GS-0913-01291 FOR NEW TRANSPORTATION SECURITY ADMINISTRATION (TSA) OFFICE SPACE CURRENTLY UNDER CONSTRUCTION, AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A SUBSEQUENT SUPPLEMENTAL LEASE AGREEMENT WHICH WILL ESTABLISH BENEFICIAL OCCUPANCY UNDER THE EXISTING LEASE RATES, CITY AGREEMENT NO. A4582. FROM: David H. Ready, City Manager BY: Department of Aviation SUMMARY Construction is currently underway for new passenger screening lanes and the adjacent TSA office and operational space. Under the proposed amendment TSA will relinquish existing office space back to the Airport shown on the attached exhibits from the previously approved Supplemental Lease Agreement No 2. This transitional effort between the City and TSA is needed to supplement security enhancements related to TSA's operation of the passenger screening lanes and regulatory security mandates. There will be no change to the annual rent and all other terms and conditions of the lease shall remain in force and effect. Beneficial occupancy of the new space will be addressed in a subsequent supplemental lease agreement. RECOMMENDATION: 1. Adopt Minute Order No. approving Supplemental Lease Agreement No. 3 to GSA Lease No. GS-0913-01291 for new TSA office space currently under construction and authorize the City Manager to enter into a subsequent Supplemental Lease Agreement which will establish beneficial occupancy under the existing lease rates, City Agreement No. A4582. 2. City Council Staff Report October 5, 2005 -- Page 2 GSA Supplemental Lease Agreement No. 3 STAFF ANALYSIS: With the construction of new passenger screening lanes, staff has been working with TSA in the development of the new security checkpoint, adjacent office, and operational space which is needed to sustain regulatory security mandates for the processing of passengers at the Palm Springs International Airport. This transitional effort will allow the Airport to recover space currently leased by TSA which may provide future revenue generation opportunities such as additional concession space. Supplemental Lease Agreement No. 3 will allow GSA to relinquish Block A (140 sq.ft.), Block B (572 sq.ft.) and Block C (1080 sq.ft.) upon the completion of the build out of the GSA's new space located at Rooms 304, 305, and 401-407. The relinquished space is attached in the depicted exhibits from Supplemental Lease Agreement No. 2. The new space will be identified as Blocks A, B and C and is depicted in the attached agreement exhibits under Supplemental Lease Agreement No. 3. There will be no change to the annual rent and all other terms and conditions of the lease shall remain in force and effect. As a consequence of the relocation, an additional forty-five (45) square feet will be provided to the government for use at no additional cost until the expiration of the lease term. Beneficial occupancy of the new space will be addressed in a subsequent Supplemental Lease Agreement. It is anticipated that occupancy of the new office space will occur in November 2005. We have received approval from our Fire &Life Safety Office for the proposed construction of the TSA space. I have enclosed three(3) copies of Supplemental Lease Agreement(SLA)No. 3 and exhibits for your signature. Please review, sign and return all copies to our office for execution. Once the Contracting Officer has signed the SLAB,your office may commence the constriction of the government's new space. In addition,please forward a construction schedule to my office. I will need to perform site inspections during various construction phases of the project. Also, there will be a need to schedule a punchlist walk-thin before 100% completion of the construction. Once GSA feels the items have been corrected and the government can take possession, a beneficial occupancy SLA will be submitted to your office for signature. This will memorialize the change in location and government acceptance of the new space.
