SUMMARY
The Streets and Highways Code of the State of California requires that the City hold a
Public Hearing to discuss and review the vacation of a portion of a public service
easement. After consideration of testimony received at the Public Hearing, the City
Council can consider denial or approval of the requested public service easement
vacation. This will reduce the width of the existing easement from 10 feet to 5 feet.
RECOMMENDATION:
1) Open the public hearing and receive public testimony.
2) Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, VACATING AND ABANDONING ALL
OF ITS RIGHT, TITLE AND INTEREST IN A PORTION OF A 10 FEET WIDE
PUBLIC UTILITY EASEMENT LOCATED IN LOTS 28 THROUGH 33 OF TRACT
MAP 32233-1, RECORDED IN BOOK 381 OF MAPS, PAGES 59 THROUGH 67,
SECTION 18, TOWNSHIP 4 SOUTH, RANGE 5 EAST; FILE R 08-07."
STAFF ANALYSIS:
On March 7, 2008, staff received an application from Standard Pacific of Coachella
Valley to vacate a portion of a 10 feet wide public utility easement located in several lots
within Tract Map 32233-1. The request is being made to make use of 5 feet of the 10
feet wide public utility easement that is not being used for public utility purposes.
Although a 10 feet wide public utility easement is generally located along both sides of
the streets within a residential subdivision, normal utility infrastructure is developed
within a common joint trench located on only one side of a street. However, along both

sides of a street are Desert Water Agency water meters and other facilities extending
within 5 feet of the public utility easement. Therefore, only the excess 5 feet of the
public utility easement beyond the Desert Water Agency facilities may be vacated.
The intent of Standard Pacific's request is to enlarge the usable outdoor living space on
selected lots where vacation of a portion of the public utility easement is possible. The
City Council previously approved a similar request, and vacated 5 feet of a 10 feet wide
public utility easement within Tract Map 32233-1, on March 21, 2007, and within Tract
Map 32233-4, on December 5, 2007.
Staff forwarded the requested public service easement vacation information to the City
Clerk, and pursuant to Section 8320 of the Streets & Highways Code, the City Clerk
administratively scheduled a public hearing for November 5, 2008, to hear all persons
interested in or objecting to the public service easement vacation.
Notices of the proposed public service easement vacation have been posted within the
vacation area, published in the local newspaper, and mailed to all public utility
companies. Staff has verified that the subject portion of the public utility easements are
not necessary for use by the public utility companies, and recommends that the City
Council adopt the attached Resolution, which will vacate 5 feet of the 10 feet wide
public utility easement located in Lots 28 through 33 of Tract Map 32233-1.

ABANDONING ALL OF ITS RIGHT, TITLE AND INTEREST
IN A PORTION OF A 10 FEET WIDE PUBLIC UTILITY
EASEMENT LOCATED IN LOTS 28 THROUGH 33 OF
TRACT MAP 32233-1, RECORDED IN BOOK 381 OF
MAPS, PAGES 59 THROUGH 67, SECTION 18,
TOWNSHIP 4 SOUTH, RANGE 5 EAST; FILE R 08-07
WHEREAS, the City Council of the City of Palm Springs, California, is authorized by
Chapter 3, Part 3, Division 9 of the Streets and Highways Code of the State of California
(the "statute"), to vacate and abandon public service easements, or parts thereof, within
the limits of the City; and
WHEREAS, pursuant to Section 8320 of the statute, the City Clerk administratively set a
public hearing for November 5, 2008, for City Council consideration of vacating and
abandoning a portion of an existing 10 feet wide public utility easement located in Lots
28 through 33 of Tract Map 32233-1, recorded in Book 381 of Maps, Pages 59 through
67; and
WHEREAS, the City Clerk did cause to be published a notice of the public hearing, and
did cause to be posted notices of vacation along the line of the subject public service
easements, as required by the statute; and
WHEREAS, the City Council did hold a public hearing as required by the statute, and
has considered all evidence submitted concerning the portion of public service
easements dedicated within Lots 28 through 33 of Tract Map 32233-1, recorded in Book
381 of Maps, Pages 59 through 67, being the vacated area described in Exhibits "Al",
"A2", and "A3", and shown on Exhibits "131", "62", and "133", attached hereto and made a
part hereof, and the need therefore for present and prospective public use.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council does hereby find that a portion of a public service
easement identified as a 10 feet wide public utility easement dedicated within Lots 28
through 33 of Tract Map 32233-1, recorded in Book 381 of Maps, Pages 59 through 67,
is unnecessary for present or prospective public use.
Section 2. The City Council does hereby vacate and abandon all the City's right, title
and interest in a portion of a public service easement identified as a 10 feet wide public
utility easement dedicated within Lots 28 through 33 of Tract Map 32233-1, recorded in
Book 381 of Maps, Pages 59 through 67, being the vacated area described in Exhibits

made a part hereof.
Section 3. The City Clerk is hereby directed to cause a certified copy of this
