Tahquitz Canyon Way Palm Springs,CA 92262 Subject: PROPOSED AMENDMENT TO CITY HALL CLASS 1 DESIGNATION(HSPB#33) Dear Mr.Mayor, Over a year ago,under the California Public Records Act, we requested a copy of city council Resolution 18907 which designated City Hall, along with other Albert Frey-designed sites,a Class 1 Historic Site. The city's response to our request included an October 2, 1996 planning department memo to the city council. That planning department memo states that: "The recommended Class I designation protects the architectural and historic integrity of the sites in that the structures and their sites may not he modified, nor objects removed, without the approval of the city council..."(emphasis added) Accordingly, we believe Resolution 18907 already clearly and unequivocally protects the sites identified in the resolution. We also believe that the recent misinterpretation of Resolution 18907(i.e.,that the intent of the resolution was to protect the structures only,not the sites) is an anomaly motivated by nothing more than bureaucratic expediency(a view the Planning Commission unanimously concurred with on September 8,2010). Hence, our concern is that should you support the proposed Historic Site Preservation Board recommendation to amend HSPB#33,you will(1)endorse and legitimize the recent misinterpretation of Resolution 18907,and(2) thereby implicitly remove the protections we believe are already afforded to the other five sites protected under the resolution(i.e.,the Frey II House, Valley Tramway Station,Loewy House,Carey-Pirozzi House and the Tramway Gas Station). To put it simply,you will take one step forward and five steps backwards for historic preservation in Palm Springs. For these reasons we ask you not to support the subject amendment.
