Ready, City Manager BY: Office of the City Clerk SUMMARY The City has recently made application to the State Department of Parks and Recreation for funds to develop the Tahquitz Creek Master Plan. The approximately $3.5 million dollar project has been submitted for a grant under the "Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006" and its Nature Education Facilities Program. The application is for 100% funding of the project; no local match is required. A draft Council resolution in support of the application is required and provided for Council adoption. RECOMMENDATION: 1. Adopt Resolution No. , "A RESOLUTION OF THE CITY OF PALM SPRINGS APPROVING THE APPLICATION FOR NATURE EDUCATION FACILITY PROGRAM FUNDS (SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006) FISCAL IMPACT: No fiscal impact. wing AP Thomas J. A RESOLUTION OF THE CITY OF PALM SPRINGS APPROVING THE APPLICATION FOR NATURE EDUCATION FACILITY PROGRAM FUNDS (SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006) WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility by the Legislature of the State of California for the administration of the Nature Education Facilities Program, setting up necessary procedures governing the Application; and WHEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications before submission of said application to the State; and WHEREAS, the applicant will enter into a contract with the State of California to complete the Tahquitz Creek Environmental Education Trail Facilities. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby approve the filing of an application for the Tahquitz Creek Environmental Education Trail Facilities; and SECTION 1. Certifies that the City has or will have available, prior to commencement of any work on the project included in this application, the sufficient funds to complete the project should this grant be awarded; and SECTION 2. Certifies that the City has or will have sufficient funds to operate and maintain the project; and SECTION 3. Certifies that the City has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Grant Administration Guide; and SECTION 4. Certifies that this project is consistent with the applicable Palm Springs General Plan and the Tahquitz Creek Trail Master Plan; and SECTION 5. Delegates the authority to the City Manager to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the project; and r, Resolution No. Page 2 SECTION 6. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines. ADOPTED THIS DAY OF JULY, 2010. David H.
