BARISTO NEIGHBORHOOD ORGANIZATION March 3, 2010 TO' Mayor Steve Pougiet; Council members Mills,Poat, Hutcheson, Weigel; City Manager David Ready RE: Street asphalt overlay request—Baristo Road for 2010 The Baristo Neighborhood Organization(BN))requests funding and approval of asphalt overlay on Baristo Road between Avenida Caballeros and Sunrise Wa . Boord of Advisors Over the past several years this portion of Baristo Road has been subjected to heavy traffic, David Carden Jr. re-routed buses,heavy-duty construction trucks, delivery trucks and used as a staging area Choir y" 7r D' g g for the construction projects along Sunrise Way for the installation of the storm drains Dean Conkle (2008-09) and now the construction at Tahquitz/Sunrise Way- vice-chair Gayle Wilson The attached photos show the present condition of the road and, as an arterial rreosurer thoroughfare, Baristo should be maintained in better condition to help to minimize further deterioration due to the heavy daily traffic. if traffic is exceeding the speed limit the noise Dan Shenefelt amplifies and is very disturbing. Secretary Claudia Rossi Quality of life—because Baristo Road has hundreds of sunken trenches on both sides of the At-large road the daily autornobile/bus/truck activity causes a loud thumping noise as the vehicles pass through. The noise levels for those residents who live along Baristo Road have been William Squire exacerbated due to the deterioration ofthe road and lack of maintenance by the city. Some At-large residents describe the vibration and noise as going through an earthquake and are George Zander awakened at night! Many cannot use their outdoor patios during the day or night. ANCrge Over 450 households are along this stretch of Baristo Road. Many residents have expressed their concerns and implore the City Council to include this portion of Baristo Road on the `priority list'of the new asphalt overlay project- Signatures gathered on a petition requesting City Council action just since Monday is only a small fraction of the residents/property owners who have expressed concern. In the interim the Baristo Neighborhood Organization has submitted a requestfor `traffic calming'and hopes that project can begin in the next 30-60 days as a step-gap measure. The only solution to this neighborhood problem is to maintain the arterial thorouqhare U resurfacing with an asphalt overlay. Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The Public Works and Engineering Department schedules an asphalt overlay of various City streets. Each year the City budgets funding to overlay a few streets that are too deteriorated to receive a slurry seal treatment. Award of this contract will allow staff to proceed with this annual street maintenance program. RECOMMENDATION: 1) Approve Agreement No. in the amount of $1,234,000.00 with Hardy & Harper, Inc., a California corporation, for Bid Schedules A through E inclusive, for the 2008/2009 & 2009/2010 Annual Overlay, City Project 08-28; and 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The Public Works Department oversees the maintenance of the City's street system. Each year, the Department assembles a capital project to continue its asphalt overlay program on various City streets as needed. The 2008/2009 overlay program, is scheduled to include the following arterial streets: • Indian Canyon Drive (between San Rafael Drive and Vista Chino) Racquet Club Road (between N. Palm Canyon Dr. and Avenida Caballeros) Baristo Road (just east of Farrell Drive adjacent to the AAA building) Overlay of these streets is being funded through the Proposition 1B Local Streets and Roads Funding Program through the state. The 2008/2009 annual overlay was postponed, as the state was delayed in disbursing Proposition 1 B funds to cities due to its budget crisis. However, the City was successful in certifying completion of the 2007/2008 Proposition 113 overlay program and submitting its request for disbursement of 2008/2009 Proposition 1 B funds, which were received in May 2009. The 2009/2010 annual overlay program includes an overlay of the following arterial street. • N. Indian Canyon Dr. (19th Avenue to 20th Avenue —west half) Additionally, this year's annual overlay program includes an overlay of local residential streets. In determining which local residential streets should be included in this year's overlay program, staff uses the City's Pavement Management System program, MicroPaver. MicroPaver is a program used by most Public Works Departments, and it assigns all of the streets in the City by a Pavement Condition Index (PCI) value rated from 0 (worst condition) to 100 (new condition). A street with a PCI value of 60 or less requires an asphalt pavement overlay. On May 7, 2008, the Public Works and Engineering Department presented its Pavement Management System findings to the City Council, summarized in a technical report called: A Comprehensive Report on the Current Condition of City Streets. The report identified the fact that of the City's 18 established Neighborhood Organizations (there are now 25), 8 of these neighborhoods had streets with an overall pavement condition that ranked in the lower one-fourth of all of the individual Sections' of the City. The Pavement Management System is continuously updated each time a street is maintained with a slurry seal or asphalt overlay. The program updates the PCI of the street segments that received a slurry seal or new asphalt overlay, and a new overall PCI value for the Section where those streets are located is calculated. In this way, the report generated by the Pavement Management System is a living document, being kept current with PCI values on an on-going basis. The following Table lists the overall PCI values for the Section of land where each of the 25 Neighborhood Organizations is located, by ranking of the overall PCI value for the Section (worst condition to best condition): 1 A "Section" is a one-mile square area of land, which forms the basic subdivision of public lands in the United States, which is why if you fly across the United States today, you will see below a vast checkerboard, with fields and roads and cities laid out in a precise north-south, east-west arrangement. "Section 14", a common reference to the area of Tribal land in central Palm Springs, is actually identified as Section 14, Township 4 South, Range 4 East, San Bernardino Meridian, and is a one-mile square area of land bounded by Alejo Road to the north, Ramon Road to the south, Indian Canyon Drive to the west, and Sunrise Way to the east. Many streets within a Section, or corresponding neighborhood, have PCI values less than 60, City Council Staff Report March 3, 2010- Page 4 2008/2009 &2009/2010 Annual Overlay (CP 08-28) Staff is recommending an asphalt overlay of those local residential streets with the lowest PCI values less than 60, Unfortunately, there are many local residential streets with PCI values of 60 or less throughout the entire City, and it is necessary to focus each annual overlay within a certain neighborhood to obtain more cost effective overlays by grouping streets within the same neighborhood rather than isolated local streets in multiple neighborhoods. The Las Palmas neighborhoods remain the area with the worst overall PCI value, with 59 separate local street segments that have PCI values less than 60. However, with'the last annual overlay program the City constructed an asphalt overlay on 10 different local street segments within the Las Palmas neighborhoods, and it is staff's recommendation that each year's asphalt overlay program focus on a different neighborhood to ensure equity and fairness in repairing and overlay of local residential streets throughout the City. This year, staff is recommending asphalt overlay of the worst local residential streets within the Sunmor neighborhood located immediately west of City Hall, and the residential area located between Amado Road and Tahquitz Canyon Way, from Sunrise Way to Sunset Way (see Attachment 2 for a listing and map of local residential streets recommended for an asphalt overlay). This area is within Section 13, and has the next lowest overall PCI value as shown in Table 1. Also recommended for an overlay is Paseo El Mirador, from Avenida Caballeros to Paseo De Anza; and an overlay of Hermosa Drive between Mesquite Avenue and S. Riverside Dr. in the Deepwell neighborhood, both of which are in poor condition. The City receives frequent calls from residents requesting repair of these streets, and prior asphalt overlay projects lacked sufficient funds to continue the overlay of Paseo El Mirador, or to include Hermosa Drive. The plans and specifications were prepared by Department staff, and on January 20, 2010, the City Council approved the plans and specifications and authorized construction bidding. On February 4 and 11, 2010, the project was advertised for bids, and at 2:00 p.m. on March 2, 2010, the Procurement and Contracting Division received construction bids from the following contractors: 1. Granite Construction Co., Indio, CA; Bid: $1,499,786 City Council Staff Report March 3, 2010 - Page 5 2008/2009 &200912010 Annual Overlay (CP 08-28) Local Business Preference Compliance Section 7.09.030 of the Palm Springs Municipal Code, "Local Business Preference Program," requires prime contractors to use good faith efforts to sub-contract the supply of materials and equipment to local business enterprises and to sub-contract services to businesses whose work force resides within the Coachella Valley; submission of good faith efforts is required. Of the 9 bids received, 3 are from a prime contractor located within the Coachella Valley, however, the lowest bid is not from a firm located within the Coachella Valley. Generally, the work sub-contracted in this project consisted of 5 trades: cold-milling existing pavement, crack-sealing repairs, pavement fabric, installation of traffic signal detector loops, and traffic striping work (some bidders listed less sub-contracted work, and some listed more). Of the 6 sub-contracted firms listed by the lowest bidder, 1 is a local firm from Thermal (the sub-contracted work is trucking/hauling of asphalt concrete pavement). Only two other bidders (the third and seventh lowest bidders) also listed 1 local firm for sub-contracted work (both listed a local firm from Beaumont for traffic striping work). Six of the 9 bidders did not list a local firm for sub-contracted work, and all 9 bidders indicated sub-contracted work for this project. Given the low bidder's identification of a local firm for sub-contracted work, and the fact that only two other bidder's listed one local firm for sub-contracted work, staff recommends that the City Council determine that the lowest bidder has complied with the Local Business Preference Program, or otherwise waive any informality of compliance with the Local Business Preference Program, and authorize award to the lowest, responsive bid received from Hardy & Harper, Inc. The Engineer's estimate for this project was $1,800,000. The company is a California corporation, and its principal officers are Fred Maas, Jr., President/Treasurer; Dan Maas, CEO; Steve Kirschner, Vice President; and Kristen Paulino, Secretary. FISCAL IMPACT: Funding for this project is made available through Proposition 1 B funds, Transportation Congestion Relief funds, and local Measure A funds in the following accounts: 133- 4298-50225, 133-4298-50276, 134-4498-50225, and 134-4498-50278. No local miscellaneous General Funds are being used for this project. This year, due to the City's receipt of nearly $700,000 in Proposition 1B funds and $400,000 in Transportation Congestion Relief funds from the state, with the City's $500,000 budgeted for the annual overlay program and $300,000 specifically budgeted to overlay N. Indian Canyon Dr. (north of 1-10), the annual overlay project has an overall budget of $1.8 Million which is much higher than normally budgeted. Typically, the City budgets $500,000 for an annual overlay project through local Measure A funds; however, as sales tax receipts continue to decrease, affecting the generation of Measure A funds within Riverside County, the City's local Measure A budget will likewise decrease and limit the ability to appropriately budget more funds for asphalt overlays and other projects.
