CONSENT CALENDAR
Subject: PROPOSED RESOLUTION AUTHORIZING THE ENGINEERING
FIELD TECHNICIAN-DUST INSPECTOR TO ISSUE CITATIONS
AND AMENDING RESOLUTION NO. 12967

SUMMARY:
This authorizes the Engineering Field Technician-Dust Inspector, to issue citations
consistent with the City's PM-10 Dust Control Ordinance (Palm Springs Municipal
Code Section 8.50).
RECOMMENDATION:
Adopt Resolution No. "A Resolution of the City Council of the City of
Palm Springs, California Amending Resolution No. 12967 adding the position of
Engineering Field Technician-Dust Inspector as authorized to issue arrest citations
for misdemeanor violations.
STAFF ANALYSIS:
The Engineering Field Technician-Dust Inspector is responsible for grading
inspection and enforcement of the City's Dust Control Ordinance (Section 8.50 of
the Palm Springs Municipal Code). This ordinance provides for infraction penalties
for the initial and second violations and misdemeanor penalties for the third and
subsequent violations. The City Attorney and Building & Safety Department are
currently working on an Administrative Citation Ordinance which covers the
infraction penalties but when repeat violations occur it may become necessary for
a citation to be issued for the misdemeanor violation. This will avoid the alternative
of finding a police officer who may not be fully aware of the dust control ordinance
and will allow that officer to continue with his normal police duties.

THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING RESOLUTION NO. 12967,
ADDING THE POSITION OF ENGINEERING
FIELD TECHNICIAN-DUST INSPECTOR AS
AUTHORIZED TO ISSUE ARREST
CITATIONS FOR MISDEMEANOR
VIOLATIONS.
WHEREAS, Resolution No. 12967 was adopted on April 18, 1979 by the City
Council of the City of Palm Springs, California; and
WHEREAS, the City Council wishes to amend the section concerning officers
and employees designated to exercise the arrest and citation authority conferred
by Section 1.08.050 of the Palm Springs Municipal Code.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES
HEREBY RESOLVE AS FOLLOWS:
That the following employee of the City of Palm Springs is hereby added to
Resolution No. 12967 to read as follows:
Officer or Employee Misdemeanors
Engineering Field Technician-Dust Inspector All Municipal Codes and the
ordinance provisions as related to
Grading and Dust Control
