HomeMy WebLinkAbout2/16/2005 - STAFF REPORTS (14) DATE: February 16, 2005 TO: City Council FROM: Director of Public Works/City Engineer GENE AUTRY TRAIL WIDENING RECOMMENDATION: It is recommended that the City Council approve amendments to contract services agreements with HDR Engineering, Inc., for the following two projects: 1) Amendment No. 1 to Contract Services Agreement No. 4665 for additional professional engineering design services in the amount of $107,572.00 for the Gene Autry Trail Railroad Bridge Widening, City Project 01-04, for a total contract amount of$588,572.00; and 2) Amendment No. 1 to Contract Services Agreement No. 4666 for additional professional environmental and engineering design services in the amount of $70,859.00 for the Gene Autry Trail Widening, City Project 02-03, for a total contract amount of$485,859.00. SUMMARY: These agreements provide the City with environmental and engineering design services for two Gene Autry Trail widening projects which are currently underway. The City of Palm Springs is the recipient of a federal grant related to the widening of Gene Autry Trail from the Union Pacific Railroad bridge to Salvia Road/Micro Place. Additionally, the City entered into an agreement with the Coachella Valley Association of Governments (CVAG) for funding to widen Gene Autry Trail from Vista Chino to the Union Pacific Railroad bridge. The grant and agreement with CVAG will provide for the widening of Gene Autry Trail to 4 lanes through the Whitewater River, and to 6 lanes across the railroad bridge and between Vista Chino and Via Escuela, to coincide with the Gene Autry Trail / Interstate 10 interchange improvements currently proceeding through the environmental and design stages. Additional work has been identified for these projects, now that the City and its consultant have proceeded through the environmental and preliminary engineering phases. Staff has coordinated with HDR Engineering, Inc., to obtain a competitive cost for the additional scopes of work identified in the contract amendments, and after numerous meetings and a review of comparable costs of similar scopes of work, recommends approval of the contract amendments. BACKGROUND: On March 3, 2003, City Council awarded two contract services agreements to HDR Engineering, Inc., for two separate projects along the Gene Autry Trail corridor. One project, City Project 01-04, is a federally funded project to widen the existing Union Pacific Railroad (UPRR) bridge from two to six lanes, extending north to Salvia Road/Micro Place intersection. This project will allow the six lane corridor to extend from the planned expansion of the Gene Autry Trail / 1-10 interchange across the UPRR bridge with a transition to four lanes south of the UPRR bridge approach (in the Whitewater River). The companion project is a locally funded project, through Regional Measure A funds, to widen the existing roadway from two to four lanes through the Whitewater River, and widen to six lanes with a divided median between Vista Chino Gene Autry Trail Widening February 16, 2005 Page 2 and Via Escuela, and a new traffic signal at Gene Autry Trail and Via Escuela. These two projects in combination with the planned interchange expansion will greatly improve access into and out of Palm Springs via Gene Autry Trail. The original scope of work submitted by HDR Engineering, Inc., for contract services agreement for City Project 01-04, assumed that the existing UPRR bridge would remain in place as is, with a separate new bridge structure to be constructed immediately adjacent to it. This assumption was made to avoid impacting the existing bridge structure which would then require that the existing bridge structure be analyzed for any required seismic retrofit improvements. However, in proceeding through the preliminary engineering for this project, it was determined that the best course of action was to widen the existing bridge and have one complete structure, given the horizontal and vertical alignments of the existing bridge and Gene Autry Trail over the UPRR tracks. The proposed contract amendment reflects the additional scopes of work necessary to analyze the existing bridge structure for seismic deficiencies, and necessary to prepare the corresponding seismic retrofit plans, specifications and estimate (PS&E). Given the proposed fee of $107,572 for this additional scope of work, staff consulted with HDR Engineering, Inc., to determine if the suggested fee was appropriate. HDR provided copies of other contract service agreements for seismic retrofit, showing that the additional scope of work and the suggested fee was comparable to other seismic retrofit projects for which HDR is currently under contract. The original scope of work submitted by HDR Engineering, Inc., for contract services agreement for City Project 02-03, assumed that upon construction of the roadway widening through the Whitewater River, a Nationwide 404 Permit through the Army Corps of Engineers (ACOE) would be required. As the Whitewater River is a delineated water course and, therefore, considered "waters of the United States", the City is required to obtain necessary permits from the ACOE for construction within the Whitewater River. A Nationwide 404 Permit is a more streamlined process for construction within the ACOE's jurisdiction, and is allowed for construction that impacts less than 0.50 acres of waters of the United States. As a result of proceeding through the environmental and preliminary engineering process for this project, an actual delineation of the estimated limits of the ordinary high water mark through the Whitewater River was established by the City's consultant, and it was determined that the actual impact area caused by the roadway widening will be 3.53 acres. As such, an Individual 404 Permit through the ACOE will be required, which involves a substantial amount of work, including coordination and permits with other resource agencies (California Regional Water Quality Control Board and California Department of Fish and Game), preparation of a Biological Assessment for review and approval by the United State Fish and Wildlife Service, and preparation of an alternatives analysis which required public review and comment. HDR Engineering, Inc., through their environmental sub-consultant LSA Associates, Inc., carefully outlined the additional scope of work required for an Individual 404 Permit, and identified suggested fees for the work. The original contract included a fee of$9,000 for preparation of the Nationwide 404 Permit; the suggested increase of $60,859 to a new fee of $69,859 includes fees necessary to provide all of the additional environmental work to obtain an Individual 404 Permit, including $13,859 of the fee which is for payment of the regulatory permits from the associated resource agencies. Additionally, staff proposed that HDR Engineering, Inc., include preparation of PS&E for a new traffic signal at Gene Autry Trail and Via Escuela. This intersection has met warrants for a �✓ Gene Autry Trail Widening February 16,2005 Page 3 traffic signal for several years, and with widening of Gene Autry Trail by this project, the need for a traffic signal will be increased. The proposed fee for this work is $10,000. All costs associated with both contracts are covered by a federal grant or CVAG Regional Measure A funding. No local funds are required. CVAG has agreed to the increased contract amounts. Sufficient funding is available for City Project 01-04 in Caltrans federal reimbursable account 261-4491-50214 (Gene Autry RR Bridge) and CVAG Measure A reimbursable account 134-4497-50214 (Gene Autry RR Bridge); and for City Project 02-03 in Measure A reimbursable account 134-4497-50217 (Gene Autry Widen @ WW Wash). Contractor shall furnish the Union Pacific Railroad (UPRR) with It memorandum providing the estimated gap and clearance information between the UPRR crash wall and the existing bridge column, and between the UPRR crash wall pile foundation and existing column footing, as necessary for UPRR to redesign the UPRR crash wall to allow for implementation of future column and footing retrofit. Contractor shall provide sketches along with the memorandum showing estimated required clearance between the existing bridge column/footing and the proposed location of the UPRR crash wall. The proposed location of the UPRR crash wall will meet UPRR clearance requirements. No engineering calculation/seismic analysis shall be performed as part of this task item of work. Redesign of the UPRR crash wall shall be performed by a different contractor and is not part of this contract. Task 6.I(a) Existing Bridge Seismic Retrofit Structural Design and Calculations. Contractor shall design necessary seismic retrofit measures and associated details for the existing bridge of the proposed widened structure and perform a final seismic analysis with the retrofit measures included in the model. The column deflections of the final widened and retrofitted bridge shall be tabulated and the gap and clearance required shall be checked against those provided in the memorandum to UPRR as defined in Task 3.6(a). Seismic retrofit structural design and calculations shall be performed in compliance with the latest Caltrans' seismic design requirements and shall include the following elements: Combined Seismic Models - the combined seismic model shall be set up using a three dimensional general structure program (STADD) and shall have the widening portion included in with the as-built seismic model, this model shall include all of the retrofitted measures and a final modal analysis shall be performed to validate the sufficiency of the retrofit design;Bent Push-Over Analysis-a plastic bent push-over analysis shall be performed on each bent to attain the displacement capacities on each bent for both existing and retrofit conditions, moment-curvature analyses for the existing columns for both existing and retrofit conditions shall be performed conforming to Caltrans seismic design criteria; Bent Cap Retrofit Design - calculations and details for bent cap retrofit shall be prepared; Column Retrofit Design - calculations and details for column retrofit design shall be prepared; Footing Retrofit Design - calculations and details for footing retrofit design shall be prepared; and Abutment Retrofit Design - calculations and details for abutment retrofit design shall be prepared. The seismic retrofit design and final seismic modal analysis shall be based on the retrofit strategies stipulated in the Bridge Retrofit Report. Task 6.2(a) Draft PS&E(Seismic Retrofit). Contractor shall prepare structural plans containing all seismic retrofit measures, as determined from the seismic retrofit design analyses as performed in Task 6.1(a), such that the existing structure meets the seismic design requirements. The seismic structure plans shall be included with the structure plans set for the widening project. Contractor shall prepare Special Provisions for items pertinent to the seismic retrofit design and not covered by the Caltrans Standard Specifications or Standard Special Provisions (SSP's). The SSP's shall be edited and Seismic Retrofit Special Provisions specific to this project produced and incorporated into the Final PS&E. The Seismic Retrofit Special Provisions shall be prepared, signed and stamped by a California registered Professional Engineer. Contractor shall prepare Seismic Retrofit Specifications conforming to Caltrans requirements. Contractor shall prepare quantity calculations for items applicable to the seismic retrofit design, and prepare the corresponding seismic retrofit cost estimate. Contract items shall be supported by quantity calculations prepared in a neat and orderly fashion and show all sketches, diagrams and dimensions necessary to allow them to be independently used by field inspectors. All quantity calculations shall be independently checked. Contractor shall prepare a Construction Cost Estimate using the latest available Caltrans cost data, City's cost data and actual recent construction costs in the Project area. <✓ Agreement No.4665 Amendment 1 Page 4 Task 6.3(a) Independent Check Revien, and Quality Control (Seismic Retrofit). Contractor shall conduct an Independent Check review upon the completion of the initial seismic retrofit design. The Independent Check Review shall consist of preparation of an independent set of seismic retrofit design check calculations and review of the PS&E, which shall be performed by senior Structural Engineers who are not part of the design team. Any difference in findings from the seismic retrofit design and the independent check shall be identified and reconciled before the final submittal. Task 6.4(a) Final PS&E (Seismic Retrofit). Contractor shall prepare a final "bid-ready" PS&E for the bridge seismic retrofit design,to be part of structure plans for the bridge widening. Contractor shall prepare complete traffic signal plans, meeting City standards and requirements, for a new traffic signal at Gene Autry Trail and Via Escuela. Contractor shall coordinate with all appropriate utility companies for verification of utility locations. Contractor shall coordinate with Southern California Edison (SCE) as necessary to obtain electrical service connection points and service for the new traffic signal. The traffic signal plan shall be incorporated into the final PS&E for the project. Traffic signal timing to be provided by the City." Delete Task 6.6 and replace with the following: "Task 6.6Individual 404 Peanut. Contractor shall coordinate with members of the project team to discuss the results of the jurisdictional delineation to be conducted as part of the Project Report phase (Task 3), and review the anticipated permitting approach, discuss and identify any additional information needs, and review the projected permitting schedules. Objectives of the coordination shall include scoping the alternatives analysis, identifying feasible mitigation options, and preparing for initial permitting coordination with regulatory agencies. Contractor will be responsible for arranging any meetings, preparing agendas, and distributing minutes and other relevant materials. Contractor shall schedule, arrange, and prepare any necessary materials for a "pre-application consultation" with the Army Corps of Engineers and other involved agencies. Objectives of the meeting will be to describe the proposed project, discuss permitting approach, and identify potential mitigation options. Contractor shall also arrange a meeting with representatives of the California Department of Fish and Game and the Regional Board (Colorado River Basin Region). The meeting shall be in conjunction with the Corps meeting if schedules allow; otherwise a separate meeting time will be set. A meeting with the Corps and USFWS shall be arranged to discuss the Section 7 Consultation process. Contractor shall summarize and document the results of agency coordination in a letter format. The letters shall be submitted to the respective agencies with copies to project team members. Based on the outcome of the initial coordination with the involved agencies, Contractor shall prepare and submit the necessary permit application materials. This scope of work assumes that the Army Corps of Engineers will provide Section 404 authorization for this project under an Individual Permit; that a Section 401 water quality certification (or waiver) will be issued by the Regional Board; that the California Department of Fish and Game will provide a Streambed Alteration Agreement under Section 1602 of the Fish and Game Code; and that the USFWS will issue a letter concluding that the project is not likely to adversely affect threatened or endangered species. Contractor shall prepare permit applications accordingly. Each application packet will be reviewed with the project team and any required changes will be made prior to submittal to the respective agencies. It is anticipated that the permit application materials will include the following materials: delineation of jurisdictional waters for the project; biological resources report; an alternatives analysis to determine if the proposed project is the least environmentally damaging practicable alternative (typically involving two off-site and four to six on-site alternatives, evaluated according to site-specific factors - impacts to waters of the U.S., practicability factors such as economic, technical, and logistical feasibility, and general environmental effects such as water quality issues, endangered species, and archaeological resources), Contractor shall coordinate preparation of responses to public comments; standard Corps application forms shall be completed by Contractor and submitted to the City for signature as applicant; a preliminary mitigation and monitoring plan based on Corps guidelines, which shall include information on how on-site impacts will be mitigated to replace jurisdictional areas that will be lost; a final mitigation plan shall be prepared and submitted following Corps review of the application packet, which shall incorporate appropriate conditions based on the Federal and State agency review and comment; Contractor shall prepare all necessary graphics and other supporting materials; a complete copy of the Section 401 Water Quality application and the 1602 Notification of Streambed Alteration. Contractor shall expedite the Corps' permit review process by preparing the Public Notice and Environmental Assessment for the project. Many of the same materials used for the 404 application can be submitted as part of the application materials for the 401 Certification and 1602 Agreement. Contractor shall prepare written correspondence requesting Section 401 water quality certification or waiver and include the following application materials: information prepared for the 404 application to provide a complete project description, including the purpose, location, total site acreage, types of water bodies within the site, total Agreement No. 4666 Amendment No. 1 Page 4 acres of waters of the U.S., wetland acres, and types of riparian habitats, if present; a copy of the report on the delineation of wetlands and jurisdictional waters prepared for the 404 application; an assessment of water quality impacts addressing types of fill material to be discharged, impacts to beneficial uses of the water body, and any expected water diversions; a complete copy of the Section 404 Permit application and the 1602 Notification of Streambed Alteration will be included; completed Standard Regional Board application form; a copy of the final environmental (CEQA) document for the project including any certifications associated with the document; other appropriate material as may be required by the Regional Board; a summary plan describing Best Management Practices (BMP's) to treat road surface runoff for water quality proposes; and a filing fee based on acreage of fill material to be deposited in jurisdictional waters or linear feet of fill, whichever is greater, estimated at$12,500. Contractor shall prepare written correspondence requesting a Section 1602 Streambed Alteration Agreement through the California Department of Fish and Game (CDFG), and include the following application materials: a standard CDFG Notification of Lake or Streambed Alteration form; Lake and Streambed Alteration Program - Project Questionnaire; Wild and Scenic Rivers Evaluation Form; a copy of the report on the delineation of wetlands and jurisdictional waters prepared for the Section 404 application; a copy of the preliminary mitigation and monitoring plan prepared for the Section 404 application with a provision to submit the final plan upon its completion; a copy of the final environmental (CEQA) document including any certifications associated with the document; appropriate plans, exhibits, and maps; a complete copy of the Section 404 Permit application and the Section 401 Water Quality application; and a filing fee of$5,000, Contractor shall prepare a biological assessment (BA) report which summarizes habitat suitability assessment and the sensitive species focused survey results of previous surveys. A description of listed species (i.e. Coachella Valley milkvetch) that may be affected by the action will be included. The report will also include a description of the action being considered and a description of the specific area that may be affected by the action and an evaluation of project impacts and description of proposed mitigation measures. A draft version of the report shall be submitted to the City for review and comments; and Contractor shall revise the draft report and submit a final report to the Federal agencies. Following the review of the biological assessment by the Corps, another informal effort may be appropriate to eliminate any residual adverse effects. If that effort results in elimination of potential impacts, the USFWS will concur in writing that the action, as revised with clearly stated agreed upon modifications, is not likely to adversely affect listed species or designated critical habitat. The USFWS may respond within 30 days to the Corps Biological Assessment finding. No formal consultation is required if the action "may affect, but is not likely to adversely affect" listed species or critical habitat. Contractor shall provide follow-up coordination. Following submittal of the various applications, Contractor shall coordinate with the involved regulatory agencies to respond to agency questions and submit any additional information that may be requested. Follow-up coordination will include responding to comments that may be submitted during the Section 404 public review process. During this process, Contractor shall coordinate closely with members of the project team to discuss any agency concerns, questions, or requests for additional materials that may arise. Payments to Contractor shall be made no more frequently than monthly, and shall be based on costs per unit of work as indicated herein.
