APPROVAL OF A REQUEST BY THE PUBLIC ARTS COMMISSION TO PURCHASE A
SCULPTURE ENTITLED WAVE RYTHMS BY JOHN MISHLER (ARTIST) FOR $30,000, AND
APPROVING AND AUTHORIZING THE CITY ATTORNEY TO PREPARE AN AGREEMENT
FOR PURCHASE AND SALE OF PUBLIC ARTWORK.
RECOMMENDATION:
That the City Council approve the request by the Public Arts Commission to purchase a
sculpture entitled Wave Rythms by John Mishler(Artist)for$30,000 and approving and
authorizing the City Attorney to prepare an Agreement for Purchase and Sale of Public Artwork.
BACKGROUND:
The Public Arts Commission's desire to continue to develop and maintain a visual arts program
for visitors and residents of Palm Springs and add to the economic viability of the community by
acquiring additional works of art that will enhance the City's Public Arts Collection.
The Acquisition Subcommittee has met on serval occasions to review and recommend to the
full Commission the purchase of certain works of art. On January 7, 2005 at the Public Arts
Commission meeting the Subcommittee recommended the acquisition of a sculpture entitled
Wave Rythms. The Commission voted unanimously to approve the purchase of the sculpture
in the amount of$30,000 plus additional funds to prepare the site which shall not exceed
$10,000. The site shall meet the requirements of the Public Arts Ordinance No.1479 Section
3.37.080 Art Site Acceptability.
The artwork consists of two kinetic elements of the sculpture which turn randomly in the wind,
passing each other, looking like they will collide, but do not and continue turning in the wind.
The material is steel sheets that are shaped and welded together. The stainless steel will be
textured in a pattern and accented with red and black paint.
The Commission is seeking City Council approval for the purchase so that staff can proceed
with preparing the Purchase Agreement, subject to City Attorney and City Manager review and
approval. A site plan, costs and installation time frame will be outlined in the Agreement. The
costs to purchase the sculpture, installatio and site preparation will come from the Public Arts
Funds (4406-50015 No general fund m ney will be used.
