A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, ADOPTING INSPECTION
FEES FOR THE IMPLEMENTATION OF THE VACANT
BUILDING MONITORING PROGRAM AND AMENDING
THE COMPREHENSIVE FEE SCHEDULE ADOPTED BY
RESOLUTION NO. 21578 AS AMENDED.
WHEREAS, the City Council enacted Ordinance No. 1746 providing for the
regulation and registration of Vacant and Boarded Buildings; and
WHEREAS, the City Council adopted Resolution No. 22387 establishing a
Vacant Building Problem Resolution Fee; and
WHEREAS, the City, under various statutory provisions under the California
Government Code, may set and collect fees for the cost of providing various public
services to the community; and
WHEREAS, the City Council desires to update and adopt re-designate the
Vacant Building Problem Resolution Fee as the Vacant Building Inspection Fee and
modify the amount of the fee.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. FINDINGS.
a. The current Vacant Building Ordinance calls for a Monitoring Program for
the identification and monitoring the maintenance of all vacant buildings in the City as
provided in Palm Springs Municipal Code Section 8.80.070(C).
b. The implementation of an inspection fee to be paid in conjunction with
periodic inspections of vacant buildings will meet the criteria and intent of Palm Springs
Municipal Code Section 8.80.070(C) and is in substantial compliance thereof.
C. City staff has completed an analysis of the fees for the regulatory
program.
d. There is a reasonable relationship between the amount of the fee and the
estimated reasonable cost of providing the type of service for which the fee is imposed.
e. The fee does not exceed the estimated reasonable cost of providing the
service for which the fee is charged.

SECTION 2. FEES IMPOSED.
a. The City Council adopts and imposes Vacant Building Inspection Fee at
$25.00 per inspection for each vacant single family residence.
b. The City Council adopts and imposes a Vacant Building Inspection Fee at
$100,00 per inspection of multifamily, commercial, or industrial buildings.
G. On July 1" of each year, commencing on July 1, 2011, the fee and charge
shall be automatically adjusted by an amount equal to the percentage of increase or
decrease in the Consumer Price Index for this region, as last computed for the previous
twelve (12) months, to reflect the cost-of-living changes to ensure that changing
economic conditions do not impair the real value of the fees and charges.
d. The Vacant Building Problem Resolution Fee adopted by Resolution No.
22387 is hereby repealed.
SECTION 3. SEVERABILITY.
Each component of the fees and all portions of this Resolution are severable.
Should any individual component of the fee or other provision of this Resolution be
adjudged to as invalid, the remaining provisions shall be fully effective, and the fee shall
be fully effective except as to that portion that has been judged to be invalid.
SECTION 4. EFFECTIVE DATE.
The fees imposed by Sections 2(a) and 2(b) and of this Resolution shall be
immediately effective upon adoption of this Resolution.
SECTION 5. COMPREHENSIVE FEE SCHEDULE.
The City Clerk is hereby authorized and directed to incorporate said
modifications and fees into the Comprehensive Fee Schedule, adopted by Resolution
No. 21578 as amended.
