Ready, City Manager BY: Department of Parks and Recreation SUMMARY: The City Council will consider adopting a resolution that suspends certain regulatory ordinances, as allowed under City Ordinance No. 1310, for the opening-night festivities of the Palm Springs Power Baseball Team at Palm Springs Stadium on Friday, June 3. RECOMMENDATION: 1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, TEMPORARILY SUSPENDING CERTAIN REGULATORY ORDINANCES TO FACILITATE A FIREWORKS DISPLAY FOR THE OPENING-NIGHT FESTIVITIES OF THE PALM SPRINGS POWER BASEBALL TEAM AT PALM SPRINGS STADIUM ON JUNE 3, 2005." STAFF ANALYSIS: The Palm Springs Power Baseball Team is asking that the City suspend its Noise Ordinance on June 3 to allow for a five-to seven-minute fireworks display to occur at roughly 10:15 p.m. following the opening night game at Palm Springs Stadium. The Palm Springs Power is entering its second year with the City of Palm Springs and would like to make opening night at the stadium a special occasion for the entire community to kick off the new season. Staff has reviewed the proposed event through the Special Events Planning Team and sees no complications with the request. The event producer is proposing to use a reputable firm familiar to the City of Palm Springs to conduct the fireworks show and has agreed to pay all employee support costs associated with producing the event. The Palm Springs Power will supply the City with the appropriate insurance for the event as is normally required for pyrotechnic displays. The promoter has agreed to advertise the fireworks display heavily in all media purchases and work with the City's Public Affairs Director to do specific public service notifications to inform the community of the fireworks display. Palm Springs, CA 92262 Ph (760) 864-6278 • Fax (760) 325-7206 Dear Scott Mikesell, The Palm Springs Power Foundation would like to request to have a fireworks show at Palm Springs Stadium on Friday, June P after the Palm Springs Power Baseball Club Home Opener. The show will be put on by Pyro Spectacular and will start at approximately 10:15 p.m. It will be about five (5) to seven (7) minutes in length. We agree to provide the City of Palm Springs with a copy of our contract with Pyro Spectacular as well as a copy of their insurance to cover the event. We also agree to pay the city any support costs involved and cover any additional insurance needed. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, TEMPORARILY SUSPENDING CERTAIN REGULATORY ORDINANCES TO FACILITATE A FIREWORKS DISPLAY FOR OPENING-NIGHT FESTIVITIES ON THE PALM SPRINGS POWER BASEBALL TEAM AT PALM SPRINGS STADIUM ON JUNE 3, 2005. WHEREAS the City of Palm Springs has a one-year Agreement to Use Facilities with the Palm Springs Power Baseball Foundation; and WHEREAS the City Council desires to facilitate the staging for the opening-night festivities of the Palm Springs Power Beaseball Team; and WHEREAS the City Council finds that certain regulatory ordinances, which are generally deemed desirable and necessary, may, nonetheless, impede the conduct of special events; and WHEREAS the City Council finds that in holding special events, the public interest and the benefits derived therefrom outweigh the temporary public inconvenience; and WHEREAS the City Council has enacted Ordinance #1310 authorizing temporary suspension of regulatory ordinances. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. A. That the opening-night fireworks display by the Palm Springs Power Baseball Team is a special event beneficial to the community and its visitor-oriented economy. B. That the date and time of the five- to seven-minute opening-night fireworks display is Friday, June 3, at 10:15 p.m. C. That Palm Springs Power Baseball Foundation is the event promoter, along with its construction personnel and staff. D. That the venue is Palm Springs Stadium. Section 2. That the following ordinances are hereby temporarily suspended for the special event designated in Section 1 above: Noise Ordinance. Section 3. That the regulatory ordinance designated in Section 2 above shall remain in full force and effect as to the event, date and persons or organizations as designated in Section 1 above.
