Ready, City Manager BY: James Thompson, City Clerk SUMMARY The City Council will consider the recommendation of the ad hoc City Council Subcommittee (Mayor Pro Tern Hutcheson and Councilmember Mills), and consider the appointment of five of the seven members to the Palm Springs Business Improvement District Advisory Board. RECOMMENDATION: 1. Appoint Larry Abel, Area Precinct 1 Representative, to the Palm Springs Business Improvement District Advisory Board. 2. Appoint Larry Bitonti, Area Precinct 2 Representative, to the Palm Springs Business Improvement District Advisory Board. 3. Appoint Tracy Heller, Area Precinct 3 Representative, to the Palm Springs Business Improvement District Advisory Board. 4. Appoint Keith McCormick, Area Precinct 4 Representative, to the Palm Springs Business Improvement District Advisory Board. 5. Appoint Diego Heredia, At-Large Representative, to the Palm Springs Business Improvement District Advisory Board. 6. Continue to solicit and accept applications to fill the remaining two At-Large Representatives. STAFF ANALYSIS: In April, 2010 the City Council adopted Ordinance No. 1770, restructuring the composition and appointment criteria of the Palm Springs Business Improvement ITEM NO. 5.6 City Council Staff Report December 1, 2010-- Page 2 Business Improvement District District Advisory Board, based upon input from stakeholders and business owners within the District. The City Council appoints an Advisory Board consisting of seven (7) members: four (4) members are appointed from four area precincts; and three (3) members are appointed at-large. Members shall own or be employed by a business within the District, and are not required to be bona fide residents and voters of the City. Generally the area precincts are as follows: Precinct 1 — North Palm Canyon Drive, Alejo Road north to Tachevah Drive, and related side streets. Precinct 2 — North Palm Canyon, Alejo Road south to Tahquitz Canyon Way, and related side streets. Precinct 3 — South Palm Canyon, from Tahquitz Canyon Way south to Ramon Road; Belardo and Museum Way from Alejo south to Ramon Road; and related side streets. Precinct 4 — Indian Canyon, Alejo Road south to Ramon Road, and related side streets. Members are volunteers and receive no compensation and will serve a term of three (3) years; however, the initial seven members shall serve staggered terms, as determined by the City Clerk, drawn by lot at the first meeting of the Advisory Board. The Advisory Board is subject to the Brown Act (open meeting laws) and the City's Conflict of Interest Code and shall make recommendations to the City Council on: 1) the expenditure of revenues derived from the levy of assessments; 2) the classification of businesses; 3) boundaries of the District and/or Precincts; and 4) the method and basis of levying assessments. FISCAL IMPACT: None. The City Council did not provide for assessments to businesses within the District for Fiscal Year 2010-11. AMES THOMPSON, CITY CLERK DAVID H.
