SUBJECT: Resolution Requesting CaIPERS Approve Employment Extension for
Retiree Allen Smoot per GCS 21221(h)

SUMMARY
The City of Palm Springs appointed Allen Smoot to the temporary position of
Convention Center Project Administrator, subject to a CaIPERS cap of 960 hours per
calendar year. Mr. Smoot expects to exceed the 960 limitation by the end of September
and estimates an additional 300 hours may be necessary to complete the project.by the
end of the calendar year. The proposed Resolution requests CaIPERS authorization to
extend Mr. Smoot's temporary employment for an additional 300 hours through
December 31, 2005.
RECOMMENDATION:
Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM SPRINGS REQUESTING THE CALPERS BOARD OF ADMINISTRATION
APPROVE AN EMPLOYMENT EXTENSION PER GCS 21221(h) FOR RETIREE
ALLEN SMOOT TO COMPLETE THE PALM SPRINGS CONVENTION CENTER
EXPANSION PROJECT"
STAFF ANALYSIS:
The California Public Employees Retirement System (CaIPERS) generally allows a
retired person to work for a municipality as a temporary employee not to exceed 960
hours in a calendar year. Per GCS 21221(h), the limitation on hours may be extended
under extenuating circumstances if the Municipality seeks approval from CaIPERS via
Resolution prior to the retiree reaching the cap.
Allen Smoot was appointed to a temporary position by the City Council to provide
specialized construction administration for the Convention Center Expansion Project.
Under normal circumstances, the 960 hours would be more than an adequate amount

of time to carry out the construction administration on a project as large as the
Convention Center. However, this year the area received a record amount of rainfall
and the project lost 26 days to rain. In addition, with the worldwide shortage of steel,
the project was further delayed. In order to catch the schedule up, the Project
Administrator had to attend many more meetings and be onsite more often to expedite
decision making in an effort to close the schedule gap. This extra time was deemed
necessary as the completion date of mid-September is a fixed time frame with a client
already contracting for the entire convention center, including all the new space.
Attached for Council consideration is a Resolution in the prescribed CaIPERS format.
Mr. Smoot expects to exceed the 960 hour limitation by the end of September and
estimates that an additional 300 hours may be necessary to complete the project
closeout by the end of the calendar year.
FISCAL IMPACT:
The fiscal impact will be coed by funds already budgeted for in the project.

CITY OF PALM SPRINGS REQUESTING THE
CALPERS BOARD OF ADMINISTRATION
APPROVE AN EMPLOYMENT EXTENSION PER
GCS 21221(h) FOR RETIREE ALLEN SMOOT TO
COMPLETE THE PALM SPRINGS CONVENTION
CENTER EXPANSION PROJECT
WHEREAS, Allen Smoot retired from the City of Palm Springs in the position of
Executive Director of Airports, effective December 31, 2003; and
WHEREAS, the City of Palm springs appointed Allen Smoot to the temporary
position of Convention Center Project Administrator, a position deemed to be of
limited duration and requiring specialized skills, effective January 18, 2004; and
WHEREAS, Allen Smoot is expected to reach his maximum of 960 hours this
calendar year on or about September 30, 2005; and
WHEREAS, due to the unprecedented rainfall this year resulting in 26 days of
delay, and the world-wide shortage of steel which contributed to at least 30
additional days of delay, the project has fallen behind. The Convention Center,
which is vital to the economic well being of the City, has a fixed completion date
of September 26, 2005 to accommodate a National Convention which has
booked the entire expanded facility. To catch up the schedule, Allen Smoot has
been required to work many additional hours to expedite the project. To further
demonstrate the City's concern for a timely completion, Allen Smoot has been
given unprecedented authority to immediately approve change orders on the
project; and
WHEREAS, Allen Smoot has specialized construction management skills not
held by other City employees, which include over 30 years of construction
experience, and the necessary detailed financial negotiating skills to complete a
$34 million project on time and under budget; and
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the CalPERS Board of Administration be requested to approve
an extension for the temporary employment of Allen Smoot for 300 additional
hours through December 31, 2005.
