"RESTRICTED USE OF CERTAIN STREETS"

SUMMARY
The proposed amendment and accompanying resolution would add ten streets to
the Municipal Code Section which prohibits commercial vehicles from using certain
streets. Commercial vehicles over 8 tons will be prohibited from using Sunny
Dunes Road, Calle Palo Fierro, Indian Trail, Vista Oro, Camino Real, Warm Sands
Court, Warm Sands Drive, Grenfall Road, Thornhill Road and Calle Amigos.
RECOMMENDATION:
1) Waive the reading of the Ordinance text in its entirety and introduce by title
only.
2) Introduce on first reading Ordinance No. "ORDINANCE OF THE
CITY OF PALM SPRINGS, CALIFORNIA AMENDING SECTION 12.56.042
OF THE PALM SPRINGS MUNICIPAL CODE, ADDING TEN STREETS TO
THE LIST OF STREETS WHERE COMMERCIAL VEHICLES EXCEEDING
CERTAIN DESIGNATED WEIGHTS ARE PROHIBITED."
STAFF ANALYSIS:
Currently, the PSMC designates six streets whose use is prohibited by commercial
vehicles in excess of 10,000 pounds gross vehicle weight. Those streets are Chino
Canyon Road, Panorama Road, Cielo Drive, Vista Drive, Leonard Road, and
Tuscan Road. Over the past year residents in the area between Sunrise Way and
Palm Canyon Drive south of Ramon Road have expressed increasing concern with
commercial truck traffic traversing through the neighborhood on the local streets
rather than staying on the arterials such as Ramon Road and Sunrise Way.

Citizens have requested the City Manager to sign these local streets such that
commercial truck traffic cannot use them as through routes. This would result in
commercial vehicles staying on Ramon Road, Palm Canyon Drive and Sunrise
Way, unless specific deliveries within the local streets in this area are to be made.
The California Vehicle Code allows cities by ordinance to prohibit the use of a
street by any commercial vehicle exceed maximum gross weight limit, except that
those vehicles are allowed to use all streets for the purpose of making pickups or
delivery of goods from or to buildings located on the restricted street.
In response to this, staff proposed using signs which restrict those local streets for
use by any commercial vehicle over 8 tons. The streets in question are Sunny
Dunes Road, Calle Palo Fierro, Indian Trail, Vista Oro, Camino Real, Warm Sands
Court, Warm Sands Drive, Grenfall Road, Thornhill Road and Calle Amigos. The
signs were placed a trial basis for the last few weeks and appear to have the effect
of significantly reducing large commercial vehicles from using the local streets. The
adoption of the attached resolution will introduce an ordinance which adds the
above mentioned streets to the list of streets within the PSMC wherein commercial
vehicles may not use them.
FISCAL IMPACT:
Posting of signs within this area is estimated to cost between $50041,000, which
could be partially recovered to an unknown extent depending on the level of
enforcement and the amount of citations written in this area.

ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA AMENDING SECTION 12.56.042 OF
THE PALM SPRINGS MUNICIPAL CODE, ADDING
TEN STREETS TO THE LIST OF STREETS WHERE
COMMERCIAL VEHICLES EXCEEDING CERTAIN
DESIGNATED WEIGHTS ARE PROHIBITED.
City Attorney's Summary
The City of Palm Springs prohibits
commercial vehicles from using certain
specified streets. This ordinance adds
ten streets to the list of streets where
such commercial vehicles are prohibited.
The City Council of the City of Palm Springs, California, California Ordains:
SECTION 1. Section 12.56.042 of the Palm Springs Municipal Code be amended
by adding the following table. The following streets are designated as streets
where use is prohibited as to commercial vehicles . The following table applies to
vehicles in excess of eight (8) tons gross vehicle weight:

SECTION 2. The City Clerk is authorized to add the above streets in sequential
order following the streets previously designated by the Council and included in
Section 12.56.042 of the Palm Springs Municipal Code.
SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary
thereof, to be published and posted pursuant to the provisions of law and this
Ordinance shall take effect thirty (30) days after passage.
