SUBJECT: AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING SECTION 2.22.010 OF THE PALM SPRINGS MUNICIPAL
CODE, INCREASING THE MEMBERSHIP OF THE VILLAGEFEST
BOARD TO SEVEN MEMBERS.

SUMMARY
The City Council VillageFest Sub-Committee, comprised of Council members Foat and
Hutcheson, met with the VillageFest Board and MainStreet Executive committee on
June 8, 2009. The City Council Sub-Committee recommends a change to the Palm
Springs Municipal Code increasing the VillageFest Board membership from five to
seven members.
RECOMMENDATION:
1. Waive the reading of the ordinance text in its entirety and read by title only.
2. Introduce on first reading Ordinance No. , "AN ORDINANCE OF THE CITY
OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 2.22.010 OF THE
PALM SPRINGS MUNICIPAL CODE, INCREASING THE MEMBERSHIP OF
THE VILLAGEFEST BOARD TO SEVEN MEMBERS"_
BACKGROUND:
The Municipal Code currently states, "There is created a VillageFest board which shall
exist as an advisory body of the city. It shall consist of five members, serving without
compensation, appointed in the manner prescribed in Section 2.22.020 of this code. All
appointments to the board shall be for terms also as prescribed in Section 222.020 of
this code. (Ord. 1504 § 1 (part), 1995)

VillageFest Board Change
The code also identifies the term of the Board as follows, (a) Members of the board
shall be appointed or removed in accordance with and shall be subject to all the
provisions of Chapter 2.06 of the Palm Springs Municipal Code, as the chapter now
reads, or as it may be amended from time to time. Except for the initial staggered terms,
members shall serve for three-year terms and until their successors are appointed and
qualified, unless they are earlier incapacitated, resign, or are removed.
(b) Members of the board shall be either current retail merchants or have significant
retail experience, or, in the alternative, one member may be a representative of the
community-wide tourism industry. (Ord. 1674 § 1, 2005; Ord. 1504 § 1 (part), 1995)
The City Council VillageFest Sub-Committee recommends amending the existing
Municipal Code as identified in the attached.
FISCAL IMPACT:
Minimal staff time for additional coordination.

AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING SECTION 2.22.010 OF THE
PALM SPRINGS MUNICIPAL CODE, INCREASING THE
MEMBERSHIP OF THE VILLAGEFEST BOARD TO
SEVEN MEMBERS.
City Attorney Summary
This Ordinance increases the membership of the VllageFest
Board from five members to seven members.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ORDAINS:
SECTION 1. Section 2.22.010 of the Palm Springs Municipal Code is amended
to read-
2.22.010 Board Created.
There is created a VillageFest Board which shall exist as an advisory body
of the City. It shall consist of seven members, serving without compensation,
appointed in the manner prescribed in Section 2.22.020 of this code. All
appointments to the Board shall be for terms also as prescribed in Section
2.22.020 of this Code.
SECTION 2, The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary
thereof, to be published and posted pursuant to the provisions of law and this
Ordinance shall take effect thirty (30) days after passage.
