Subject: APPROVAL OF AGREEMENT WITH TRI-STAR CONTRACTING
FOR BLOW SAND REMOVAL, GENE AUTRY TRAIL, INDIAN
CANYON DRIVE AND VISTA CHINO

SUMMARY:
Award contract services agreement for removal of sand within the rights-of-way of
Gene Autry Trail, Indian Canyon Drive and Vista Chino across the Whitewater
River.
RECOMMENDATION:
1. Approve Minute Order No. approving Agreement No. with
Tri-Star Contracting in the amount of $70,000 for the removal of blow sand
from Gene Autry Trail, Indian Canyon Drive and Vista Chino, City Project
#05-12.
2. Authorize the City Manager to execute all necessary documents.
STAFF ANALYSIS:
The flows in the Whitewater River, due to storms this winter, have resulted in a
loose, uncompacted layer of dirt and sand on the surface of the wash. The recent
winds have resulted in heavier than normal areas of blowing sand and dust in the
Whitewater River, and this has caused the closure of Gene Autry Trail and Indian
Canyon Drive within the Whitewater River crossing, due to lack of visibility and
blowing sand deposited on the roadways. City crews have cleared the roadways
numerous times by pushing the sand off of the asphalt surface. When the wind
blows again, the sand pushed to the upstream portion of the roadway blows back
onto the roadway. In accordance with the Procurement and Contracting Title of the
Municipal Code, staff has requested informal bids from five local contractors to
remove approximately 10,000 cubic yards of sand from within the right-of-way. This
is work that requires more equipment than the city has. Removal of the sand would
provide an area for recurring blowing sand to be deposited, should wind storms
I continue, thereby reducing the amount of times the roadways would need to be
closed.

Staff solicited bids from Tri-Star Contracting, Granite Construction, Contereras
Construction Company, Dateland Construction and G&M Construction. Four of the
five contractors informed staff that they were too busy with other projects to submit
i a bid. Tri-Star Contracting submitted the only bid, with a unit price of$7 per cubic
yard, for a total of $70,000. Staff had estimated a unit cost of $8 per cubic yard.
i Tri-Star Contracting is a licensed contractor from Desert Hot Springs. Tri-Star's
! President is Larry J. Owens.
FISCAL IMPACT:
This project was not budgeted as part of the 2004/2005 Capital Improvement
Program, and is necessary as a result of this winter's storms. However, it is 88.53%
reimbursable from Federal CMAQ PM-10 Funds through the Coachella Valley
Association of Governments. These funds are listed under"post-event cleanup"for
the City of Palm Springs.
