IN THE AMOUNT OF $46,500.00, FOR REVISIONS TO THE PROJCET DESCRIPTION AND EIR ANALYSIS SECTIONS AND FOR MANAGEMENT OF THE TRAFFIC ANALYSIS PEER REVIEW, AS PART OF THE ENVIRONMENTAL IMPACT REPORT, FOR THE DEVELOPMENT OF A 371,000 SQUARE FOOT COMMERCIAL CENTER, LOCATED AT THE NORTH EAST CORNER OF GENE AUTRY TRAIL (STATE HIGHWAY 111) AND RAMON ROAD, ZONE M- 1-P, SECTION 17. jFROM: David H. Ready, City Manager I BY: Department of Planning Services I I I SUMMARY: I Since the EIR contract was originally approved, the project has been revised. These revisions require modification of the EIR scope of work so that the Final EIR that can withstand legal challenges RECOMMENDATION: 1. Approve Minute Order # approving Amendment #2 to Contract Service Agreement No. 4745, with Dudek & Associates, Inc., for an additional amount of $ 46.500.00, for a total contract price of$ 181,625. STAFF ANALYSIS: On July 30, 2003, the City Council approved a contract with Dudek & Associates, Inc, in the amount of $110,775, for the preparation and circulation of an Environmental Impact Report (EIR) for the Springs project. A variety of technical studies were prepared by the applicant, including: traffic/circulation; biological resources; cultural resources, air quality; and site remediation program. On March 23, 2005, the City Council approved a time extension though December 31, 2005 and a contract amendment in the amount of $24,350 to the scope of work to include preparation of a traffic study as part of the EIR contract. Since the EIR contract was originally approved, the project has been revised. These revisions require modification of the EIR project description. Furthermore, these revisions will require additional project analysis in the areas of aesthetics, air quality, geology and soils, hydrology and water quality, noise, land use, public services, utilities and transportation and traffic. The amendment also includes peer review of the traffic study. Riverside County has also adopted a new Airport Land Use Compatibility Plan (ALUCP). The current ALUCP includes restrictions in land use, which may result in incompatibility with the revised project plan, based on revisions to the site plan. These issues will be fully addressed in the EIR. Item No. 2 . 0 . Staff believes that this contract amendment is necessary in order to expedite processing of the project and to develop an EIR that can withstand legal challenges. The work will take approximately twelve weeks to accomplish. All costs associated with this study, including administrative costs, will be paid by the developer. The Disposition and Development Agreement between the Community Redevelopment Agency of the City of Palm Springs (CRA) and Geiger, LLC., the Tentative Parcel Map for finance purposes and the Preliminary Planned Development District are considered a "Project" under the California Environmental Quality Act (Public Resources Code Section 21080(a) and California Code of Regulations Section 15378). CEQA applies to discretionary projects proposed to be carried out or approved by a public agency, which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, both within and beyond the project boundaries. To identify the impacts that the project may have on the environment, an Environmental Impact Report will be prepared to determine how significant the effects are, if any (Section 15060 d, Public Resources Code). CEQA compliance must occur before a public agency approves a project. For public j agency projects, approval does not occur until the agency is legally committed to i proceed with the project. A Request for Proposal (RFP) was circulated on June 3, 2003, to seven environmental j consulting firms, including four local firms. On June 20, 2003, four consulting firm(s) submitted proposals. Dudek & Associates, Inc was selected based on its amount of experience, professional qualifications, ability to complete the project in the time frame outlined in the RFP, and demonstration of clear understanding of the project. I In order to meet both CEQA requirements and the applicant's desired schedule for the approval of the entitlements, the contract service agreement concludes in December 2005, with the City Council taking action on the Environmental Impact Report. Tahquitz Canyon Way Palm Springs, CA 92262 I Subject: Revised Additional Work Request — The Springs Commercial Center Environmental Impact Report I� Dear Alex: Pursuant to our discussion, Dudek and Associates is requesting approval of this additional scope and budget as an amendment to the existing contract for preparation of The Springs Commercial Center FIR. It is our understanding that the existing contract has expired and that Staff will be presenting the contract to the City Council for an extension. As a result of changes in the project and changes in conditions that have occurred since work on the project was suspended, the contract extension will also be accompanied by a contract amendment. It is our assumption that all of the remaining budget in the existing contract will be retained through the contract extension, and that the following scope of work and costs will be added to the contract. In addition to the aforementioned project changes, per you request we are including Endo Engineering as a subconsultant to provide peer review of the revised traffic study. The following provides detail on the scope of work and costs: TASK 1: Revisions to Project Description and EIR Analysis Sections It is our understanding that there will be modifications to the proposed project design that will require changes in the project description and analysis sections of the screencheck FIR previously submitted to the City. It is anticipated that an additional screencheck will be required to resume processing of the project and City staff review. In addition, the revised analysis will examine changed conditions in the project site and local environment to ensure that the FIR adequately assesses existing baseline conditions. A review of planning and regulatory conditions will be included in this task. In particular, the Riverside County Airport Land Use Compatibility Plan update has been adopted since the time of publication of the screencheck FIR.
