HomeMy WebLinkAbout22677 RESOLUTION NO, 22677 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DESIGNATING THE SINGLE FAMILY DWELLING AND SITE AT 982 N. AVENIDA PALMAS AS A CLASS 1 HISTORIC SITE. WHEREAS, in 1929, Rachel de Brabant had a Mediterranean/ Spanish style house constructed at 982 N. Avenida Palmas; and WHEREAS, the defining characteristics of this home are its Mediterranean/ Spanish style, including a rambling and informal floor plan, terracotta barrel roof tiles that have the original fingerprints of the artisans molded into the tiles, wide roof overhangs, stucco walls studded with native rock painted an off-white cream color, casement windows of varying sizes, and period lighting fixtures; and WHEREAS, the home and site plan stand as very good examples of a style of residential architecture typical of the period of Palm Springs' development in the late 1920's; and WHEREAS, Chapter 8.05 of the Palm Springs Municipal Code allows for the designation of historic sites; and WHEREAS, the current property owner, Mark Hilbert, filed an application for Historic Site Designation; and WHEREAS, notice of a public hearing of the Historic Site Preservation Board of the City of Palm Springs to consider designation of the de Brabant / Hilbert house and site as a Class 1 historic site was issued in accordance with applicable law; and WHEREAS, on October 13, 2009 and January 12, 2010, following notification in the prescribed manner, the Historic Site Preservation Board conducted a public hearing in accordance with applicable law to consider designation of the de Brabant / Hilbert house and site as a Class 1 historic site; and WHEREAS, on January 12, 2010, the Historic Site Preservation Board voted to recommend to the City Council that the de Brabant / Hilbert house be designated as a Class 1 historic site; and WHEREAS, the designation of the de Brabant / Hilbert house and site shall further the purpose and intent of Chapter 8.05, and WHEREAS, the designation of the de Brabant / Hilbert house and site shall promote the sensitive preservation of said site; and Resolution No 22677 Page 2 WHEREAS, following notification in the prescribed manner, the City Council conducted a public hearing in accordance with applicable law to consider designation of the de Brabant/ Hilbert house and site as a Class 1 historic site WHEREAS, the City Council has carefully reviewed and considered all of the evidence in connection with the designation, including but not limited to the staff report, application and historical research, all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The de Brabant / Hilbert house reflects or exemplifies a particular period of the national, state or local history, because the buildings reflect the Mediterranean/ Spanish period of development in California in the early 20th century and provide a good example of the architectural style of the time. The rambling floor plan, the informal arrangement of exterior elements (doors, windows, stairway, fireplace, roof line) and the use of stucco, rock, tile and other materials together recreate a stylized domestic environment for relaxed, outdoor living that mirrored the lifestyle of the Californian a century earlier. SECTION 2. The de Brabant / Hilbert house embodies the distinctive characteristics of a type, period or method of construction, because the subject building and site is significant and distinguished property that possesses excellent architectural features common of a Mediterranean/ Spanish house of the 1920's. The presence of terracotta barrel roof tiles that have the original fingerprints of the artisans molded into the tiles, wide roof overhangs, stucco walls studded with native rock painted an off- white cream color, casement windows of varying sizes, and original lighting fixtures are all good examples of the style. SECTION 3. The City Council hereby designates the de Brabant / Hilbert house and associated structures and site, located at 982 N. Avenida Palmas, Palm Springs, California as a Class 1 Historic Site subject to the following conditions; 1. The property owner shall permit the City to place a historic marker of the City's choosing at the site. The marker shall be placed in a location visible from the public right-of-way. The owner shall maintain the marker in the location installed and pay for the replacement cost if the plaque is lost, stolen, or otherwise removed from the property. 2. All future exterior modifications to existing structures and all new structures, including but not limited to buildings, landscape structures, lighting, walls, and fences shall require HSPB review pursuant Municipal Code Ordinance 8.05.180. Resolution No 22677 Page 3 3. No permit shall be issued for the alteration of the exterior, including any and all of the defining elements and characteristics without prior approval by the Historic Site Preservation Board. 4. That the City Clerk submit the Council Resolution to the County recorder for recordation within 90 days of the effective date of this resolution. 5. Any alterations or modifications to the exterior approved prior to the designation of this site by the City Council shall be deemed acceptable. ADOPTED THIS 3RD DAY OF MARCH, 2010. David H.
