October 15, 2008 UNFINISHED BUSINESS Subject: APPROVE AN AGREEMENT WITH RICH PARZINSKY POOLS, INC., FOR THE RAINMAKER FOUNTAIN REPAIRS, IN THE AMOUNT OF $63,500 From: David H. Ready, City Manager Initiated by: Parks and Recreation Department Public Works & Engineering Department Community & Economic Development Department SUMMARY The Rainmaker fountain, located in Frances Stevens Park, was commissioned through a national design competition for sculpture and completed in 2001. Since that time, the fountain has been closed for repairs on several occasions. Currently, the fountain is not operational due to a number of mechanical and electrical issues. At the City Council meeting of October 1, 2008, staff presented costs of a recent bid proposal to repair the fountain. Other alternatives were also discussed such as decommissioning the fountain and converting it to a static landmark, and demolition/removal. City Council directed staff to proceed with a contract to repair the fountain, in addition to retaining Waterline Studios as a technical consultant during the repair, and to preparation of an ongoing maintenance schedule. RECOMMENDATION: 1) Approve an agreement with Rich Parzinsky Pools, Inc., for the Rainmaker Fountain Repairs, in the amount of$63,500, CP 08-02; 2) Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING THE FISCAL YEAR 2008-09 BUDGET;" 3) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The fountain has suffered from a number of electrical, mechanical, and maintenance problems. In August 2007, the City brought in Waterline Studios, a highly-qualified firm Item No. 4 • A • City Council Staff Report October 15, 2008- Page 2 Rainmaker Fountain Repairs Award & Budget Amendment that specializes in water fountain design, to prepare a comprehensive assessment of the fountain, including the mechanics, electronics, structure, design, and function. A copy of this assessment was provided to the City Council under separate cover in November 2007. This assessment identifies a number of items that can be repaired or replaced to bring the fountain back to working order and other items that will improve the long-term viability and reduce long-term maintenance costs. On November 7, 2007, City Council reviewed this matter and directed staff to receive bids for the repair. In January 2008, the City issued formal requests for bids; however, no bids were received. Since no bids were received by the deadline and the cost of the work was under $100,000, the City's Procurement Ordinance allows staff to negotiate a price to complete the project. Staff had negotiated with one of the contractors that attended the site visit and intended to submit a bid. The estimated costs to repair the fountain were: $93,000 for construction by International Waterscapes, and $48,750 for City forces to provide new sewer line. This information was provided to City Council and they directed staff to return with additional information and a cost to retain Waterline Studios as a technical consultant during the repair work and prepare a maintenance manual for future maintenance and an estimate of yearly maintenance costs. Hence, staff revised the bid specifications to reflect Council's direction, and the project was again formally advertised for bids, which resulted in the following: 1) Rich Parzinsky Pools, Inc., Palm Springs, CA $63,500 2) G&M Construction, Palm Springs, CA $66,500 The lowest qualified bid received was from Rich Parzinsky Pools, Inc., a California Corporation with Richard Parzinsky, President and Janet Garcia, as Secretary. The engineer's estimate for this project was $95,000. On October 1, 2008, Council directed staff to proceed with the contract for repair of the Rainmaker Fountain. The project Technical Specifications require the Contractor to provide the City with daily/weekly/monthly/yearly maintenance schedules outlining all issues and recommended work intervals. This action requests authorization to enter into a contract for the required construction, technical assistance and a budget appropriation to cover these casts. FISCAL IMPACT: City Staff will perform the sewer work necessary to bring a lateral to the vicinity of the fountain's "bottom pool." This cost is estimated at $20,000 to be funded from the Sewer Fund. '9 City Council Staff Report October 15, 2008- Page 3 Rainmaker Fountain Repairs Award & Budget Amendment Other costs include: construction repair, $63,500; technical review during construction, $20,000; preparation of a maintenance schedule manual, $2,500; and an estimate of $30,000 per year for ongoing maintenance costs. Funding for this project is not budgeted. Attached is a budget Resolution appropriating funds from Public Arts Fund Balance. WHEREAS Resolution 22266 approving the budget for the fiscal year 2008-09 was adopted on June 18, 2008; and WHEREAS the City Manager has recommended, and the City Council desires to approve, certain amendments to said budget; NOW THEREFORE BE IT RESOLVED that the Director of Finance is authorized to record inter-fund cash transfers as required in accordance with this Resolution, and that Resolution 22266, adopting the budget for the 2008-09 fiscal year is hereby amended as follows: SECTION 1.
