Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The Indian Reservation Roads (IRR) Program addresses transportation needs of tribes by providing funds for planning, designing, construction, and maintenance activities. The program is jointly administered by the Federal Highway Administration's Federal Lands Highway Office and the Bureau of Indian Affairs (BIA) in accordance with an interagency agreement. Approval of a Memorandum of Understanding (MOU) between the City and the Agua Caliente Band of Cahuilla Indians (Tribe) allocating the Tribe's IRR funds to a specific project is required by the BIA. RECOMMENDATION: Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PALM SPRINGS AND THE AGUA CALIENTE BAND OF CAHUILLA INDIANS REGARDING PROJECT CONTRIBUTIONS FOR THE BELARDO ROAD BRIDGE AND ROADWAY PROJECT." STAFF ANALYSIS: On March 12, 2008, the City Council approved a MOU with the Tribe and BIA establishing an arrangement whereby the Tribe can assign to the City use of its IRR funds received from the BIA (see Attachment 1). A final step to receiving any IRR funds is entering into a subsequent MOU with the Tribe regarding allocation of IRR funds to a specific project. Approval of the attached MOU is necessary to show the BIA that the Tribe has committed to the City this portion of its IRR funds- FISCAL IMPACT: Approval of the MOU will allow the City to indirectly receive up to $2,251,269 of federal funds from the IRR Program from the Aqua Caliente Band of Cahuilla Indians. Approval of a Memorandum of Understanding (MOU) between the City, the Agua Caliente Band of Cahuilla Indians (Tribe), and the Bureau of Indian Affairs (BIA), is the first step to identifying Indian Reservation Roads in the City and ensuring the Tribe receives its allocation of federal funding that may be used for construction and maintenance of streets in Palm Springs. RECOMMENDATION: 1) Approve the Memorandum of Understanding between the City of Palm Springs, the Agua Caliente Band of Cahuilla Indians, and the Bureau of Indian Affairs regarding the Indian Reservation Roads Program. 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The Office of Federal Lands Highway (FLH) works with numerous agencies. Approximately 30 percent of the land in the United States is under jurisdiction of the Federal government. The federal land management agencies (FLMAs) are: the Bureau of Indian Affairs (BIA), U.S- Forest Service (USES), National Park Service (NPS), Fish and Wildlife Service (FWS), Bureau of Land Management (BLM), Military Surface Deployment and Distribution Command (MSDDC), U.S. Army, U.S. Army Corps of ITEM N0.; City Council Staff Report March 12, 2008-Page 2 City/Tribal/BIA IRR Program MOLL Engineers (USAGOE), U.S. Navy, Tennessee Valley Authority, and the Bureau of Reclamation (BOR). The FLH also works closely with many State and Territorial partners. The Federal Lands Highway Program (FLHP) is subdivided into five core areas, namely, the Forest Highway (FH) Program, Park Roads and Parkways (PRP) Program, Public Lands Highway Discretionary (PLHD) Program, Indian Reservations Roads (IRR) Program, and the Refuge Roads (RR) Program. The FLHP is administered through partnerships and interagency agreements between FHWA's Office of Federal Lands Highway and FLMAs and Tribal customers. The FLHP also supports other important FLMA partners by providing funding (about $6 million per year total) for integrated transportation planning, bridge inspections and other technical assistance activities. The FLHP was created with the 1982 Surface Transportation Assistance Act (STAA). The primary purpose of the FLHP is to provide funding for a coordinated program of public roads that serve the transportation needs of the Federal lands which are not a State or local government responsibility. The Indian Reservation Roads (IRR) Program addresses transportation needs of tribes by providing funds for planning, designing, construction, and maintenance activities. The program is jointly administered by the Federal Highway Administration's Federal Lands Highway Office and the Bureau of Indian Affairs (BIA) in accordance with an Interagency agreement. The Indian Reservation Roads are public roads which provide access to and within Indian reservations, Indian trust land, restricted Indian land, and Alaska native villages. Approximately 25,000 miles are under the jurisdiction of BIA and tribes and another 24,000 are under State and local ownership. IRR funds can be used for any type Title 23 transportation project providing access to or within Federal or Indian lands and may be used for the State/local matching share for apportioned Federal-aid Highway Funds. The Fiscal Year 2008 allocation for the IRR Program is $410 Million, increasing to $450 Million for Fiscal Year 2009. These funds are allocated to the different Indian Reservations based on an individual Indian Reservation Roads Program for each Tribe, outlining all of the public roads that provide access to and within the Tribal Reservation. The Tribe has provided the City with a standard MOU that will facilitate the Tribe's IRR Program for public roads within the City of Palm Springs that would be eligible for funding under the IRR Program. Approval of the MOU is the first step in identifying for the federal government all of the public roads within Palm Springs that facilitate access to and within the Agua Caliente Band of Cahuilla Indians' Reservation, opening up the Tribe to receipt of federal funds under the IRR Program, which may be passed to the City for use through future cooperative agreements for specific projects. MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PALM SPRINGS, THE AGUA CALIENTE BAND OF CAHUILLA INDIANS, AND THE BUREAU OF INDIAN AFFAIRS This Memorandum of Understanding (MOU) is by and between the Agua Caliente Band of Cahuilla Indians (Tribe), the City of Palm Springs (City), and the Bureau of Indian Affairs (BIA) to incorporate all sections of the identified routes in this agreement into the BIA Indian Reservation Roads (IRR) inventory system according to the process outlines in 25 CFR 170, for the benefit of the Tribe, the City, the BIA, and the public. This MOU constitutes solely a guide to the respective intentions and policies of the parties involved. It is not intended to authorize funding by the City nor is it a legally binding contract. The IRR program funding through the BIA, Federal Lands Highways Program assists the Tribe in the improvement of roads and bridges within and leading to the Agua Caliente Indian Reservation (Reservation), and the inclusion of City owned routes should cause the Tribe's annual share of the IRR funds to increase. This agreement relates specifically to the City routes listed on Exhibit "A" that are proposed to be added to the BIA IRR inventory. The City will continue its existing ownership, jurisdiction, and maintenance responsibilities and the facilities will continue to be open to the public. The City is not relinquishing jurisdiction nor granting jurisdiction to the Tribe or BIA for any listed routes, bridge, or associated rights of way. The Tribe has identified all sections of the public City routes as critical transportation facilities which provide access within and leading to the Tribe's Reservation and are important to the Tribe because they serve the Tribal community_ The routes identified in this agreement are eligible for construction or reconstruction with federal funds. When and if adequate funding for needed improvements for these routes becomes available, and improvement has become an approved project for the Tribe, City, or BIA, a separate cooperative funding agreement will be negotiated as necessary in accordance with applicable statutes and regulations. If improvements to the routes are complete under a separate cooperative agreement, the City will continue to be responsible for maintenance to the routes,which will remain open to the public. This agreement is binding upon the signatories hereto, not as individuals, but solely in their official capacities of their respective governments; and acknowledges proper action of the City, Tribe and BIA to enter into the same. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PALM SPRINGS AND THE AGUA CALIENTE BAND OF CAHUILLA INDIANS REGARDING PROJECT CONTRIBUTIONS FOR THE BELARDO ROAD BRIDGE AND ROADWAY PROJECT WHEREAS, the Agua Caliente Band of Cahuilla Indians (the "Tribe") is a federally- recognized Indian Tribe governing itself according to a Constitution and By-Laws and exercising sovereign authority over the lands of the Agua Caliente Indian Reservation; and WHEREAS, the Tribe desires to work with the City of Palm Springs (City) in good faith to complete the construction of the Belardo Road Bridge and Roadway Project (Project), a Capital Improvement Project for the City, and WHEREAS, the Tribe and the City have an existing Memorandum of Understanding (MOU) regarding this Project dated June 19, 2002, and WHEREAS, the transportation route designated for widening and improvements as part of the Project is listed in the Tribe's FY 2008 Indian Reservation Roads (IRR) Inventory, and is eligible for IRR funding; and WHEREAS, the Tribe is seeking to use its Fiscal Year (FY) 2009 IRR Tribal Allocation towards the right-of-way acquisition and construction of the Project; and WHEREAS, the use of IRR funding requires an additional MOU identifying the responsibilities of the Tribe and the City with respect to the receipt of IRR funds from the Bureau of Indian Affairs; and WHEREAS, such an intergovernmental MOU has now been negotiated between the Tribe and the City regarding Project Contributions for the Belardo Road Bridge and Roadway Project (the "Project Contributions MOU"); and WHEREAS, the Tribal Council has reviewed the terms of the Project Contributions MOU, and finds those terms to be satisfactory. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: 1. ABSENT: ABSTAIN: James Thompson, City Clerk City of Palm Springs, California :j Ex4 INTERGOVERNMENTAL MEMORANDUM OF UNDERSTANDING By and Between THE AGUA CALIENTE BAND OF CAHUILLA INDIANS and THE CITY OF PALM SPRINGS Regarding PROJECT CONTRIBUTIONS FOR THE BELARDO BRIDGE AND ROADWAY PROJECT THIS INTERGOVERNMENTAL MEMORANDUM OF UNDERSTANDING ("MOU") is entered into this _ day of 2009, by and between the AGUA CALIENTE BAND OF CAHUILLA INDIANS, a federally recognized Indian tribe, (the "Tribe") and the CITY OF PALM SPRINGS, a municipal corporation (the "City"). I. RECITALS WHEREAS, the Agua Caliente Band of Cahuilla Indians is a Federally- recognized Indian Tribe governing itself according to a Constitution and By-Laws and exercising sovereign authority over the lands of the Agua Caliente Indian Reservation (Reservation), acting through its duly elected Tribal Council, subject to Federal law; and WHEREAS, the City, acting through its City Council (the "City Council'), is a political subdivision of the State of California, established pursuant to the Constitution of the State of California; and WHEREAS, the Tribe and the City desire to work together in good faith to complete the construction of the Belardo Bridge and Roadway Project (Project), a Capital Improvement Project for the City; and WHEREAS, the Tribe and the City have an existing MOIL regarding the Project dated June 19, 2002; and WHEREAS, the transportation route designated for widening and improvements is listed in the Tribe's FY 2008 Indian Reservation Roads (IRR) Inventory and is eligible for IRR funding; and WHEREAS, the IRR Program is jointly administered by the Bureau of Indian Affairs (BIA), and the Federal Highway Administration's (FHWA) Federal Land's Highway (FLH) Office, and WHEREAS, the Tribe will make a contribution of $2,251,269 from its Fiscal Year (FY) 2009 IRR Allocation towards the survey, right-of-way acquisition, and construction of the Project; and WHEREAS, the BIA and FHWA will review and approve the PS&E for the Project or a State licensed professional engineer will certify that the Project PS&E comply with health and safety requirements. ROAD: 1. The Project will consist of widening and improvements to Belardo Road, approximately 250 meters west of South Palm Canyon Drive to a point approximately 200 meters north of Sunny Dunes Road. 2. Improvements include the construction of a two-lane bridge to carry Belardo Road over Tahquitz Creek and construction of new roadways to connect noncontiguous sections of Belardo Road. • rJlx CITY'S RESPONSIBILITIES: 1. The City will be responsible for contracting engineering design services and construction engineering and inspection services. 2. The City will conduct advertising and bidding for Project construction. 3. The City will accept right-of-way offered by Tribe and other land owners. 4. The City will coordinate the Project with the Tribe, and will submit completed documents as necessary for the work noted above. TRIBE'S RESPONSIBILITIES: 1, The Tribe will be responsible for contracting all environmental services required by the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA). 2. The Tribe will be responsible for contracting all right-of-way services including asserting its best effort and assisting the City to obtain all necessary rights-of-way. 3. The Tribe will coordinate the Project with the City, and will submit completed documents as necessary for the work noted above. 4. The Tribe will make payments, subject to the availability of funds from the BIA, to the City from its FY 2009 IRR Tribal Allocation, up to $2,251,269, for use toward the survey, right-of-way acquisition, and construction of the Project, based on work performed and progress estimate submitted in the BIA's format and after approval of the payment by the BIA. GENERAL TERMS AND CONDITIONS: 1. Recitals. All of the above recitals are true and correct and the Tribe and City so find and determine. 2. Modifications. This MOU may only be modified in writing, signed and duly approved by both the Tribal Council and the City Council. 3. Approval. The City shall approved this MOU by passage of a duly adopted resolution of the Palm Springs City Council and the Tribe shall approve this MOU by passage of a duly adopted resolution of the Tribal Council. Both resolutions shall be subject to the prior review and approval "as to form" by both the Tribe's legal counsel and the City's legal counsel prior to approval "as to content" by the respective Councils. 4. Authority. The individuals signing this MOU warrant and represent that pursuant to their respective constitutions and/or bylaws they have the full power and authority to enter into this MOU and fully perform in accordance with the terms hereof, and the Tribe and the City acknowledge that their respective legal counsels have advised that this MOU is not subject to approval of the authorized representative of the Secretary of the Interior under 25 U.S.C. §81. 5. Effective Date. This MOU shall take effect upon its execution. IN WITNESS WHEREOF, the parties hereto have executed this MOU as of the date first written above.
