SUBJECT: DISCUSSION ON THE RECRUITMENT AND APPOINTMENT OF CITY
BOARDS AND COMMISSIONS

SUMMARY
The City Council will discuss the process, qualifications and other rules and guidelines
for the recruitment and appointment of City Boards and Commissions, and direct staff to
prepare modifications as requested.
RECOMMENDATION:
Direct staff as appropriate.
BACKGROUND:
At a previous meeting the City Council requested staff schedule a City Council
discussion on the recruitment and the appointment process of the City's Boards and
Commissions.
On November 5, 2002, the voters approved an amendment to City Charter Section 602,
that requires Commission and Board Members be appointment by at least three
affirmative votes of the City Council.
Commission and Board regulations are codified by several different means, including
the Charter, Municipal Code and Resolution. None of these regulations or guidelines
have been reviewed and/or updated since the modifications to the City Charter by the
voters.
Staff recommends the City Council discuss the requisites and process to appointment
Commission and Board members, along with reviewing the number of

Commission and Board Appointments
Commissions/Board and their duties, term limits, expiration dates and all other aspects
of the City's Commission and Board program, and direct staff as appropriate. Below are
some general areas to Facilitate discussion:
Currently the City has 13 Commissions/Boards and 103 appointees. Should the City
consider consolidation, elimination or a reduction in members. Note that the Planning
Commission, Library Board and Rent Review Commission are established in the City
Charter and may have voter implications, and the Personnel Board is established in the
Personnel Ordinance and any changes may have labor negotiation requirements.

CHARTER OF THE CITY OF PALM SPRINGS
ARTICLE VI. APPOINTIVE BOARDS AND COMMISSIONS
SECTION 600, In General.
There shall be the following enumerated boards and commissions which shall have the powers and duties
herein stated. In addition,the City Council may create by ordinance or resolution such additional advisory boards
or commissions as in its judgment are required, and may grant to them such powers and duties as are consistent
with the provisions of this Charter.
SECTION 601. Appropriations.
The city council shall include in its annual budget such appropriations of funds as in its opinion shall be
sufficient for the efficient and proper functioning of such boards and commissions. City council may,by
ordinance or resolution, set reasonable fees and charges for defraying the costs of hearings or other
administrative proceedings of the City's appointive boards and commissions.
SECTION 602. Appointments; Terms.
The members of each City board or commission shall be appointed by motion of the city council, adopted
by at least three(3) affirmative votes. Nominations for appointment to a City board or commission shall be
made by the mayor or any other member of the city council at a public meeting. Each member shall be an
elector of the City, unless otherwise provided by Ordinance. Notice of the availability of a position for
appointment shall be posted in three (3)public places at least ten (10)days before the appointment and the city
council may,by resolution, adopt additional procedures to receive and consider applicants for City boards and
commissions. No member of a City board or commission shall hold any paid office or employment in the City
government. They shall serve at the pleasure of the city council, and shall be subject to removal by motion of the
city council, adopted by at least three (3) affirmative votes. The members thereof shall serve for a tern of four
(4)years, unless the city council by ordinance or resolution establishes a different term, and until their respective
successors are appointed and qualified. (Approved by voters 11-5-02)
SECTION 603. Meetings; Chairmen.
As soon as practicable, following the first day of every fiscal year, each of such boards and commissions
shall Organize by electing one of its members to serve as chairman and by electing one of its members to serve as
co-chairman at the pleasure of such board or commission. Unless otherwise provided by ordinance or in the
rules of proceeding promulgated by the applicable board or commission, each board or commission shall hold
regular meetings at least once each month, and may hold special meetings as such board or commission may
require. All proceedings shall be open to the public, except for such closed sessions as may be authorized by
law, and shall be conducted in accordance with open meeting laws of the State of California.
Except as may be otherwise provided in this Charter,the city manager shall designate a secretary for the
recording of minutes for each of such boards and commissions, who shall keep a record of its proceedings and
transactions and shall provide staff support for such board or commission. Each board or commission shall be
governed by Roberts Rules of Order except that each board or commission may by resolution adopt such other
rules and regulations which shall be consistent with this Charter, as each may deem appropriate. Copies of all
such resolutions shall be kept on file in the office of the city clerk,where they shall be available for public
inspection. The city council may by ordinance or resolution grant to board or commission the same power as the
city council to compel the attendance of witnesses,to examine them under oath,to compel the production of
evidence before it and to administer oaths and affirmations.
SECTION 604. Compensation.
Unless otherwise provided by ordinance,the members of boards and commissions shall serve without
compensation for their services as such,but may receive reimbursement for necessary traveling and other
expenses incurred on official duty when such expenditures have received authorization by the city council.
SECTION 605. Removal; Vacancies.
Any member of a board or commission may be removed at any time by a vote of a majority of the
membership of the city council and,notwithstanding any other provision of this section mandating city council
consideration of removal of a board or commission member,removal may be with or without cause. The issue
of whether to declare the office of a board or commission member vacant shall be brought before the city council
as follows:
(a) Upon the resignation of the board or coimnission member;
(b) Upon the request of any member of the city council;
(c) Upon excessive absenteeism,to be defined as absence from three consecutive meetings of such
board or commission or for twenty five percent(25%) of the duly scheduled meetings of the board or
commission within any fiscal year, unless by permission of such board or commission expressed in its
official minutes;
(d) Upon conviction of any felony or crime of moral turpitude;
(e) If the member of the board or commission ceases to be a qualified elector of the City;
(f) Failure of the board or comnussion member to file a financial disclosure statement as may be
required by State law or city ordinance; or
(g) Such other cause as city council may provide by ordinance.
The city council may declare the office of any board or commission member vacant, and the vacancy shall
be effective from the date of the declarant unless otherwise specified in the declaration.
Any vacancies in any board or conunission shall be filled by appointment by the mayor, with the approval
of the city council. Upon a vacancy occurring leaving an unexpired portion of a term, any appointment to fill
such vacancy shall be for the unexpired portion of such term.
SECTION 606. Indemnification of Members of Boards and Commissions.
Upon request by any member or former member of any appointed board or coimnission established in this
article,named in any claim or action against him or her for an injury arising out of an act or omission occurring
within the scope of his or her duties as a member of such board or commnission of the City,made in writing not
less than ten(10) days before the trial of the action, and so long as the member cooperates reasonably and in
good faith in the defense of the claim or action, the City shall pay any judgment based thereon or any
compromise or settlement of the claim or action to which the City has agreed. Where the City conducts the
defense of the claim or action pursuant to an agreement with the member or former member of such board or
commission,reserving the City's rights not to pay the judgment, compromise, or settlement until it is established
the injury arose out of act or omission occurring within the scope of his or her duties as a member of such board
or commission,the City shall be required to pay the judgment, compromise, or settlement only if it is established
the injury arose out of an act or omission occurring within the scope of his or her duties as a member of such
board or commission. The City may indemnify any member or former member of such board or commission for
any part of a claim or judgment that is for punitive or exemplary damages only upon a vote to do so by a
majority of the membership of the city council.
SECTION 607. Planning Commission.
There shall be a planning commission consisting of seven members. There shall be a director of plaiming
and zoning whose duties shall be established by ordinance,resolution, or regulation, and who shall be the
recording secretary for the planning commission. The director of planning and zoning, or his or her designated
representative shall attend all planning commission meetings. The planning commission may meet with and
receive advice from the city attorney as it or the city attorney may deem necessary. The planning commission
shall have all of the following powers and duties, which powers and duties may be modified by ordinance of the
city council-
(a) All duties set out in the California Planning and Zoning Law for a planning agency-
(b) After public hearing,recommend to the city council any amendment to the general plan or any part
thereof, or any zoning ordinance amendments-
(c) ,Exercise authority granted to it by ordinance over subdivisions, use permits, or other matters not
inconsistent with this Charter.
(d) Make recommendations to the city council concerning public works.
(e) Perform other duties specified by the city council not inconsistent with this Charter.
SECTION 603. Rent Review Commission.
There shall be a rent review commission consisting of five members. The rent review coimmission may
meet with and receive advice from the city attorney as it or the city attorney may deem necessary. The rent
review commission shall have the following powers and duties:
(a) Receive,hear, and determine petitions from tenants, landlords, or other interested parties regarding
the application and interpretation of the City's rent control ordinances and regulations;
(b) Make or conduct such independent hearings or investigations as may be appropriate to obtain such
information as is necessary to carry out its duties;
(c) Render, at least semi-annually, a written report to the city council concerning its activities,rulings,
actions,results of hearings, and all other matters pertinent to the rent control ordinances and regulations of
the city; including recommendations for amendment thereof;
(d) Maintain and keep hearing tiles and dockets listing the time, date, and place of hearings,the parties
involved,the addresses of such parties and final disposition of each petition;
(e) Adopt rules and regulations establishing categories of petitions, which may include priorities of the
different categories so established; and
(f) Perform other duties specified by the city council not inconsistent with this Charter, or with the
provisions of Title 4 of the Palm Springs Municipal Code on the effective date of this Charter, or as may be
amended.
SECTION 609. Board of Library Trustees.
There shall be a board of library trustees consisting of five members. There shall also be a city librarian,
whose duties shall be established by ordinance, resolution, or regulation of the City and who shall serve as
recording secretary to the board of library trustees. The city librarian, or his or her designated representative
shall attend all board of library trustee meetings. Except as otherwise specifically provided in this Charter,the
board of library trustees shall have the powers and duties provided by, and shall be administered pursuant to, the
provisions of the general laws of the State of California governing municipal libraries and boards of library
trustees. Unless and until the board of library trustees for the City in existence on the effective date of this
Charter shall be disbanded pursuant to procedures established in the general law of the State of California, and
notwithstanding any other provision of this Charter,the board of library trustees shall have the powers and duties
provided by, and shall be administered pursuant to,the provision of the general laws of the State of California

2.06.010 General rules regarding appointments, terms, vacancies.
(a) Unless otherwise provided by law, or by ordinance adopted after the effective date of the ordinance
codified in this section, all members of boards and commissions of the city shall be appointed for three-year
terms commencing on July 1st of the year of appointment;provided,that interim vacancies shall be filled by
appointment for the unexpired term of the member replaced-
(b) Subject to its unfettered legislative discretion,the council will attempt to ensure that members appointed
to city boards and coirumissions shall reflect the social, ethnic and cultural diversity of the community.
(c) Persons appointed to a board or commission may be reappointed for up to one additional full term,not to
exceed a total of seven years of service on such board or commission; such reappointments shall not be
consumed as automatic, and applicants must go through the same process for reappointment as all other
applicants who are seeking initial appointment.
(d) Except in cases where the mayor or the city council are not the appointing authority,no person appomtcd
to a board or commission shall become eligible for appointment to such board or commission for a period of one
year from the expiration of his or her service upon such board or commission;provided,however, that person, if
otherwise qualified, shall become immediately eligible for appointment to any other board or commission
without the one-year hiatus. After the expiration of one year during which the person has not served upon the
same board or commission,that person,if otherwise qualified, shall again become eligible for appointment to the
board or commission upon which he or she formerly served, subject to the provisions of subsection(c)of this
section.
(c) Unless otherwise provided by law, or by ordinance or resolution of the city council,all members of boards
and commissions of the city shall be initially, and during their incumbencies,bona fide residents and registered
voters of the city, and no such member at or during such time shall be an employee of the city,nor a current
applicant for city employment.
(f) Any member may be removed from office at any time,with or without cause,by a majority vote of the
members of the city council. If a member is absent without advance permission of the board or cormnission or of
the member's appointing authority, from three consecutive regular meetings or from twenty-five percent of the
duly scheduled meetings of the board or cormnission within any fiscal year,the chair of the board or commission
shall file a certification with the City Clerk that such absences have occurred, and the member's office shall
thereupon automatically become vacant and shall be filled as any other vacancy-
(g) All existing members of any board or commission shall be eligible upon the expiration of their existing
term for one additional three-year tenn, unless they have also served an additional interim term,in which case
they shall not be eligible for an additional tern if their total continuous service would then be more than seven
years, counting the additional three-year term to which they would be reappointed. (Ord. 1724 § 1, 2007; Ord.

2.06.020 Chairmen,vice-chairmen—Selection—Terms.
Unless otherwise provided by law, or by ordinance or resolution adopted after the effective date hereof,
each board and commission of the city shall amorally at its first meeting held after June 30, choose one of its

number as chairman and one as vice-chairman. Each chairman and vice-chairman shall have authority and
perform such duties as are commonly associated with their respective titles, or as may be specially prescribed by
law or by the bylaws or other rules of the board or commission. Vacancies in either such position occurring prior
to July 1 may be filled as in the first instance, and a new chairman or vice-chairman may be chosen at any time
by majority vote of all members of the board or commission. (Ord. 1027 § 1, 1976)

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ESTABLISHING REQUISITES FOR CONSIDERATION OF
APPOINTMENTS TO CITY BOARDS AND COMMISSION, AND
PROCEDURES FOR NjUI:NG APPOINTMENTS THERETO.
' BE IT RESOLVED BY TI3E CITY COUNCIL OF THE CITY OF PALM SPRINGS, AS
FOLLOWS:
SrCti0n 1- GenPr (a) The Cit-y's boards and commissions
perform a critical role in the governance of the
City and in the relationship between the City
Council, the governmental organization, and the
citizens of Palm Springs. The boards and
commissions serve to assioL in making policy,
perform administrative functions, are a reservoir
of experience and judgment, and assist in the two-
way communications between the City and its
citizens. To this and, it is the goal of the City
Council that the process for recruiting board and
Commission members be as open as possible and
designed to bring forward those persons best suited
by interest, character, and experience to assist in
these objectives, and who will at the same time
represent the diverse interests in the community.
(b) Any reference herein to "commission" shall he
deemed to apply to all boards, commissions, or
committees unless otherwise stated_
' (c) This policy shall apply to boards,
commissions, and committees established by
ordinance, resolution, or other formal action of
the City Council to Lhe extent required by the
Brown Act (Government Code Section 54950, 6t seaj)
and, insofar as is possible, it shall be followed
in appointments to other such temporary advisory
hoards and committees that are otherwise
established. The Mayor and city Council may,
however, in making such appointments to temporary
advisory boards and committees depart from these
guidelines if permitted by the Brown Act.
(d) Nothing stated in this resolution is intended
to diminish or derogate the prerogatives of the
Mayor or of the City council pertaining to
appointments, as contained in Government Code
Section 40605.
Section 2. Criteria for. 3e1PQtiOn. The City Council will
follow the following policies in selecting
commission members:
(a) Rp�i.Oge T q. All appointees shall be bonafide
residents and registered voters of the City of Palm
Springs.
(b) Rxcper�ie rej@ducation. The Council is seeking
applicants who demonstrate that by their
background, experience, and education, they will be
enthusiastic and knowledgeable commissioners who
will exercise sound judgement.

(c) Cultural diversity-. Appointees should reflect
the social, ethnic and cultural diversity of the
community.
(d) Attendance. Attendance at prior commission
meetings during the previous six (6) months will be
an important indicator of the applicant's interest
in the activities of the commission and will allow '
the Council during the interview t❑ determine the
applicant's understanding of the function of the
commission
(a) Conflijcts. Commissioners shall comply with
appropriate provisions of law relative to
disclosure of L•inanctial interests. It shall be the
policy of the City Council not to appoint or
approve appointment of any person to a commission
who would have Continually recurring conflicts of
interest to the extent of impairing their
effectiveness as a commissioner.
Section 3. Schedule. It shall. be the goal of the City Council
to undertake the appointment- process in accordance
with this schedule. The availability of positions
shall be noticed annually by March 1. At that time
the Mayor shall appoint Council subcommittees for
screening applications. Applications will be due
by the end of March. The applications will be
screened by mid-April and an interview schedule
established. Interviews will then be conducted so
that appointments can be made at the time of the
City Council's second meeting in May. Appointees
should attend all commission meetings after '
appointment as observers until they take office.
Terms commence on July 1 or as soon thereafter as
the commissioners are appointed and qualified.
SecL•ion 4. Notice of Availability. (a) Pursuant- to
CovernmenL Code Section 54972, prier to December 31
each year, Lhe City Clerk is hereby directed to
prepare an Appointments List of all regular and
ongoing commissions which are appointed by the
legislative body which shall Contain the
information required in said section; the Library
Center is hereby designated as the Library to
receive the Appointment List required by Section
54973 of said Code. (Nate: Established by Minute
Order 8/12/92.)
(b) All efforts will be made to provide timely
public information relative to vacancies prior to
the time for appointment. To insure that members
reflect a broad cross section of the community, a
strategic recruitment shall be undertaken, at least
annually, which may include, but not be limited to,
(1) use of local consumer media such as '
radio, television, and newspaper;
(2) Preparation of flyers for distribution in
the community; and through Community
organizations and contact persons.
(c) Government Code Section 54974 provides that
whenever an unscheduled vacancy occurs, a special
vacancy notice shall be posted in the office of the

City Clerk, and as may otherwise be directed by the
City council, within twenty (20) days after the
vacancy occursi and that final appointment to fill ,
such vacancy shall not he made for at least ten
(10) working days after such posting.
Notwithstanding such provisions, the Mayor and City
Council shall endeavor to fill vacancies on City
' boards and commissions within forty-five (d5) days
from the date the vacancy occurs.
Section 5. Any person desiring to be considered for
appointment to any City commission, including
incumbent commission members, shall complete an
application stating the applicant's name, address,
telephone number, the appointment desired, and any
other pertinent facts on an application form to be
provided by the City Clerk. No person may be
appointed who has not timely submitted such an
application.
Section 6. Applicants may not apply for more than two
commissions, nor concurrently serve on more than
one.
Section 7. it shall be the policy of the City Council that the
following basic procedures shall apply in making
appointments to commissions created by the City
Council:
(a) The application shall include, but not be
limited to the fallowing information:
' (1) The number of commission meetings
attended in the prior six (6) months;
(2) Outline the criteria for selection in
Section 2 hereof.
(3) The applicant's experience and
qualifications for the position.
(4J The applicant's education.
(5) The applicant's ideas and goals for the
commission.
(b) The Mayor shall appoint Council subcommittees,
each consisting of the Mayor and one alternating
Councilmember, to screen applications to determine
qualified applicants.
(c) The City Clerk shall compile and distribute to
the City Council a list of all "qualified
applicents" (as determined by the subcommittees) .
Any Councilmember may add the name of one other
person filing an application to the list by so
informing the City Clerk.
(d) The City Clark shall schedule interviews with
the full City Council of all finalists for a
particular commission. The Chairperson of the par-
ticular commission, or the Chairperson's
commissioner-designee, shall he invited to the
interview.

(e) Couacilmembers shall indicate their preference
for selection, and the Mayer may Lake such
preferences into consideration.
Section 8. Appointments to commissions shall. be made at a
regular, or adjourned regular meeting of the City
Council. ,
Section 9. Resolution lvo_ 18020 preciously establishing
guidelines for Council appointments to boards and
commissions is hereby superseded and repealed in
its entirety.

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,CALIFORNIA, ESTABLISHING GENERAL GUIDELINES FOR THE
CONDUCT OF VARIOUS BOARD AND COMMISSION MEETINGS, AND
RESCINDING RESOLUTION NO- 18723.
' BE IT RESOLVED BY TI3E CITY COUNCIL OF THE CITY OF PALM SPRINGS, AS
FOLLOWS;
Section I. That unless otherwise provided by law or by
ordinance or resolution of. the City Council, boards
and commissions shall serve in an advisory capacity
to the City Council, who shall have final authority
to establish all rules, regulations, and policies
Of the City. However, it is the desire of the City
Council that boards and commissions assist the
Council by recommending policies, guidelines, and
programs for legislative action within areas of
their jurisdiction.
Section 2. That in developing such policy recommendations,
board and commission members may seek community
input through personal contact, working with
various special-interest groups and holding public
hearings when appropriate, to thoroughly review all
proposals before final action is taken.
Section 3. That when acting as a hearing body in a quasi-
judicial manner, members of boards and commission
should refrain from independent investigations or
' prejudgment of the matter. The matter shall be
judged only on the basis of documents, testimony,
and other evidence presented at the hearing,
available to all, and made a part of the record.
Members should not express an opinion concerning
the merits of the matter prior to such hearing.
Section 4. That in the absence of a rule to govern a point or
procedure or the making of a motion, Roberts Rules
of Order, newly revised, shall be used as a guide.
Each Hoard and commission may adopt any other
parliamentary or procedural rules for the conduct
of meetings as they deem appropriate, so long as
such rules are not in conflict with any rule or
regulation of the City Council or State law. Such
rules may include rules governing decorum and the
appropriate conduct of members and the public.
section 5. That all board and commission meetings shall be
televised after July 1, 1996, unless the City will
incur significant economic expense.
Section 6. That boards and commissions shall allow a time at
each meeting for public comment where the
' interested members of the public can introduce
and/or comment on issues which may or may not
relate to the agenda, consistent with provisions of
the Brown Act.
Section 7_ That staff reports on agenda items should he
prepared sufficiently in advance to allow for
review by interested citizens and members of the
board or commission; such agenda Shall be made
available to the public 72 hours prior to the

regularly scheduled agenda, and shall comply with
the Srown Act. The City Manager, or his designee
will seek media assistance in publicizing pertinent
agenda :i.tams and disseminating information about
specific proposals.
Section a. That the City council will hold joint- study
session/workshops with boards or commissions on an '
as-needed basis. A general orientation for all
boards and commissions, to address such topics as
the Brown Act, conflicts of interest, sCatements of
economic interest, meeting procedures including
Roberts Rules of Order, and due process, shall be
conducted annually in ,Tune, or as soon thereafter
as practicable_
section 9. That each board or commission shall prepare an
annual. report on its accomplishments in the past
year and goals for the following fiscal year, which
shall be submitted to the City Council, by March 1,
for the Council's review, revision, and/or
approval. The work plan should include goals to be
accomplished at .least quarterly. The approved work
program fox the following year shall be reviewed by
each board or commission with its new members whose
terms commence on July 1.
Section 10. That boards and commissions shall not as a body
take positions on local election issues, or on
candidates for office. Nothing heroin shall limit
individual members from expressing opinions or
personal preferences as private citizens, either
orally or in writing, and in doing so, members '
should state clearly that such views are personal
and do not represent those of the board or
commission.
Section 11. Resolution No. 18723 previously establishing
guidelines for the conduct of board and commission
meetings is hereby superseded and repealed in its
entirety.
