HomeMy WebLinkAbout2/2/2005 - STAFF REPORTS (7) DATE: February 2, 2005 TO: CITY COUNCIL FROM: CHIEF OF POLICE AMENDMENT 1 TO A4932 WITH THE PALM SPRINGS UNIFIED SCHOOL DISTRICT TO PROVIDE A FULL TIME FAMILY INTERVENTION OFFICER RECOMMENDATION: It is recommended that the City Council approve Amendment 1 to A4932 with the Palm Springs Unified School District to provide a full time civilian officer, called the Family Intervention Officer (FIO), to administer the School Community Policing Partnership Grant, in an amount not to exceed $151,000 through June 30, 2006. SUMMARY: The Family Intervention Officer position was created by Council approval on September 3, 2003. On October 15, 2003, a formal agreement was authorized between the City and Palm Springs Unified School District for a police officer to administer the School Community Policing Partnership Grant. As a cost savings measure, a new agreement was made modifying the position from that of a sworn police officer to a civilian employee. This report and attached minute order will formalize that agreement. The term of this agreement will be through June 30, 2006. BACKGROUND: The Palm Springs Police Department has long held that proactive intervention programs focusing on the children and youth of our community are crucial to crime prevention. The Department's Drug Prevention and PAL programs are examples of successful attempts to offer education and alternative activities to at-risk children. The Family Intervention program was created in 2003 and completely funded for three years by a federal grant which was a result of a cooperative effort between the Palm Springs Unified School District and Police Department. The grant was through the School Community Policing Partnership designed to create positive associations between our community's youth and the Police. The program was initially staffed by a sworn uniformed police officer, but due to projected costs overruns the position will be replaced by .a civilian employee at a reduced salary and benefits. By replacing the police officer position with the civilian position, the funding will remain intact and this valuable program can continue to meet the terms of the grant. FISCAL IMPACT Pursuant to the terms of this agreement, the District shall pay to the City up to the sum of $60,000 for the annual salary and benefits of the FIO for the fiscal year 2004-05 and up to the sum of $66,000 for the annual salary and benefits of the FIO for 2005-06, with the payment to be made within 30 days upon billing by the City. The District shall pay the City for additional costs associated with this grant including, but not limited to, the cost of equipment, conference and expenses related to training incurred under the provision of the School Community Policing Partners grant, not to exceed $25,000, to be made within 30 days upon billing by the City. The total contract amount during the two year term of this agreement shall not exceed $151,000. There will be no fiscal impact to the City budget. Chief o oli ' City Manager Attachment: 1. Minute Order REVIEWED BY DEPT, OF FINANCE P AMENDED AND RESTATED PALM SPRINGS UNIFIED SCHOOL DISTRICT SCHOOL COMMUNITY POLICE PARTNERSHIP GRANT FOR THE FAMILY INTERVENTION OFFICER WHEREAS, the Palm Springs Unified School District ("District"), formed pursuant to the provisions of the California Education Code Section 12400, desires to continue to cooperate with the City of Palm Springs ("City"), and to continue its agreement with the City in order to insure the greater safety of students and to improve and strengthen law enforcement on or about the campuses of the schools of Palm Springs. WHEREAS, on October 15, 2003, the parties approved an agreement entitled "Palm Springs Unified School District School Community Police Partnership Grant Family Intervention Officer" ("Prior Agreement") to assign a full time uniformed police officer to the District during fiscal years 2003-04, 2004-05 and 2005-06. As a cost savings measure, the parties now agree to modify the Prior Agreement to modify the position from that of a sworn position to a civilian position. Accordingly, the parties now agree to rescind the Prior Agreement and to restate their agreement as set forth herein. NOW, THEREFORE, it is agreed by and between the parties as follows: 1. The City shall provide to the District during the 2004-05 and 2005-06 school years, a Police Department employee on a full-time basis with the equipment normally provided for use by the Police Department of the City for assignment to the District for the purpose of strengthening law enforcement, particularly at the schools within the city limits of Palm Springs and instilling in the young an affection, respect and understanding of the role of law enforcement in society. The title of this position shall be the Family Intervention Officer (FIO). 2. The FIO shall be a uniformed civilian officer shall work under the direction of the District's School Community Policing Partnership Operations Committee, and shall administer the partnership program entitled Project Rebound. Some assignments may require the officer to wear civilian business attire. The officer shall serve the District forty (40) hours per week. In the event the officer shall find it necessary to work overtime, advanced approval must be obtained from the police supervisor. Hours and site assignments shall be designed by joint agreement between the District and the Police Department. In instances where crimes occur, the civilian officer shall not be prohibited from taking appropriate measures to notify a sworn police officer. 3. The officer shall be expected to maintain radio contact with his or her direct supervisor at all times. In the event the officer shall find it necessary to leave the city limits of Palm Springs while on duty, the police I P 10 supervisor shall be notified, where feasible, in advance of the expected absence, and the Police Watch Commander shall be notified. 4. Pursuant to the terms of this agreement, for all of the services rendered by the FIO under this Agreement, the District shall pay to the City up to the sum of $60,000 for the annual salary and benefits of the FIO for fiscal year 2004-05, and up to the sum of $66,000 for the annual salary and benefits of the FIO for 2005-06, with payment to be made within 30 days upon quarterly billing by the City. In addition, the District shall pay the City for additional costs associated with this grant including, but not limited to, the cost of equipment, conferences and expenses related to training incurred under the provisions of the School Community Policing Partnership grant, not to exceed to $25,000, to be made within 30 days upon billing by the City. The total not to exceed contract amount during the two-year term of this agreement shall be $151,000. 5. Pursuant to Government Code § 895.4, each party hereby assumes the liability imposed on it, its officers and employees for injury caused by a negligent or wrongful act or omission occurring in the performance of that party's obligations under this agreement to the same extent that such liability would be imposed in the absence of Government Code § 895.2. Accordingly, each party shall defend, indemnify and hold harmless the other party for any claim, demand, cause of action, loss, liability, damage, cost or expense that may be imposed on such party solely by virtue of said Section 895.2. The term of this agreement will be from November 10, 2004 to June 30, 2006; however the agreement may be amended at any time by the mutual consent of the parties hereto, as memorialized in writing, and may be terminated by either party upon 30 days written notice to the other of its intention to do so. In the event this agreement is terminated, the District shall remain liable to the City for the actual costs incurred by the City in connection with this agreement prior to expiration of the agreement.
