CASE NO. HSPB-48: REQUEST TO DESIGNATE THE HOME AT 272 CAMINO BUENA
VISTA DRIVE AS A CLASS ONE HISTORIC SITE.
RECOMMENDATION
That the City Council designate the home at 272 Camino Buena Vista as a Class One Historic
Site.
SUMMARY
The Historic Site Preservation Board, at their March 8, 2005 meeting, voted 6-0 (1 absent) to
recommend that the City Council designate 272 Camino Buena Vista as a Class One Historic
Site.
RULES AND REGULATIONS FOR A CLASS ONE HISTORIC SITE
A Class One Historic Site is a structure or site that qualifies for city designation. This structure
or site may be qualified at the federal, state and/or county level. An archival file will be
maintained. The structure or site may not be modified nor objects removed without the approval
of the City Council. Usage may be limited by the City Council to the extent that it may impair the
integrity of the site. The site will be identified by a plaque. The City Council is authorized to
designate Historic Sites. The Historic Site Preservation Board is charged with conducting
studies and investigation of sites proposed for designation and making a recommendation to the
City Council regarding proposed designation.
In accordance with Section 8.05.180 of the Palm Springs Municipal Code, no person may
undertake any of the following within or upon a Class One Historic Site without a Certificate of
Approval from the HSPB:
1. Construction of a new structure;
2. The moving, demolition, or alteration of an existing structure in any manner which affects
the exterior appearance of the structure;
3. A change in land use which affects the exterior appearance of a structure or the interior
arrangement of the public buildings;
4. The erection, remodeling or replacing of a sign which affects the exterior appearance of
a structure;
Additionally, in accordance with Section 8.05.170 of the Municipal Code, at any time after the
initiation of proceedings for designation of an historic site, the HSPB may, upon its own motion
or upon the application of any interested person, issue an order staying any proposed or
threatened demolition or alteration of the exterior of any structure within or upon such proposed
site. Such stay order shall be effective for no longer than 120 days and is intended to afford
time for necessary studies, hearings, and determination whether such site should be designated
as a historic site. Such stay order may be extended once for a period not to exceed sixty days.
Decisions of the HSPB may be appealed to City Council.

At this time, the HSPB has not and is not considering any staying actions related to this
structure.
272 CAMINO BUENA VISTA BACKGROUND
The 2003 Historic Resource Survey describes the site as follows, "The home was constructed in
1924 in the Spanish Colonial Revival Style and epitomizes the elegant rusticity of early Palm
Springs. The original main house is a single story and generally L-shaped in plan. Additions at
the rear sit higher on the site than the main house, but do not intrude on it visually. The main
house is situated facing a sloping lawn in front. The roof is covered with red tile; the eaves are
exposed. The principal roof terminates in a veranda, extending to cover the open porch. A low
wall of white stucco frames the porch. The exterior masonry walls are painted white and the
house retains the original unpainted wood finishes at the porch, specifically posts, beams, and
exposed rafters, and at the carved brackets and door and window lintels throughout. French
doors open onto the porch. Windows at the main house are multi-paned casements and retain
original sashes. The longer wing of the main house contains the kitchen; a smaller squared
volume protrudes at the south and contains the kitchen with a dedicated service entrance. The
house is fronted by a large yard with mature vegetation."
The home was previously owned by Earl Neel, former city councilman and owner of Neel's
Nursery, which was to become the site of Palapas Art Gardens and Nursery.
The subject property is zoned R-1-B and is located on a slope of greater than 10%. All exterior
improvements are subject to Architectural Review per Section 94.04.00 of the Palm Springs
Zoning Ordinance.
272 CAMINO BUENA VISTA DEFINING CHARACTERISTICS
The defining characteristics of the home are:
• Unpainted posts, beams, and exposed rafters
• Carved brackets and door and window lintels
• Multi-paned wood casement windows
Posts, beams, and exposed rafters: These are the original, unpainted wood finishes located at
the porch.
Carved brackets and door and window lintels: These are original details which are prevalent
throughout the home.
Multi-paned wood casement windows: These windows represent the vernacular tradition
common in early Palm Springs architecture.
ENVIRONMENTAL ASSESSMENT
In accordance with Section 15331 (Historical Resources Restoration/Rehabilitation) of the
California Environmental Quality Act (CEQA), the proposed designation is categorically exempt
from environmental review as the proposed designation meets the conditions outlined for
preservation of a historic resource.

All property owners within three hundred (300) feet of the subject site have been notified. As of
the writing of this report, staff has received general inquiries from interested property owners.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will
hold a public hearing at its meeting of April 6, 2005. The City Council meeting begins at 6:00
p.m. in the Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider designation of the home located at 272 Camino
Buena Vista as a Class One Historic Site. After considering all information presented, the City
Council may consider designating the house as a Class One or Class Two Historic Site. Class
One designations are typically reserved for sites that have maintained their historical integrity
over time while Class Two designations are for sites that have been significantly altered so as
not to resemble their original appearance or have historic significance but the structure is no
longer on the site or is not restorable.
This request is categorically exempt from review pursuant to Section 15331 (Historical
Resource Restoration/Rehabilitation) of the California Environmental Quality Act (CEQA),
whereas the proposed designation meets the conditions outlined for preservation of a historic
resource. The application is available for public review in the Department of Planning Services,
City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs.
If any individual challenges the action in court, issues raised may be limited to only those issues
raised at the public hearing described in this notice or in written correspondence to the City
Clerk at or prior to the City Council hearing.
An opportunity will be given at said hearing for all interested persons to be heard. Questions

RESOLUTION NO. 21235
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, DESIGNATING THE HOME
LOCATED AT 272 CAMINO BUENA VISTA, AS A CLASS
ONE HISTORIC SITE.
WHEREAS, the home located at 272 Camino Buena Vista was constructed in 1924; and
WHEREAS, the defining architectural style of the home is Spanish Colonial Revial; and
WHERAS, the incorporation unpainted wood finishes, door and window lintels, and
multi-paned casement windows were an integral part of the original design and have
continued to be maintained; and
WHEREAS, Chapter 8.05 of the Palm Springs Municipal Code allows for the designation
of historic sites; and
WHEREAS, the current property owners, Marty Botwinick and Joey English, filed an
application for Historic Site Designation; and
WHEREAS, notice of a public hearing of the Historic Site Preservation Board of the City
of Palm Springs to consider designation of the home at 272 Camino Buena Vista as a
Class One historic site was issued in accordance with applicable law; and
WHEREAS, on February 8, 2005, the Historic Site Preservation Board conducted a
public hearing in accordance with applicable law to consider designation of the home at
272 Camino Buena Vista as a Class One historic site; and
WHEREAS notice of a public hearing of the City Council of the City of Palm Springs to
consider designation of the home at 272 Camino Buena Vista as a Class One historic
site was issued in accordance with applicable law; and
WHEREAS, on April 6, 2005, the City Council conducted a public hearing in accordance
with applicable law to consider designation of the home at 272 Camino Buena Vista as a
Class One historic site; and
WHEREAS, the designation of the home at 272 Camino Buena Vista shall further the
purpose and intent of Chapter 8.05; and
WHEREAS, the designation of home at 272 Camino Buena Vista shall promote the
sensitive preservation of said site; and
WHEREAS, in accordance with the California Environmental Quality Act (CEQA), the
designation of a historic site is categorically exempt from environmental review pursuant
to Section 15331 for the preservation of historical resources; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the designation, including but not limited to the staff report,
all written and oral testimony presented.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds that the designation of the
home at 272 Camino Buena Vista as a Class One historic site is
categorically exempt from environmental review pursuant to Section
15331 whereby this designation is for the preservation of a historical
resource.
Section 2: The home located at 272 Camino Buena Vista is designated as a Class
One Historic Site pursuant to Chapter 8.05 of the Palm Springs Municipal
Code.
Section 3: No permit for an alteration to the unpainted posts, beams, and exposed
rafters shall be issued as they are considered a defining characteristic of
the home.
Section 4: No permit for the alteration of the carved brackets and door and window
lintels shall be issued as they are considered a defining characteristic of
the home.
Section 5: No permit for the alteration of the multi-paned wood casement windows
shall be issued as they are considered a defining characteristic of the
home.
Section 6: All permitted existing or previously approved alterations are considered
acceptable.
Section 7: All future exterior modifications including but not limited to building, site,
landscaping, lighting, walls, and fences shall require Architectural
Approval pursuant to Section 94.04.00 of the Palm Springs Zoning
Ordinance and Historic Site Preservation Board review.
Section 8: To allow for public viewing of the structure, a public view corridor of the
structure from Camino Buena Vista is required.
Section 9: The property owner shall permit the City to demark the home at 272
Camino Buena Vista as an historic site with a plaque of the City's
choosing. The plaque shall be placed in a location visible from the public
right-of-way. Owner shall maintain the plaque in the location installed and
pay for the replacement cost if the plaque is lost, stolen, or otherwise
removed from the property.
Section 10: This resolution, and the historic designation put in place by it, shall not
affect title to the property.
Section 11: The City Council directs the City Clerk to submit this resolution to the
County recorder for recordation within 90 days of the effective date of this
resolution.

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City
Council designates the home at 272 Camino Buena Vista as a Class One Historic Site.
