SUBJECT: APPROVE DONATION TO THE POLICE DEPARTMENT OF 22 H & K
MP5 RIFLES AND ASSOCIATED EQUIPMENT FROM THE JACKSON
TOWNSHIP POLICE DEPARTMENT, JACKSON TOWNSHIP, NEW
JERSEY

SUMMARY
The City Council will approve the resolution accepting the donation of 22 H&K MP5
rifles and Associated equipment from the Jackson Township Police Department to the
Police Department.
RECOMMENDATION:
'I. Approve the Resolution No. authorizing the City Manager to accept on
behalf of the Police Department the donation of 22 H & K MP5 rifles and
associated equipment from the Jackson Township Police Department.
STAFF ANALYSIS:
The police department Special Response Team (SRT) members currently use H&K
MP5 rifles in the performance of their duties. The MP-5 is a 9 mm shoulder fired long
gun capable of firing as an automatic or semi-automatic weapon. This is a weapon
utilized with highly trained police officers in tactical situations beyond the capabilities of
a regularly equipped and trained police officers. The department currently has 15 H&K
P✓1P5 rifles and each rifle has a value of $1,000.00 (good used condition). Each rifle is
individually issued to a SRT member (excluding marksmen and negotiators). Each
member of the Special Response Team is required to qualify with these rifles on a
quarterly basis.
Dr. Lawrence Hieskel is a member of the police department's reserve police officers unit
and a member of SRT assigned as the Emergency Medical Doctor. He is also an H&K
MP5 rifle instructor and is recognized as an expert in the training and use of these rifles.Item No. 2 . (�V .
Dr. Hieskel travels throughout the United States presenting classes to police officers
and physicians who are associated with Special Weapons and Tactical teams in the use
of the MP5 rifles and at least once a year he trains at police department training center.
Through his law enforcement agency contacts Dr. Hieskel became aware that the
Jackson Township Police Department in New Jersey were changing from MP5 rifles to
another weapons system. Dr. Hieskel made contact with Det. Vincent Rubio of the
Jackson Township Police Department and negotiated the following agreement:
Dr. Hieskel will donate $10,001.00 to the Jackson Township Police Department. He will
send the money to Eagle Point/T.J. Morris & Sons in Thorofare, New Jersey who is
licensed gun dealer in that state. These funds will purchase 12 new Colt AR 6721 rifles
for the Jackson Township Police Department. Once this purchase has been completed
and the new rifles have been delivered, the Jackson Township Police Department will
donate and ship the 22 MP5 rifles (used, good condition) and associated equipment to
the Palm Springs Police Department. Chief Samuel DePasquale of the Jackson
Township Police Department and Mr. Kevin Starkey City Attorney for the Township of
Jackson, has approved this donation. City Attorney Doug Holland has reviewed the
transaction and has approved it as well.
All of the necessary ATF required firearm forms will be completed prior to the police
department accepting these donated weapons.
The donation of these rifles has the following advantages to the Police Department:
1. There is no cost (except shipping) to the police department for the acquisition of
these rifles.
2. The SRT will have replacement rifles when their present rifles malfunction and
need repair.
3. This provides extra rifles for training purposes.
Dr. Hieskel will be permitted to use his donated rifles while conducting his Tactical
Emergency Medical Operator's Course in Palm Springs. It is anticipated there will be
two courses per year. The course is a week long, the classroom portion will be held at
the Police Department training center, the discharging of the weapons will occur at the
Gun Club range in Thousand Palms. The firearms will be checked out and monitored
by the police department's range master. In addition, appropriate waivers as prescribed
by the city attorney will be obtained by Dr. Hieskel.
FISCAL IMPACT:
The cost of shipping for these 22 rifles is estimated at $550,00. This cost will come from
account # 3010 43200.

WHEREAS the Jackson Township Police Department, Jackson Township, New Jersey
will donate 22 H & K MP5 rifles and associated equipment to the Police Department at
no cost.
WHEREAS the Police Department can use these rifles for the performance of their
duties.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Palm Springs,
that the City Manager be authorized to accept these rifles for use by the Police
Department.
ADOPTED THIS 7th day of September 2005.

jThis letter is pursuant to the telephone conversation between Capt. M. McCabe,Dr. L.
Heiskell of the Palm Springs City Police Department and Det. V. Rubio of the Jackson

Township Police Department. The conversation was relative to the proposed transfer of
I weapons between agencies. The following is the understanding of this agency.

It is proposed that Dr.L. Heiskell will provide a check in the amount of$10008.00
directly to Tom Morris of Eagle Point Guns Thorofare,NJ for twelve(12) Colt AR6721
.223 rifles. P.E.T.paperwork along with a letter of intent to acquire from this agency will
accompany said check to Eagle Point Guns to initiate the process. The Colt AR6721
comes with two 20 round magazines, cleaning kit and sling as standard equipment.

Upon receipt of the Twelve Colt AR6721 rifles, this agency will provide twenty two(22)
H&K MP5's along with fifty(50)magazines and twenty five (25)magazine clamps to
the Palm Springs City Police Department. All items will be shipped UPS next day air
insured.

All "navy"weapons are equipped with"navy' safe/semi/three/full/trigger groups. All
weapons(excluding SD's) are fitted attachment type barrels. All SF weapons are
outfitted with flash suppressors.
All weapons were fitted with H&K new tritium front sight posts (4/01/04)
Weapons bearing serial number's 62-352106, 109, 110, 111 were dedicated range
weapons.
It should be noted that the transfer of these weapons WILL NOT include any type of
trigger or action locking devices.
This process will begin on approximately July 15, 2005, after approval of both the
t Jackson Township Governing Body, as well as the Palm Springs City Governing Body.
