V� CITY COUNCIL April 6, 2005 PUBLIC HEARING Subject: EL DORADO BOULEVARD AND PUBLIC ALLEY RIGHT-OF-WAY VACATIONS Initiated by: Public Works and Engineering Department SUMMARY: The Streets & Highways Code of the State of California requires that the City hold a Public Hearing to discuss and review proposed right-of-way vacations. After consideration of testimony received at the Public Hearing, the City Council can consider denial or approval of the requested right-of-way vacation. RECOMMENDATION: It is recommended that the City Council, after considering testimony received at the Public Hearing, adopt a resolution vacating a portion of the right-of-way dedicated for El Dorado Boulevard, and various unused public alleys in the Desert Highlands Estates neighborhood, Section 34, Township 3 South, Range 4 East; File R-04-002. STAFF ANALYSIS: El Dorado Boulevard is identified as a local residential street, but has a total right-of-way width of 80 feet. The City's standard minimum width for local residential streets is 50 feet; and the City constructed El Dorado Boulevard to a minimum local standard with a 36 feet wide travel way in 1973. As such, there is an excess of 15 feet of right-of-way along and adjacent to either side of El Dorado Boulevard that is not necessary for present or future use. With the completion of Century Vintage Homes' Mountain Gate project, development interest in the Desert Highlands Estates neighborhood has greatly increased. Several different developers inquired as to the status of the excess right-of-way and the potential for City approval to vacate the excess. Further, a previous Parcel Map (Parcel Map 26089), approved by the City and recorded October 8, 1991, reverted to acreage and merged Lots 10-18 (between Las Vegas Road and Corazon Avenue) as well as vacated the frontage road that exists between Indian Avenue and El Dorado Boulevard, as well as the east half of the public alley that exists between Las Vegas Road and Corazon Avenue. The frontage road physically exists today, however, it is officially vacated by the C;ity's approval and the recordation of Parcel Map 26089. Further, the Parcel Map left the adjacent public alley with only half of its 30 feet width, or 15 feet, which is too narrow to use for public purposes. In reviewing the various rights-of-way issues in this neighborhood, staff recommends that the City pursue the vacation of the excess right-of-way along El Dorado Boulevard, as well as the remaining west half of the public alley adjacent to Parcel Map 26089 (identified as Lot 'R" on the Desert Highlands Map). Staff also looked to see what use, if any, the other 30 feet wide public alley had between Corazon Avenue and Tramview Road (identified as Lot "S" on the Desert Highlands Map). In researching the use of this public alley, staff found that not only is it not improved, but various developers expressed interest in making use of the alley as part of potential development of the adjacent lots, and that access would not come from the public alley. As such, staff is recommending vacation of the entire public alley identified as Lot "S". 0001 El Dorado Boulevard and Public Alley Right-of-Way Vacations April 6, 2005 Page 2 Engineering staff processed the right-of-way vacation request, and on January 26, 2005, the Planning Commission approved Case No. R-04-002, determining that the proposed right-of-way vacation of the easterly and westerly 15 feet of El Dorado Boulevard, the west half of the public alley identified as Lot "R", and the public alley identified as Lot "S" were consistent with the Circulation Element of the General Plan. Staff forwarded the requested right-of-way vacation information to the City Clerk, and pursuant to Section 8320 of the Streets & Highways Code, the City Clerk administratively scheduled a public hearing for April 6, 2005, to hear all persons interested in or objecting to the right-of-way vacation. Notices of the proposed right-of-way vacation have been posted within the vacation area, published in the local newspaper, mailed to all public utility companies, and sent to all City departments managing City facilities within public streets. City staff coordinated with the public utility companies and verified that no public utilities have existing facilities within the portion of El Dorado Boulevard requested for vacation (in the excess right-of- way area), however, existing overhead utilities exist within the public alleys, and a public utility easement is proposed to be reserved across these alleys as part of the Resolution of Vacation submitted for City Council approval. If the City Council desires to approve the proposed right-of-way vacations, adoption of the attached Resolution will vacate and close to public use the excess right-of-way on El Dorado Boulevard, the west half of the public alley identified as Lot "R", and the public alley identified as Lot "S.
