Ready, City Manager BY: Owner's Representative SUMMARY The proposed action would result in the sole source purchase and installation of a centralized spray cleaning system for the Animal Care Facility. RECOMMENDATION: 1. Waive the competitive requirements of the Municipal Code pursuant to Section 7.04.020 and award a sole source purchase and installation of a SMT-600- REY Spray Cleaning System, from Spray Master Technologies, a Division of Assembled Products Corporation, of Rogers, Arkansas, in the amount of $71,747.47. 2. Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: One of the most critical issues facing animal shelter operators today is that of the health of the animals they protect. Cleaning with a combination of hot reclaimed water, and chemicals within an enclosed environment can be a very complicated process. The use of reclaimed water was one of the design team's many efforts to incorporate "green" design elements into the project. Any system installed in the structure must be able to withstand the corrosive nature of reclaimed water and be able to support chemical application (including hydrogen peroxide) thru adjustable spray nozzles. In addition, and more importantly, the system must be able provide thermal limit emergency shut down, and be permitted by the State Department of Public Health. The project architect and the owner's representative have conducted thorough research on the various products on the market. This research included contacting large national ITEIV, NO. n�r •--- City Council Staff Report September 22, 2010- Page 2 Sole Source—Animal Shelter Cleaning System equipment manufacturers, such as HydroTec Systems, Spray Master Technologies and Dultmeier, all having some type of experience in central pressure washing at animal shelters. A search of the California Department of Public Health, Department of Drinking Water and Environmental Management web site was conducted. This agency is responsible for issuing permits to operate cleaning systems utilizing reclaimed water in the state. The only reclaimed water spray cleaning system in an animal shelter permitted within the State was found to be in Contra Costa County. This shelter is successfully utilizing the Spray Master Technologies SMT-600-REY Spray Cleaning System. Pursuant to Section 7.04.020 of the Municipal Code, a purchase contract may be awarded by the City Council without competition when the action is made after conducting a good faith review of available sources and it is determined that there is only one source for the item or service. The architect and owner's representative have conducted a comprehensive good faith review, acceptable to the Procurement Manager, of the available cleaning systems specifically for animal shelters utilizing reclaimed water for cleaning on the market today and have determined that the proposed system from Spray Master Technologies is the only suitable system for the animal shelter as it is the only system that has been successfully permitted by the State Health Department to operate with reclaimed water in an animal shelter environment. FISCAL IMPACT: A centralized spray cleaning system has been carried in the Animal Shelter Project budget estimate as owner provided/owner installed equipment. A centralized system has been negotiated with Spray Master Technologies at $71,747.47, proposal attached. Original offerings from the company began in the range of $110,000.
