SUBJECT: PROPOSED RESOLUTION CERTIFYING THE RESULTS OF THE
MARCH 8, 2005 SPECIAL MUNICIPAL ELECTION

SUMMARY:
Pursuant to California Elections Code the City Council shall certify the results of the
March 8, 2005 Special Municipal Election.
RECOMMENDATION:
Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM SPRINGS, CALIFORNIA RECITING THE FACT OF THE SPECIAL
MUNICIPAL ELECTION HELD ON MARCH 8, 2005 DECLARING THE RESULT AND
SUCH OTHER MATTERS AS ARE PROVIDED BY LAW."
STAFF ANALYSIS:
At the direction of the City Clerk, the Riverside County Registrar of Voters canvassed
the returns of the March 8, 2005 Special Municipal Election. The Registrar of Voters
has provided a Certification to the Results and Canvass of the Election Returns.
Pursuant to California Elections Code the City Council shall certify the results of the
election.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA RECITING THE FACT OF
THE SPECIAL MUNICIPAL ELECTION HELD ON MARCH
8, 2005 DECLARING THE RESULT AND SUCH OTHER
MATTERS AS ARE PROVIDED BY LAW.
WHEREAS, a Special Municipal Election was held and conducted in the City of Palm
Springs, California on Tuesday, March 8, 2005, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers were
appointed and that in all respects the election was held and conducted and the votes
cast, received and canvassed and the returns made and declared in time, form and
manner as required by the provisions of the laws of the State of California, and the
Charter of the City of Palm Springs.
WHEREAS, pursuant to Resolution No. 21132 and Resolution No. 21133 adopted by
the City Council on November 10, 2004, the Riverside County Registrar of Voters, at the
direction of the City Clerk of the City of Palm Springs, canvassed the returns of the
election and has certified the results to the City Council. The results are attached to this
resolution as Exhibit A.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS AS FOLLOWS:
SECTION 1: That the whole number of ballots cast in the precincts except absent voter
ballots was 5720. That the whole number of absent voter ballots cast in the City was
5,884, making a total of 11,604 ballots cast in the City.
SECTION 2. That the Special Municipal Election was held for the purpose of submitting
to the voters of the City of Palm Springs the following questions:
Measure B. Shall the General Plan of the City of Palm
Springs be amended to establish a new MR (Mountain
Region) designation for approximately 55.5 square miles of
property in and proximate to the San Jacinto and Santa
Rosa Mountains, and repeal the various land use regulations
currently affecting this property?
Measure C. Shall Resolution 20994 approving amendments
to the General Plan Use and Circulation Plan for Palm Hills
area be adopted?
SECTION 3. That the number of votes given at each precinct and the number of votes
given in the City for and against each question are attached as Exhibit A.

SECTION 4. The City Council declares and determines that: As a result of the election,
a majority of the voters voting on Measure B "Shall the General Plan of the City of Palm
Springs be amended to establish a new MR (Mountain Region) designation for
approximately 55.5 square miles of property in and proximate to the San Jacinto and
Santa Rosa Mountains, and repeal the various land use regulations currently affecting
this property?" did NOT vote in favor thereof and that Measure B was rejected.

the results of the election, showing:
a. The whole number of votes cast in the City;
b. The Measures voted upon;
C. The number of votes given at each precinct for and against each Measure;
d. The number of votes given in the City for and against each Measure.
SECTION 7. That the City Clerk shall certify to the adoption of this resolution and enter
it into the book of original resolutions.
