11,2007 The Winter House embodies the characteristics of the typical wood frame and stucco homes built during the 1920's through the 1940's using picturesque revivalist architectural styles. The Winter House is part of a multi-party development agreement between the City and the owner of the parcel to the north of the Winter parcel. This development agreement involved density transfer from the Winter parcel to the parcel to the north. As part of this agreement dated June 2, 2004, the owner of the Winter parcel acknowledged in Exhibit "E" "Consent to project" that a condition of sale was placed on the sales agreement between Mrs. Winter and Mr Tysen, that upon purchase, Mr. Tysen would preserve the exterior of the Winter House. A copy of Exhibit "E" is attached to this staff report. For these reasons, Staff recommends the Winter House be identified as a "contributing structure" and the regulations governing Class 1 historic sites be applied to the exterior of this structure in its entirety, and that reinstallation of the wood shutters be required. Object 2 The McCallum era stone wall. The McCallum era stone wall may meet the definition of a Class 1 site in the following ways: That is associated with lives of persons who made meaningful contribution to national, state or local history. The stone wall may be determined to be historically significant because it is identified as having been constructed for Judge John G. McCallum, who owned this parcel as part of a much larger land holding. Judge McCallum historically significant because he is credited with being the first non-Indian settler in Palm Springs, having arrived in the 1880's and encouraged many other settlers to come to Palm Springs in an effort to develop an agricultural community. That reflects or exemplifies a particular period of the national, state or local history. The stone wall is historically significant because it reflects a built element from the earliest period of non-Indian settlement of Palm Springs. For these reasons, Staff recommends the McCallum era stone wall be identified as a "contributing structure" and the regulations governing Class 1 historic sites be applied to this wall in its entirety. Object 3 161 South Cahuilla: The Apache Lodge; The Apache Lodge is a long rectangular wood frame structure with a gable roof built as a series of hotel rooms. Along the south side is a covered porch and a rectangular Swimming pool which appears to be original to the property's development. The Apache Lodge may be deemed historically significant because it is associated with Hollywood actress Polly Bergen, Ms. Bergen purchased the Apache Lodge in the late 1950's apparently as an enterprise for her parents to operate- Although the report compiled by the applicant suggests the building is historically significant because it reflects a particular period in time and a period or type of construction, Staff does not believe the Apache Lodge stands as a notable example of either of these qualities. While it is true that the post-war era did see dozens of small resort hotels built cheaply and quickly and with modest provisions throughout Palm Springs, this building does not stand as a particularly outstanding example of such structures. Staff further questions the strength of the condition of historic significance related to persons of significance. Although Ms. Bergen may have owned the Apache Lodge, this condition alone seems weak in arguing that it should receive Class 1 designation. The significance of this property relative to the period of Ms. Bergen's life in which she achieved prominence is not known, nor is the length of time that she owned it. Staff recommends Object 3, The Apache Lodge, be identified as non-contributing. At most, Staff would recommend The Apache Lodge could be granted Class 2 status, recognizing its association with Ms. Bergen, but not giving it the higher status of Class 1. Object 4 175 South Cahuilla: Casa Cody Hotel and Apartments The Casa Cody Hotel may meet the definition of a Class 1 site in the following ways: A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The Casa Cody is an example of a modest home-turned-inn. It is designed in a Spanish Colonial ranch style building with wide covered porches, entry to the various rooms being from the covered porch, the walls are smooth stucco and the roof is two piece clay barrel tile. The building has had numerous modifications over the years which diminish its integrity including non-historic period French doors, replacement windows, and through- wall air conditioning units. Harold and Harriet Cody arrived in Palm Springs in 1916. Harold Cody was the cousin of "Buffalo Bill" Cody, a well known wild-west performer. Harriet Cody's entrepreneurial spirit made her a notable figure in the early years of Palm Springs development as a resort town. She was encouraged to enter the hotel business by close friend Nellie Coffman who owned the Desert Inn. Mrs. Cody established the Casa Cody after Harold Cody's death. Harriet Cody also owned and operated a "dude" stable in the south end of Palm Springs. Horseback riding was one of the most popular pastimes in Palm Springs during the early 1900's. She became a prominent, well known and respected person in the Palm Springs community whose business enterprises were directly associated with the early development of Palm Springs as a resort destination. Casa Cody apparently also provided accommodation to General George S. Patton's tank corps when they were conducting desert training maneuvers in the Palm Springs area and some Hollywood notables including famed cowboy Monty Montana. Staff considers these aspects to be minor in considering the historic merit of the site. That reflects or exemplifies a particular period of the national, state or local history. Casa Code may be historically significant because it exemplifies the type of residential development common in Palm Springs in its earliest years of non-Indian settlement. Staff recommends the Casa Cody be identified as a Class 1 historic object. The defining characteristics are the clay roof, the wide open porches and exposed rafters and beams and the smooth stucco walls. Object 5 The cottage relocated from the 1932 LA Olympic Village The Olympic Cottage may the definition of a historic site in the following ways: An historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect and: That is associated with events that have made a meaningful contribution to the nation, state or community. The original portion of El Rincon is best described as a simple Spanish ranch style structure and is said to have been designed by John Porter Clark. Staff does not believe this building represents a notable example of Clarks' work. The current wood shake roof is a replacement; the original roof is said to have been asphalt shingles. The El Rincon Apartments is noted as having been constructed by Francis Crocker. Crocker is noted as being a driving force behind the development of the Palm Springs Aerial Tram. Staff does not believe the El Rincon's association with Crocker is substantial enough to argue it as a defining historic characteristic. Crockers' importance as a local person of historic significance is due to his affiliation with the Tram, not necessarily with this property. Staff recommends Object 7, the El Rincon Apartment building, be identified as non- contributing- El Rincon could be given Class 2 historic status recognizing Mr. Clark's authorship of the design of the building and Mr. Crocker's ownership. Object 8 The 1940's cottage The 1940's cottage does not meet the definition of a Class 1 site for the following reason: Staff recommends that Object 8 be identified as non-contributing. Although it was constructed during the ownership of the El Rincon Apartments by Francis Crocker, who is credited as the driving force behind the creation of the Palm Springs Aerial Tramway, it lacks any significant or meaningful association with Mr- Crocker and is not part of the original construction of the El Rincon Apartments. Object 9 The Adobe House The Adobe house may meet the definition of a Class 1 site in the following ways: A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or 12 Historic Site Preservation Board Staff Repoa Page 13 of 17 case HSPB�59 Date September 11.2007 significant because of its location, design, setting, materials, workmanship or aesthetic effect. The adobe house is historically significant because it is a unique and surviving example of a vernacular adobe structure. The estimated date of construction of around 1910 or 1916 would make this one of the earliest structures built in Palm Springs that is still standing. The aesthetic effect of the adobe house has been seriously compromised over the years with the addition of a clay tile roof, (the original roof is said to have been corrugated sheet steel), steel porch columns (that replaced wood columns) and an entirely new roof structure installed to support the weight of the clay tile roof system. That is associated with lives of persons who made meaningful contribution to national, state or local history. The adobe house may be deemed historically significant because it is associated with Mr. Lawrence Tibbet, the first internationally recognized American operatic tenor. The association with Mr. Tibbet is not the strongest historic characteristic of this object. It is not known how long Mr. Tibbet owned the property, nor its relevance to Mr. Tibbets' operatic career. That reflects or exemplifies a particular period of the national, state or local history. The adobe house was constructed prior to the period when Palm Springs experienced its first boom years as a resort destination in the 1920's and 1930's. At the time of its construction, Palm Springs was still a very small desert village comprised mostly of early settlers who pursued agricultural pursuits or fledgling businesses related to the mineral springs and the provision of treatment of visitors seeking relief from illnesses such as tuberculosis. The adobe house is historically significant because it reflects or exemplifies a building type from the earliest period of Palm Springs non-Indian settlement. That embodies the distinctive characteristics of a type, period or method of construction. The adobe house embodies the distinctive characteristics of the adobe method of construction, using sun-dried clay masonry units laid up in thick walls by hand in an un- reinforced manner. Adobe construction, now rare, was a common construction method for early settlers through the southeastern United States in the late 1800's and early 1900's. Although the adobe house possesses many notable characteristics, staff believes only the walls and wood shutters meet the qualifications of Class 1 status. Object 10: Fragment of the McCallum era irrigation ditch. The McCallum era irrigation ditch fragment may meet the definition of a Class 1 historic site in the following ways: 13 Historic Site Preservation Board Sleff Report Page 14 of 17 Case HSPB-59 Date September 11 2007 That is associated with lives of persons who made meaningful contribution to national, state or local history, This section of stone lined irrigation ditch is a remnant of a large network of irrigation channels and ditches built under the direction of Palm Springs first non-Indian settler, Judge John G. McCallum. That embodies the distinctive characteristics of a type, period or method of construction. Throughout Palm Springs history, the conveyance and availability of water from either mountain streams or underground aquifers has been an important part of the development of the City. This stone-lined ditch represents the earliest example of man- made redirection of water flow from the adjacent mountains into the valley floor for irrigation of newly planted agricultural fields. Later systems of steel pipes and storage tanks would replace this early form of water conveyance. That reflects or exemplifies a particular period of the national, state or local history. The irrigation channels such as this one constructed by local labor for Judge John G. McCallum reflect the earliest efforts of non-Indian settlers to capitalize on the natural resources of the Palm Springs area for purposes of development. Judge McCallum's vision was of Palm Springs as the center of a vast agricultural center that would supply early produce to the growing population of Los Angeles. His enterprise was dependent on a reliable water source feeding the valley floor through stone lined channels and ditches such as this one. McCallum's dream was ruined by torrential rains in 1893 that washed out most of the channels and ditches followed by a ten year drought that forced most of the settlers to abandon Palm Springs. Staff recommends the fragment of the stone irrigation ditch may qualify as a Class 1 historic site. Object ill: The 1940's era east wall of the El Rincon Apartment site. The east wall of the El Rincon Apartment site does not meet the definition of a Class 1 site for the following reasons: Although the wall appears to have been constructed around the same time as the original portion of the El Rincon Apartment Building; it does not stand as an outstanding or defining characteristic of the El Rincon site. CONCLUSION 27 14 Historic Site Preservation e0ard Staff Report Page 15 of 17 Case HSP6-59 Date September 11 2007 The Casa Cody encompasses several parcels, structures, and other natural and man- made features and spaces. Of the objects identified for consideration of historic significance, Staff recommends the following be identified as "contributing" and be recommended for Class 1 status: Objects 1: The Winter House, 2: The McCallum era stone wall, 4: The Casa Cody , 9: The Adobe house, and 10: McCallum era irrigation ditch, and The following be identified as "non-contributing" but offered possible Class 2 status: Objects 3: The Apache Lodge, 5: The 1932 Olympic Village cottage, and 7: the south part of the El Rincon Apartments, and The following objects be identified as "non-contributing" and not given any historic class or status: Objects 6: the north addition to the El Rincon Apartments, 8: the 1940's era cottage, and 12: the1940's era brick wall. Staff further makes no recommendation that open space be included in the defining characteristics of any of the Casa Cody lots. Areas of open space that contribute to the condition of the setting or aesthetic effect may be considered part of the defining characteristics of a historic site as outlined in Section 8.05,020 of the Municipal Code, however Staff does not believe the open spaces on the Casa Cody sites contribute to their defining historic characteristics. RECOMMENDATION The Board has several options it may consider in making a recommendation to City Council on the Casa Cody application: 1 Determine that the Casa Cody site is not eligible for historic designation. 2 Recommend that the three lots are designated as one historic site and make determinations on which objects thereon are given historic designation. For this option, Staff would note that a condition of approval of the designation would require the three lots to be merged such that they are entirely one site associated with one assessor parcel number. 3. Recommend that the three lots are designated as three separate historic sites and make determinations on which objects on each site are given historic designation. 4. Recommend the three lots to be designated as a historic district. Determine which objects are "contributing" and "non-contributing". Identify the defining historic characteristics of each object on each site that are deemed "contributing" since they would be regulated as Class 1 historic sites under Chapter 8.05 of the Municipal Code. � o 15 Historic Site Preservation Board Staff Report Page 16 of 17 Case bISPB-59 Date September 11,2007 Staff recommends option 3 as follows: HSPB 59A: 141 South Cahuilla Road "The Winter House" Class 1 objects: The exterior only of the Winter House and the McCallum era stone wall. HSPB 596: 175 South Cahuilla Road "The Casa Cody Hotel" Class 1 objects: The entire stone wall and the exterior only of the Casa Cody Hotel. Defining Historic Characteristics: The clay tile roof, the smooth stucco exterior walls, the exposed wood timbers of the original porch structure only of the Casa Cody. Class 2 objects: The Olympic Cottage and The Apache Lodge, HSPB 59C: 300 West Arenas Road "The Adobe House" Class 1 objects: The adobe house. Defining Historic Characteristics: the original adobe walls and wood shutters only. The clay roof tiles, roof and porch structure would be excluded. Class 2 objects: The south portion of the El Rincon Hotel and Apartments. Staff initially explored the possibility of Casa Cody as a historic district but concluded it lacked some of the conditions that would typically be found in historic districts. For example the Casa Cody site lacks an overall aesthetic style or theme. Its structures are disparate and reflect many different periods of Palm Springs history. In addition, one usually gives consideration to a larger geographic area when evaluating eligibility for historic district status. As only three lots, it seems to fall short of that aspect. Thus Staff does not recommend historic district status for this application. ENVIRONMENTAL ASSESSMENT In accordance with Section 15331 (Historical Resources Restoration/Rehabilitation) of the California Environmental Quality Act (CEQA), the proposed designation is categorically exempt from environmental review as the proposed designation meets the conditions outlined for preservation of a historic resource. NOTIFICATION Pursuant to section 8.05.140 of the Municipal Code of Palm Springs, All property owners within three hundred (300) feet of the subject property have been notified. The three lots comprise approximately 1.6 acres. There are 23 hotel units presently on the three lots. The current zoning R-3, multi-family residential and hotel, and the General Plan designation H43/30 high density residential allowing a potential maximum of 68 hotel units across the three lots. Buildings in the R-3 zone may be two stories and a maximum of 24 feet. Staff has not had time to evaluate or prepare a staff report but is bringing this forward if the Board wants to take action initiate the designation proceedings. Frank Tysen, Owner, explained that he and partner, Therese Hayes, have diligently restored four adjacent historic properties over the past 20 years. The Casa Cody itself dates back to the early 1900's and is related to the family of the original Buffalo Bill Cody, cowboy performer. Acquired properties were owned by Polly Bergen, Lawrence Tibbit, Frances Crocker, and others. Additional history of the properties in this project was given (will be included in the informational packet). During the 20-year restoration, the original design and architecture were preserved to the extent possible. Without this historic Tennis Club district, Palm Springs would not be Palm Springs. PUBLIC COMMENTS Roxann Ploss pointed out that the Adobe was built in 1915, the Winter house in 1936, the El Rincon Apartment Hotel in the 1930's, the Apache Lodge was in the 1950's, one of the small cottages was an Olympic Village Cottage for the 1932 LA Olympics and moved to this site from LA - the Casa Cody compound was built over a 20-year period She urged the Board's recommendation of this designation to a Class 1 site. PUBLIC COMMENTS CLOSED. DISCUSSION: Board member Riley reminded that one of the Board's goal is to have a Historic District and this project could bring this goal to a really. This is the ideal neighborhood for Palm Spring's first Historic District. Board member Strahl agreed and asked that the next two meetings address how to set-up Historic Site Districts with this one being the first priority. Significance Continued Casa Cody B&B Country Inn reflects the context of hotel and lodging development in this area in the 1930s. The L-shaped hotel building was constructed in the mid-1930s. The Casa Cody is comprised of an eclectic group of structures built over different eras. The main residence was constructed of adobe in the 1920s by pioneer Harold Bryant Cody(cousin of famous cowboy/performer Buffalo Bill)for him and his wife, Harriet. The Cody's migrated from the east coast in search of a drier climate that would help cure Harold's tuberculosis. Cody, an architect by trade,designed several homes in Palm Springs,including an estate for socialite Louis Kellogg of the Kellogg cereal company. In the early 1930s,four cottages built for the 1932 Los Angeles Olympic village were moved to the Cady estate and,along with the original residence,formed the Casa Cody Hotel and Apartments (former name). Three of the four cottages were razed in the 1930s to make way for the L-shaped hotel addition. In 1948,an earthquake severely damaged the Codys original adobe residence and it was demolished soon afterward; a new building housing three units was constructed in its place. The fourth cottage from the Olympic Village was spared from demolition and now remains the oldest(Cody) structure in the complex. In 1989 the owners of Casa Cody bought the neighboring Apache Lodge(built in the 1950s and once owned by actress Polly Bergen)and incorporated it into Casa Cody. The most recent addition occurred in 1995 when structures from the Francis Cracker estate were purchased and added to the Casa Cody complex;the original building on the Crocker property is an adobe built in 1910 once awned by Metropolitan opera star Lawrence Tibbet who frequently entertained his friend Charlie Chaplin there- Due to these changes and additions, the hotel retains a good degree of integrity;the location, setting,design, materials,workmanship, feeling,and association appear to remain mostly unchanged since the buildings were constructed. In addition, because of the mature garden surroundings, the setting of the hotel is enhanced. The hotel at 175 South Cahuilla appears to meet the level of significance necessary for individual National Register of Historic Places or California Register of Historical Resources eligibility at the local level. This hotel is typical of the pattern of development that occurred in the City of Palm Springs. Associated with a historic pioneer family of great local import, and constructed(in part) of adobe materials associated with early Palms Springs, this hotel has an elevated level of significance. The enclosed private garden setting and spatial arrangement of bungalows and buildings contributes to the hotel's unique design, layout and significance. REPORT FROM THE CHAIR: Acting Chair Nelson reported that the Riverside County District Attorney's office will be holding training sessions for the Brown Act. The nearest location is Palm Desert on September 20 from 2 to 4 p.m. He urged members to attend. Staff Lyon advised that the City Attorney for Palm Springs will also be holding training on the Brown Act later this year and all boards, commissions, committees, and staff who work with them must attend if they have not already attended Brown Act training. Staff will advise when the date is set. Acting Chair Nelson commented that the house of Charles Eames, designer of pre-fab furniture in the 40, 50 & 60's, in Pacific Palisades in Santa Monica has just been designated a national historic landmark by the Department of Interior and Park Services. The historic Little Red School House in Cathedral City may be relocated close to the Palm Springs Air Museum — negotiations are in process for this move. 7. PUBLIC HEARINGS: RE: Casa Cody.... John Williams excused himself prior to the public hearing on this item because he had received a contribution from the owner of Casa Cody toward his city council campaign. A. Case No. HSPB a#69 — Casa Cody Inn Application for Class 1 Historic Site Designation Possible Action: Recommendation to Council for Historic Designation Staff explained the staff report and the new historic assessment report from the applicant (all provided in Board packets), and described building locations on the displayed drawings. PUBLIC COMMENTS: Frank Tysen, owner of Casa Cody and Applicant, asked the Board to approve his application for Historic Class 1 designation. He reported that several people have been interested in buying the property, but the property is not currently in escrow. Mr. Tysen wants to be sure the property can be profitably operated by a new owner which may necessitate additional units being constructed on the site. The property is currently for sale. Roxanne Ploss, Palm Springs Resident, urged the Board to approve the entire project as a Class 1 Historic Site. Discussion: Board member Grattan stated that Charlie Chaplin's staying and impromptu entertaining there with Lawrence Tibbitts, Metropolitan Opera star, should have been shown in the report so that information is not lost. Staff member Lyon read a letter from Marcia Scharfen, President of RK Miller Investment Corp and Palm Springs property owner, supporting the designation of the Casa Cody to a Class 1 Historic Site (copy attached). - 71 Historic Site Preservation Board Page 3 of 5 Minutes from the September 11, 2007 Meeting There was lengthy Board discussion and questions of Mr. Tyson, Owner and Applicant, who asked that limited additional unit density be made possible on the properties. Deed restrictions to limit future density were discussed as a possible mechanism for the owner to consider- Board member Riley moved that the Casa Cody Inn and property be designated as follows.- (1) HSPB 59A — 141 South Cahuilla Road "The Winter House" - Designate the exterior only of the Winter House and the McCallum era stone wall as Class 1 Historic Site #59A and add the defining characteristics as shown on page 16 of the Staff Report: "The entire stone wall and the exterior clay tile roof, the smooth stucco exterior walls, the exposed wood timbers of the porch structure, and the wood shutters of the Winter House." It was seconded by Board member Grattan- Discussion: Acting Chair Nelson felt Recommendation Option #2 of the Staff Report (page 15) is more appropriate for the site, and feels Option 2 provides more site protection. VOTE ON MOTION HSPB #59A ABOVE: M/S/C (Riley/Grattan) as stated in (1) above— 5 Yes, 0 No, 2 Absent, 0 Abstentions. 2 HSPB 59B — 175 South Cahuilla Road "The Casa Cody Hotel" — Designate the entire stone wall and exterior only of the Casa Cody Hotel (Inn) as Class 1 Historic Site #59B and the defining characteristics as shown on page 16 of the Staff Report: The clay tile roof, the smooth stucco exterior walls, and the exposed wood timbers of the original porch structure only of the Casa Cody. Designate the Olympic Cottage and The Apache Lodge as Class 2. Seconded by Board member Saunders. Discussion: None VOTE: M/S/C (Riley/ Saunders) as stated in HSPB #59B (2) above — 5 Yes, 0 No, 2 Absent, 0 Abstentions. 3 HSPB 59C — 300 West Arenas Road "The Adobe House' — Designate as Class 1 Historic Site #59C the Adobe House, and the defining characteristics as shown on page 16 of the Staff Report: "the original adobe walls and wood shutters only, excluding the clay roof tiles, roof, and porch structure — they are not original. Designate as Class 2 Historic the south portion of the El Ricon Hotel and Apartments." Seconded by Board member Strahl. Discussion: Acting Chair Nelson asked why the clay roof tiles and structure are excluded. Staff advised that the clay roof tiles, the wood beams that hold it up, and the porch columns are not original. The building was originally built with a corrugated steel roof and the porch columns that exist today are steel. Staff also pointed out that there is no reference to the irrigation ditch. Acting Chair Nelson amended the motion to include the McCallum era irrigation ditch. Board member Strahl seconded the amendment, and Board member Riley accepted the amendment to his motion. VOTE: M/S/C (Riley/Strahl) as stated in HSPB #59C (3) above stated and as amended— 5 Yes, 0 No, 2 Absent, 0 Abstentions. (4) Board member Grattan moved to ask the City Council to initiate a Zone Change for the Casa Cody site to lower density residential. Board member Riley seconded this motion- Frank Tysen, owner and applicant, asked if this would allow ten additional units to be built at some future time. In order to make it feasible for future owners, there needs to be flexibility to allow more units if they so chose. He stated that he would rather work through a deed restriction on the property- _ -_ ?2 Historic Site Preservation Board Page 4 of 5 Minutes from the September 11,2007 Meeting Director Ewing explained that if the current zoning and general plan land use density would allow ten more units, then this Board is asking the Council to put a lower unit maximum on the property - it appears that about 44-45 units are allowed on this site by the current zoning. The owner may wish to put their own deed restrictions on the property. The motion would actually ask the City Council to initiate the process of re-zoning the site to change the zone from R-3 to some other lower-density residential zone. If the Council takes this up, they would initiate it, it would go to the Planning Commission for public hearing, and then to City Council for public hearing before final action. Board member Grattan asked if there would be any reason for the Council to follow through if Mr. Tysen provided a deed restriction in the meantime that would satisfy this aspect? Director Ewing suggested that the Board hold this for 30 days to allow time for Mr. Tysen to bring back to HSPB whatever agreements/deed restrictions he has prepared. He recommended "Sunmor Estates" as another potential Historic District (they have expressed interest) and "Mesa". He asked for a detailed report from the Subcommittee at the next meeting. B. Subcommittee Report on Public Outreach —J. Nelson, B. Strahl, and S. Grattan Mr. Lyon handed out a draft "Public Outreach and Education Work Plan 07-08" and described the contents: Short-Term, Long-Term, and Ongoing Work Items (attached for reference). Board member Grattan moved to approve this Work Plan. Board member Saunders seconded the motion. Discussion: Some Board members felt this Plan is too aggressive Plan and were concerned about being able to accomplish all the items. THE HISTORIC SITE PRESERVATION BOARD HEREBY FINDS AS FOLLOWS: Section 1: The Winter House meets the definition of a Class 1 historic site in the following ways: (a) A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The Winter House meets this definition of a historic site because it is a fairly good example of a modest Spanish Colonial Revival style residence. The defining characteristics are its two piece clay barrel roof tiles, heavy timber roof beams and porch columns, smooth stucco exterior walls, and low gable style roof. The structure has steel hinge pins at the windows and doors on which original wood shutters were hung. (b) That reflects or exemplifies a particular period of the national, state or local history; or The Winter House is an example of the early period of resort development in Palm Springs from the 1920's through the 1940's when many affluent and notable families from the Los Angeles area and elsewhere built modest homes for weekend and vacation get-aways. (c) That embodies the distinctive characteristics of a type, period or method of construction; or The Winter House embodies the characteristics of the typical wood frame and stucco homes built during the 1920's through the 1940's using picturesque revivalist architectural styles. Section 2: The McCallum era stone wall located on the western side of 141 South Cahuilla Road meets the definition of a Classl historic site in the following ways: (a) That is associated with lives of persons who made meaningful contribution to national, state or local history- 7 The stone wall is historically significant because it is identified as having been constructed for Judge John G. McCallum, who owned this parcel as part of a much larger land holding. Judge McCallum historically significant because he is credited as being the first non-Indian settler in Palm Springs, having arrived in the 1880's and encouraged many other settlers to come to Palm Springs in an effort to develop an agricultural community. (b) That reflects or exemplifies a particular period of the national, state or local history. The stone wall is historically significant because it reflects a built element from the earliest period of non-Indian settlement of Palm Springs. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Historic Site Preservation Board recommends that the City Council designate 141 South Cahuilla Road as Class 1 Historic Site # HSPB 59A, subject to the following conditions; 1. The property owner shall permit the City to demark the sites with historic markers of the City's choosing. The historic markers shall be placed in a location visible from the public right-of-way. Harold Cody was the cousin of "Buffalo Bill" Cody, a well known wild- west performer. Harriet Cody's entrepreneurial spirit made her a notable figure in the early years of Palm Springs development as a resort town. She was encouraged to enter the hotel business by close friend Nellie Coffman who owned the Desert Inn. Mrs. Cody established the Casa Cody after Harold Cody's death. Harriet Cody also owned and operated a "dude" stable in the south end of Palm Springs. Horseback riding was one of the most popular pastimes in Palm Springs during the early 1900's. She became a prominent, well known and respected person in the Palm Springs community whose business enterprises were directly associated with the early development of Palm Springs as a resort destination. (c) That reflects or exemplifies a particular period of the national, state or local history. Casa Code is historically significant because it exemplifies the type of residential development common in Palm Springs in its earliest years of non-Indian settlement. 78 The French doors and trellis structures are not defining characteristics of this structure. Section 2: The McCallum era stone wall located on the western side of 141 South Cahuilla Road meets the definition of a Classl historic site in the following ways: (a) That is associated with lives of persons who made meaningful contribution to national, state or local history. The stone wall is historically significant because it is identified as having been constructed for Judge John G. McCallum, who owned this parcel as part of a much larger land holding. Section 3: The Apache Lodge meets the definition of a Class 2 historic site in the following ways: The Apache Lodge was owned for several years by actress Polly Bergen. Although Ms. Bergen is identified as a recognized name in the movie and film industry, her association with the Apache Lodge is limited to a short period of ownership. Ms. Bergen's career development or achievements are not directly associated with the Apache Lodge, thus its historic importance due to association with a person of significance is minimal. The Apache Lodge is typical of countless small motor lodges constructed during and after World War II. It is a simple utilitarian structure without any particular aesthetic effect. Thus, while it typifies the type of accommodation built during that period, it does not stand as a particularly notable or outstanding example of such construction. Section 4: The Olympic Cottage meets the definition of a Class 2 historic site in the following ways; The Olympic Cottage was relocated from the grounds of the 1932 Olympic Village in Los Angeles. Although significant because of its association with this 'first of its kind' Olympic Village, it has been significantly altered and deteriorated and lacks adequate historic integrity to merit higher historic classification. ? Section 5: The north addition of the El Rincon Apartments does not meet the definition of a historic site. It is defined as a "non-contributing" object on the site and no historic classification is assigned this structure. The Casa Cody Hotel is a small resort hotel comprised of several buildings of varying architectural styles and ancillary structures built over several decades on three lots in the Historic Tennis Club Neighborhood. 2. The structures on the three lots at the Casa Cody site have been identified as follows and evaluated individually against the findings of Chapter 8.05 of the City of Palm Springs Municipal Code: 3. The structures located at 300 West Arenas Road include: Object 7: The El Rincon Apartments, Object 8: The 1940's Cottage, Object 9: The Adobe House, Object 10: The McCallum era irrigation ditch, and Object 11: The 1940's east wall of the El Rincon Apartments. 4. Separate resolutions will be made for 141 South Cahuilla Road and 175 South Cahuilla Road. THE HISTORIC SITE PRESERVATION BOARD HEREBY FINDS AS FOLLOWS: Section 1: The Adobe House meets the definition of a Class 1 historic site in the following ways: (a) A historic site is any real property such as: a building; a structure, including but not limited to archways, tiled areas and similar architectural elements; an archaeological excavation or object that is unique or significant because of its location, design, setting, materials, workmanship or aesthetic effect. The adobe house is historically significant because it is a unique and surviving example of a vernacular adobe structure. The estimated date of construction of around 1910 or 1916 makes this one of the earliest structures built in Palm Springs that is still standing. (b) That reflects or exemplifies a particular period of the national, state or local history. The adobe house was constructed using local labor prior to the period when Palm Springs experienced its first boom years as a resort destination in the 1920's and 1930's. At the time of its construction, Palm Springs was still a very small desert village comprised mostly of early settlers who pursued agricultural pursuits or fledgling businesses related to the mineral springs and the provision of treatment of visitors seeking relief from illnesses such as tuberculosis. The adobe house is historically significant because it reflects or exemplifies a building type from the earliest period of Palm Springs non-Indian settlement. (c) That embodies the distinctive characteristics of a type, period or method of construction. The adobe house embodies the distinctive characteristics of the adobe method of construction, using sun-dried clay masonry units laid up in thick walls by hand in an un- reinforced manner. Adobe construction, now rare, was a common construction method for early settlers through the southeastern United States in the late 1800's and early 1900's. The defining characteristics of the Adobe House are the exterior walls and wood shutters. The clay tile roof, wood timbers and steel porch columns are not from the historic period and are not considered defining characteristics of the Adobe House. cr 2 Section 2: The McCallum era stone-lined irrigation ditch meets the definition of a Class 1 site in the following ways: (a) That is associated with lives of persons who made meaningful contribution to national, state or local history. This section of stone lined irrigation ditch is a remnant of a large network of irrigation channels and ditches built under the direction of Palm Springs first non-Indian settler, Judge John G. McCallum. (b) That embodies the distinctive characteristics of a type, period or method of construction. Throughout Palm Springs history, the conveyance and availability of water from either mountain streams or underground aquifers has been an important part of the development of the City. This stone-lined ditch represents the earliest example of man- made redirection of water flow from the adjacent mountains into the valley floor for irrigation of newly planted agricultural fields. Later systems of steel pipes and storage tanks would replace this early form of water conveyance. (c) That reflects or exemplifies a particular period of the national, state or local history. The irrigation channels such as this one constructed by local labor for Judge John G. McCallum reflect the earliest efforts of non-Indian settlers to capitalize on the natural resources of the Palm Springs area for purposes of development. Judge McCallum's vision was of Palm Springs as the center of a vast agricultural center that would supply early produce to the growing population of Los Angeles. His enterprise was dependent on a reliable water source feeding the valley floor through stone lined channels and ditches such as this one. McCallum's dream was ruined by torrential rains in 1893 that washed out most of the channels and ditches followed by a ten year drought that forced most of the settlers to abandon Palm Springs. Section 3- The El Rincon Apartments meet the definition of a Class 2 site in the following ways: The El Rincon Apartments are said to have been designed by John Porter Clark. No evidence has been provided to support this assertion. The El Rincon Apartments were built by Francis Crocker. Francis Crocker is recognized locally as one of the driving forces behind the development of the Palm Springs Tram, however the El Rincon Apartments do not have any relationship to Mr. Crocker's involvement with the Tram, thus while he was the owner of the property when it was built, this association is not sufficient to merit higher historic classification. Section 4: The 1940's cottage does not meet the definition of a historic site. It is defined as a "non-contributing" object on the site and no historic classification is assigned this structure. Section 5: The 1940's era east brick wall of the El Rincon Apartments does not meet the definition of a historic site. It is defined as a "non-contributing' object on the site and no historic classification is assigned this structure. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Historic Site Preservation Board recommends that the City Council designate 300 West Arenas Road Class 1 Historic Site # HSPB 59C subject to the following conditions; 1. The property owner shall permit the City to demark the sites with historic markers of the City's choosing. The historic markers shall be placed in a location visible from the public right-of-way. The owner shall maintain the historic markers in the location installed and pay for the replacement cost if the markers are lost, stolen, or otherwise removed from the property. 2. All future exterior modifications to the site including but not limited to building, lighting, walls, and fences shall require review and approval by the Historic Site Preservation Board pursuant Municipal Code Ordinance 8.05.180. 3. When the present owners bought Casa Cody, they incorporated the other addresses with the exception of the latter residence which was restored and added to the property only recently. History 2) That is associated with lives of persons who made meaningful contribution to national, state or local history as follows: The property is located on the acreage once owned by original settler, Judge John Guthrie McCallum. The Casa Cody was built and operated by Mrs. Harriet Cody, an early non-Indian resident of Palm Springs. She was an owner of one of the two "dude" stables and the widow of the architect, Mr. Harold William Cody, cousin of"Buffalo Bill" Cody. Harold Cody was an architect who had come to the desert, as many others had, for his health; he was one of many who worked on the designs of the Mission Inn in Riverside. The Vassar-educated Harriet Cody was the long-time friend of Mrs. Nellie N. Coffman, owner of the close-by Desert Inn, who had encouraged her entry into the hotel business after Harold's death. During World War II when Gen. George S. Patton was training his tank corps for desert maneuvers, his officers were bivouacked at the Casa Cody. Hollywood personalities often stayed there as well. Famed cowboy Monty Montana was photo- graphed doing rope tricks in the courtyard where the pool is now located. Architecture 3) That reflects or exemplifies a particular period of the national, state or local history as follows.- The Casa Cody is an eclectic mixture of buildings and architectural styles reflecting the evolution in "guest houses" and apartment hotels over the first four decades of resort development in Palm Springs. It is comprised of a series of connected units and single-unit cottages. The feel of"comfortable" rather than "luxurious surroundings were typical in this "get-away-from-it-all"town which emphasized healthy and athletic pursuits during that period. The "roughing it" holiday had yC become quite popular in the '30's at a time when Hollywood Westerns were at their peak. People of means wanted to get in touch with the real West, the desert solitude and gorgeous nights. For the "down-East-ers", it was also a way to get away from wintry weather for several months (hence, the kitchenettes in most units). 4) That embodies the distinctive characteristics of a type, period or method of construction.- The L-shaped main structure, built in 1936, is in the Spanish adobe style with cedar- shake rooftops and exposed rafters. Cottage #18 was built in 1940 in the same style. They are wood framed buildings covered with stucco. Covered walk ways are supported by simple wood columns. As referenced in Palm Springs Confidential, the Casa was designed by Myron Hunt, the architect of record for Cal Tech and the L.A. Ambassador Hotel. Cottage #17 was one of four salvaged from athlete's village at the 1932 L.A_ Olympics and was used to form the core of the "new Casa Cody" after much was lost in an earthquake. It is in a typical wood-frame bungalow style popular in the fast- growing studio areas of Los Angeles in that period. 161 South Cahuilla (originally "The Apache Lodge") History 2) That is associated with lives of persons who made meaningful contribution to national, state or local history as follows: The Apache Lodge, built in the 1940's, was purchased and managed (by her mother) by actress Polly Bergen in the late '50's when Hollywood and the fledgling Rat Pack group were discovering Palm Springs as their "secret" week-end hide-away. (The Chi- Chi Club was only a short walk away.) Architecture 3) That reflects or exemplifies a particular period of the national, state or local history: The Lodge reflects that post-war, automobile-driven economy when Americans were beginning to enjoy a burgeoning upper-middle class that included more leisure time. The focus of the small hotels built in that period was either an expansive courtyard, a tennis court or, as was true in this case, a swimming pool. This was something that was featured previously only in the more elegant, more expensive grand hotels frequented by the wealthy. After the war, there was a flurry of quick construction to provide much �a - -- CJu needed housing for returning soldiers and families. Butthe middle and the upper middle classes had a great desire to "see what we were fighting for'; motor courts and long-term vacation rentals became the rage. Palm Springs was already known for its restorative powers and as being the playground of the rich. Ranch-style apartment hotels complete with small kitchens went up quickly to accommodate this interest. Steel and glass had been in short supply during the war but wood and stucco were available. The Apache Lodge reflects all of this: use of wood and stucco, quickly built in ranch-style, built with month-long (or more) stays in mind. 4) That embodies the distinctive characteristics of a type, period of method of construction as follows: With its overhanging portal, the Lodge represents the typical Mexican ranch look popular in Southern California. This probably was one of the last such buildings since, now that steel and glass were available again, the boom in mid-century moderist architecture was beginning. All rooms at the Lodge opened onto the pool area. The style was hacienda with an open feel and covered walkways. 7) That has yielded or may be likely to yield information important to national, state or local history or pre-history as follows: See #7 as it applies to El Rincon Hotel and Apartments below. Part of the rock wall also extends across the back of The Apache Lodge_ 330 West Arenas (formerly known as El Rincon Hotel and Apartments) Architecture 3) That reflects or exemplifies a particular period of the national, state or local history as follows: El Rincon Hotel and Apartments was built in the 1930's and. Again, this exemplifies the casual atmosphere of Palm Springs in that period and, as it JUST predates the vogue of"Mid-century Modernism", relies heavily on the Mexican hacienda look then popular throughout Southern California. Haciendas typically were large squares with a protective wall and entry(ies) and contained three buildings, either connected or not, in a U-shape with all (or most) doors facing the inner courtyard. The present owners have slightly altered the look by extending the walkways and building an overhanging portal connecting the two, formerly-separate units_ 4) That embodies the distinctive characteristics of a type, period or method of construction as follows: In keeping with "hacienda-style", this L-shaped complex focused on an expansive central courtyard. It faces the pre-existing The Adobe. The south side of the courtyard is bounded by the whitewashed brick wall and arched entry gates, again true to the hacienda style. The construction is of wood frame and stucco with cedar- shake roofs. The low-slung buildings with thick walls, broad door-ways and deep-set windows responds well to the harsh desert climate by retaining heat during the winter, remaining cooler in the summer. 5) That presents the work of a master builder, designer, artist or architect whose individual genius influenced his cage or that possesses high artistic value as follows: John Porter Clark designed the original sections of the building. He was the first architect-in-residence in Palm Springs brought here by developers Culver and Sally Nichols in 1932. He is credited as the architect of such notable local buildings as the Welwood Murray Library and the part of the Palm Springs High School campus which is referred to as The Ramon Academy. The windows have not been changed in any way. Although the wooden doors were no longer salvageable, they were replaced with exact duplicates of the three-part doors and hinged in the same unique fashion. 7) That has yielded or may be likely to yield information important to national, state or local history or pre-history as follows: On what would have been the southwestern corner of this property, a remnant of the original "Tahquitz Ditch", an irrigation system built by Judge McCallum in the late 1800's has been uncovered and is now visible again. This irrigation ditch was part of a complex network of irrigation ditches built by Judge McCallum in his efforts to develop Palm Springs as a major supplier of fruits and vegetables to the growing population of Los Angeles. His efforts were lost when the reliable source of water dried up in a 10 year drought in the early 1900's. Also listed as part of the El Rincon Hotel and Apartments but was formerly a single-family residence: "The Adobe" History 2) That is associated with lives of persons who made meaningful contribution to national, state or local history as follows: The Adobe was built around 1910 as a private residence and was owned at one time by Lawrence Tibbet, the first internationally recognized American operatic tenor. He � r "wintered" in the house for several years, housing his piano in the "potato cellar"to protect it from summer heat. When Tibbet went into film, he became friends with some of the major movie stars of the period like Charlie Chaplin who often visited him here in the Desert. At a later date, the house was purchased by the Crocker family. Francis Crocker is known as the "Father of the Aerial Tramway". 3) That reflects or exemplifies a particular period of the national, state or local history as follows: The Adobe is in the vernacular style with a two-piece clay-barrel roof. Its thick, clay brick walls are original to the building as are the floor tiles, windows and wood shutters. The roof tiles are of the same style as the original. The outdoor-accessed basement, though not unusual to the time, was something of a rarity in the desert. It is one of the oldest, continuously occupied residences still existing in Palm Springs which has not been turned into a storefront, an office or a museum. 4) That embodies the distinctive characteristics of a type, period or method of construction.- Again, this is an adobe brick construction, Of interest, the house was built using the only local labor pool, the Agua Caliente Indians. 7) That has yielded or may be likely to yield information important to national, state or local history or pre-history: Among the defining historic characteristics of this site are: Along the western boundary of the property is a fairly extensive remnant of the original stone wall built by Judge John G. McCallum in the 1880's using local labor and stone. This wall also extends along the original Casa Cody as well as The Winter House. There is also a very old Palo Verde tree on this property (The Adobe) thought to be one hundred years old. The china berry trees are also planted during Judge McCallum's ownership of the property. 141 South Cahuilla (The Winter House) History 2) That is associated with lives of persons who made meaningful contribution to national, state or local history as follows: A mortgage banker from Beverly Hills bought his "winter' home in 1936. It remained in the family for seventy years until Mrs. Francis Winter sold it to the Casa Cody. Mrs. Winter was probably best known for steadfastly standing (figuratively speaking) in front of the wrecking ball when the City wanted to demolish this small-hotel area of the Historic Tennis Club District in favor of a major "urban renewal project'. Since that time, this area has become an important tourist draw. Architecture 4) That embodies the distinctive characteristics of a type, period or method of construction as follows: The Winter House is a classic example of a small, Spanish revival residence. Rooms are interconnected but each also opens onto a massive courtyard with expansive lawns and mature fruit trees. It is L-shaped with a Dutch door opening onto a small dining patio. The maid/guest quarters at the rear of the house were added during the war and reflect the lack of materials and skilled labor. The unique window hinge structures are original; a few have been exactly duplicated by a family-owned business in San Francisco for the renovations. The wooden doors are original to the house. 6) That represents a significant and distinguishable entity whose components may lack individual distinction as follows: Only the entrance to the property (now near what used to be the garage) has been changed. The area, once open to the driveway, is now walled and gated with an open-work wrought iron gate. As the Casa Cody incorporated more buildings, the encompassing wall were extended using period block. i EXHIBIT "E" CONSENT TO PROJECT Pursuant to the Settlement Agreement dated May 4, 1988, the Palm Springs Community Redevelopment Agency has a first right to acquire that certain parcel identified as the Winters Parcel, located on North Palm Canyon Drive and adjacent to the Property described in the foregoing agreement.
