LOCATED AT 1020 EAST RAMON ROAD, ZONE R-2, SECTION 14. RECOMMENDATION: Uphold, overturn or modify the Planning Commission decision on January 12, 2005 to deny Case 5.0080-C. SUMMARY: The Planning Commission met on January 12, 2005 and voted 6-0 to deny Case 5.0080- C to allow the temporary parking of recreational vehicles in the existing parking area for a maximum of nine vehicles and for a maximum of nine months. Located at 1020 East Ramon Road, Zone R-2, Section 14. The applicant filed an appeal of the Planning Commissions decision on January 20, 2005. BACKGROUND: The subject property is known as the Our Savior's Community Church and is located at 1020 East Ramon Road. The proposal is to allow up to nine recreational vehicles for up to nine months use the existing parking area as a temporary RV park. The subject property would be required to provide water, sewer, and power for the recreational vehicles. A well known volunteer group of retired people, who travel the country in their RV units, are offering their services for construction for minimum wage to the church. By allowing the RV units to park on the church property will save the church approximately$35,000. The Planning Commission based their decision on the potential negative precedent an approval would set and that this is a policy matter that would be appropriate for City Council to consider and take an action on. Should the City Council decide to overturn the Planning Commissions decision, the City Council should be aware of Section 11.96.030 of the Municipal Code that it shall be unlawful to use any vehicle or boat for living, sleeping or housekeeping purposes in the City, unless such vehicle or boat is parked or stored in a space intended for such use in a mobile home park or recreational vehicle park. This ensures that such living arrangements will not occur without the benefit of public involvement and a public hearing. The Conditional Use Permit Amendment is the appropriate type of permit before the City Council. This type of permit allows uses that are not permitted by right of the underlying Zone designation. The CUP Amendment allows the City to set Conditions of Approval that will ensure compatibility with permitted uses in that Zone. The CUP Amendment is to allow the church to use its parking area for temporary RV Park; for a maximum of nine RV units for a maximum of nine months. The church will provide temporary water, sewer and utility connections for the RV units for the duration of their stay. Staff has included a Condition of Approval that require the church to provide a security deposit to the Building Official to ensure site clean up and the removal of temporary utilities, water and sewer connections. ENVIRONMENTAL ANALYSIS: This Amendment to the existing Conditional Use Permit is categorically exempt from environmental assessment pursuant to Section 15304 (Minor Land alterations) of the California Environmental Quality Act (CEQA). NOTIFICATION: A Public Hearing Notice was published in the Desert Sun newspaper. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: The City Council finds that this Conditional Use Permit is categorically exempt from environmental assessment per Section 15304 of the California Environmental Quality Act (CEQA). Section 15304 states that minor temporary use of land having negligible or no permanent effects on the environment, including carnivals, sales of Christmas trees, etc. Section 2: Pursuant to Section 93.02.00 of the Zoning Ordinance: The commission shall not approve or recommend approval of a conditional use permit unless it finds as follows: a. That the use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by this Zoning Code; The R-2 Zone designation does not permit or prohibit RV parks. b. That the use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the general plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located; The temporary RV Park for nine RV units for a maximum of nine months is not is not desirable development. RV parks, under a Land Use Permit, are allowed for a maximum of three days and re related to events such as RV sales. RV Parks have been determined by the Zoning Ordinance to be appropriate in other Zone designations. c. That the site for the intended use is adequate in size and shape to accommodate such use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust such use to those existing or permitted future uses of land in the neighborhood; The existing parking area is already improved, but temporary utilities would have to be installed and removed when finished. A six foot wall exists along the east property line and a temporary construction fence is along the west side of the parking area. These walls and fences are at six feet in height, but the typical RV unit is approximately nine feet in height. The neighboring properties would be able to see the RV units. d. That the site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use; The existing access will be used. No street improvements are required to accommodate the temporary RV units. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 1a. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.0080 - CUP. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate-fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive further indemnification hereunder, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. 2. Non-compliance with any of the conditions of this approval, or with City codes and ordinances, State laws; any valid citizen complaints or policing and safety problems (not limited to excessive alcohol consumption, noise, disturbances, signs, etc) regarding the operation of the establishment; as determined by the Chief of Police or the Director of Planning Services, may result in commencement of proceedings to It revoke the Conditional Use Permit pursuant to Section 94.02.00.1 of the Zoning Ordinance.
