HomeMy WebLinkAbout1755 - ORDINANCES - 2/18/2009 ORDINANCE NO. 1755 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING CHAPTER 2.28 OF THE PALM SPRINGS MUNICIPAL CODE RELATING TO THE SUSTAINABILITY COMMISSION. City Attorney Summary This Ordinance changes the name of the Resource Conservation Commission to the Sustainability Commission to reflect the City's overall commitment to sustainability, and further establishes revised duties of the Sustainability Commission. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS: SECTION 1. The name of the Resource Conservation Commission as established pursuantto Chapter2.28 of the Palm Springs Municipal Code is amended and changed to "Sustainability Commission"and the City Clerk is authorized to make appropriate revisions to the Code in furtherance of this amendment. SECTION 2. Section 2.28.050 of the Palm Springs Municipal Code is amended to read: 2.28.050 Powers and Duties of the Commission. Within the limitations provided by law, the Sustainability Commission shall have the following powers and duties: (1) Establish a schedule of regular meeting times; (2) Advise, assist, and make recommendations to the City Council regarding: (a) Efforts to make City operations more sustainable; (b) Efforts to educate and inform the citizenry of the efforts to make the City more sustainable, (c) Progress of the creation, maintenance, and promotion of regular sustainability indicators, and a monitoring and reporting program; (d) City policies and plans to enhance the sustainability of the City as a whole including, but not limited to, water and energy efficiency, renewable sources, climate change strategies, air quality, waste management and recycling, water resources, building and infrastructure, transportation, and natural resource conservation; (e) Sustainability project finance options. Ordinance No- 1755 Page 2 (3) Perform such other duties as the City Council may assign or designate- SECTION 4. If any section or provision of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, or contravened by reason of any preemptive legislation, the remaining sections and/or provisions of this ordinance shall remain valid. The City Council hereby declares that it would have adopted this Ordinance, and each section or provision thereof, regardless of the fact that any one or more section(s)or provision(s) may be declared invalid or unconstitutional or contravened via legislation. SECTION 5. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
