DATE: March 9, 2005 TO: City Council FROM: Interim Director of Planning Services TEMPORARY SUSPENSION OF NOISE ORDINANCE (CHAPTER 11.74.00), NOISE NUISANCE (CHAPTER 11.08.040), DANCES (CHAPTER 5.12), AND SIGN ORDINANCE (CHAPTER 93.20.00) AND APPROVING A CARNIVAL ON MARCH 25-28, 2005 TO FACILIATE THE PLANNED EVENTS FOR THE "WHITE PARTY". RECOMMENDATION That the City Council consider adopting a resolution suspending certain regulatory ordinances to facilitate "White Party" planned events at certain locations from March 25-28, 2005. SUMMARY The White Party has been held in Palm Springs for the past 15 years. The event utilizes a wide range of venues including Palm Springs Convention Center, Wyndham Hotel, the vacant lot at the northeast corner of Arenas Road and Calle Encilia, and Knott's Soak City USA. The event is scheduled for March 25-28, 2005. Over the past several years, the success of the event has resulted in increased attendance, expanded activities, and use of additional sites. If the City Council wishes to facilitate the 2005 event, certain regulatory ordinances that would normally impede such an event will need to be temporarily suspended pursuant to Chapter 6.12 of the Municipal Code. These ordinances include the Noise Ordinance, Noise Nuisance, Dances, and Sign Ordinance. BACKGROUND This year, the White Party is scheduled from March 25-28, 2005. Main events are the Opening Party on March 25, the White Party on March 26, the Tea Dance/Carnival and the Closing Party on March 27. Convention Center—The White Party 4000 11 a.m. to 5 p.m. Wyndham Pool Side - Pool Party 1500 March 27 3 p.m. to 9:30 p.m. Vacant lot @ NE corner of Arenas Road 4000 Sunday and Calle Encilia —Tea Dance/Carnival 9 p.m. to 4 a.m. Wyndham Ballroom — Closing Party 2500 Similar to previous years, after hours dance parties will be held at Heaven Night Club located at 611 S. Palm Canyon Drive on March 26, 2005 from 1 a.m. to 7 a.m., March 27, 2005 from 4 a.m. to 10 a.m. and on March 28, 2005 from 3 a.m. to 8 a.m. These events will take place inside the premises of the nightclub, will not require suspension of any ordinances, and are subject to a separate permitting process through the Planning Department. �`� . D. ANALYSIS If the City Council wishes to facilitate this event as proposed, certain regulatory ordinances that could impede the conduct of such an event will need to be temporarily suspended. The promoter will need to apply for a Temporary Use Permit for only the Arenas Road Tea Dance/Carnival. Other events where live entertainment is provided are being held indoors (at the Wyndham Hotel, Hilton Hotel, and Convention Center) in response to noise complaints received from the previous year's event. The only events that will be held outdoors with amplified music will be the pool parties at the Wyndham Hotel and the private party at Knott's Soak City USA. The schedule of events were reviewed by the Special Events Planning Team (SEPT) on March 3, 2005 where a number of key issues were discussed. As has been the case in previous years, the promoter has agreed to work with the City in reducing noise and other safety concerns through the implementation of crowd control measures, on-site security, traffic control, medical aid, and contracted Police and Fire services. For the March 26 White Party to be held at the Convention Center, public access will be from Avenida Caballeros near the Springs Room. The dance party will be staffed by private security contracted by the Convention Center, Palm Springs Police Officers, Palm Springs Fire Inspectors, and EMS contracted by the event promoter. For the March 27 Tea Dance, parade barricades will be erected by the City's streets and traffic maintenance staff. The intersection of Arenas Road and Calle El Segundo will be closed from 6 p.m. to 10 p.m. The promoter is required to contact the church located on Calle El Segundo to inform them of the street closure which will affect their entry driveway. In response to crowd and traffic control concerns, private security, 2 California Highway Patrol officers, and 5 additional Palm Springs Police officers will be at the Tea Dance. The increase in Palm Springs Police Officers from last year's event is due to the need to secure the area where the fireworks will be located at the intersection of Arenas Road and Calle El Segundo. A 10-minute pyrotechnic display to occur at approximately 9 p.m. will not consist of aerial or concussion-type shells. The promoter and pyrotechnic company shall submit certificates of insurance accompanied by an additional insured endorsement form showing the City as an additional insured party with the standard coverage of $1,000,000, The Tea Dance will include a ferris wheel. Safety inspections for the Ferris wheel are under the authority of Cal-OSHA and the Palm Springs Fire Department. In the interest of providing public information and responding to any complaints received during the course of the White Party events, a non-emergency number will be provided. In addition, the promoter is required to notify all surrounding neighbors in writing of the date and times of all planned activities along with the non-emergency phone number. Two notices shall also appear in The Desert Sun prior to the start of the events. The promoter is not requesting that the City pay for any event production or operational costs. RESOLUTION NO. 21224 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, SUSPENDING NOISE ORDINANCE (CHAPTER 11.74,00), NOISE NUISANCE (CHAPTER 11.08.040), DANCES (CHAPTER 5.12), AND SIGN ORDINANCE (CHAPTER 93.20.00), AND APPROVING A CARNIVAL ON MARCH 25-28 2005 TO FACILITATE THE PLANNED EVENTS FOR THE "WHITE PARTY". WHEREAS, the City Council desires to facilitate the White Party; and WHEREAS, the City Council finds that certain regulatory ordinances, which are generally deemed desirable and necessary, may, nonetheless, impeded the conduct of special events; and WHEREAS, the City Council finds that in holding special events, the public interest and the benefits derived therefrom outweigh the temporary public inconvenience; and WHEREAS, the City Council has enacted Ordinance No. 1310 authorizing temporary suspension of regulatory ordinances. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, finds as follows: Section 1: A. That the White Party is a special event beneficial to the community and its visitor-oriented economy. B. That the dates of the 2005 White Party are from March 25-28, 2005. C. That J.S. Enterprises is the event promoter along with the Palm Springs Wyndham Hotel, the Palm Springs Convention Center, Hilton Palm Springs Resort, and Knott's Soak City USA. D. That the venues of the White Party will be the Palm Springs Wyndham Hotel, vacant lot at the northeast corner of Arenas Road and Calle Encilia, Palm Springs Convention Center, and Knott's Soak City USA. Section 2: That the following ordinances are hereby temporarily suspended for the special event designated in Section 1 above: Noise Ordinance, Noise Nuisance Ordinance, Dances Ordinance,and Sign Ordinance.
