HomeMy WebLinkAbout1/19/2005 - STAFF REPORTS (20) DATE: January 19, 2005 TO: City Council FROM: City Clerk RESIGNATION OF JERRY GRENCE FROM THE PLANNING COMMISSION Recommendation: 1) Accept with regret the resignation of Jerry Grence from the Planning Commission; and 2) Direct the City Clerk to post a Notice of Vacancy and advertise the Vacancy on PSCTV. BACKGROUND: The City Clerk received a letter of letter of resignation from Planning Commissioner Jerry Grence on January 12, 2005. Government Code Section 54974 requires a Notice of Vacancy be posted in the office of the City Clerk and the public library with the largest service population within its jurisdiction. Appointment to the Commission shall not be made by the City Council for at least 10 working days after the posting of the notice in the City Clerk's office. Palm Springs Municipal Code Section 2.04.060 requires the Notice shall be posted in three public places at least ten days before the appointment. games Thompson David H. I have been assigned new and additional responsibilities at work, including meetings in Sacramento which conflict with Planning Commission Meetings and I do not feel that I can give the city my best service at this time. I would like to remain on the General Planning Steering Committee as an informed citizen. I have been involved with this from the start of the process, including the sub committee for the selection of the team that will do the new general plan. I am grateful for the learning experience and I am honored to have served the city. I hope I will again be afforded the time to serve on the Planning Commission in the future. The Local Appointments List shall be made available to members of the public for a reasonable fee which shall not exceed actual cost. The legislative body shall designate the public library with the largest service population within its jurisdiction to receive a copy of the list. 54974. (a) Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, the library designated pursuant to Section 54973, and in other places as directed by the legislative body, not earlier than 20 days before or not later than 20 days after the vacancy occurs. Final appointment to the board, commission, or committee shall not be made by the legislative body for at least 10 working days after the posting of the notice in the clerk's office. (b) Notwithstanding subdivision (a) , the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section. 54975. (a) The board of supervisors shall include in the Local Appointments List prepared pursuant to Section 54972 all appointments of public members and alternate public members made to the local agency formation commission pursuant to Chapter 2 (commencing with Section 56325) of Part 2 of Division 3. (b) Whenever an unscheduled vacancy occurs in a local agency formation commission, the board of supervisors shall cause a special vacancy notice to be posted as provided in Section 54974. The members of each city board or commission shall be appointed by motion of the city council, adopted by at least three affirmative votes. Nominations for appointment to a city board or commission shall be made by the mayor or any other member of the city council at a public meeting. Each member shall be an elector of the city, unless otherwise provided by ordinance. Notice of the availability of a position for appointment shall be posted in three public places at least ten days before the appointment and the city council may, by resolution, adopt additional procedures to receive and consider applicants for city boards and commissions. No member of a city board or commission shall hold any paid office or employment in the city government. They shall serve at the pleasure of the city council, and shall be subject to removal by motion of the city council, adopted by at least three affirmative votes. The members thereof shall serve for a term of three years, unless the city council by ordinance or resolution establishes a different term, and until their respective successors are appointed and qualified.
