Ready, City Manager BY: Department of Parks and Recreation SUMMARY The City Council will consider introduction of an ordinance to amend the requirements that "One member shall be a retail merchant having significant experience in the jewelry business" and "One member shall represent the community-wide tourism industry," as set forth in Item (b) of Section 2.22.020, "Term —Vacancies — Vote," of the Palm Springs Municipal Code. RECOMMENDATION: 1. Waive the reading of the ordinance text in its entirety and read by title only. 2. Introduce on first reading Ordinance No. , "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 2.22.020, ITEM (B), OF THE PALM SPRINGS MUNICIPAL CODE, REGARDING CERTAIN QUALIFICATIONS FOR VILLAGEFEST BOARD MEMBERS. STAFF ANALYSIS: Over the past several months, the VillageFest Board has been reviewing the VillageFest Rules and Regulations for a number of proposed changes to be considered by City Council. This review is intended to update the Rules and Regulations so that they are more consistent with the rules and regulations of similar regional events, allow VillageFest to be more competitive with other events, and create flexibility and clarity for staff, vendors and the board. The complete review of the Rules and Regulations will be coming forward to the City Council in the near future for consideration. As part of this overall rules review, the VillageFest Board felt that the limitations imposed for board member designations, specifically the designation and requirement that one member be a jeweler [Section 2.22.020, item (b)(2) of the Palm Springs Municipal Code], was an unnecessary restriction. DATE: October 5, 2005 SUBJECT: PROPOSED ORDINANCE AMENDING PALM SPRINGS MUNICIPAL CODE SECTION 2.22.020, ITEM (B), REGARDING CERTAIN QUALIFICATIONS FOR VILLAGEFEST BOARD MEMBERS PAGE: Two Board feels this requirement is both limiting and unneeded as all vendors are juried by the collective board prior to participation in VillageFest. Furthermore, all board members are generally required to have extensive retail experience and it is believed that with the right mix of retail merchants, the jewelry component can be properly judged without having to designate a jeweler to the board. The board also believes that this current restriction discourages existing Palm Springs merchants from applying for vacant board positions and removing the restriction will encourage more applicants in the future. With the current vacant position on the VillageFest Board, the board felt it would be a timely action to amend the Palm Springs Municipal Code as proposed at this time. Doing so will allow for a quicker and more open recruitment of the existing vacancy. Also, there is no member of the current board that meets the requirement of a community-wide tourism industry representative, and it is being requested that item (b)(3) of Section 2.22.020 be deleted, a portion of that item be added to item (b)(1), and the word "shall" be changed to "may." This change will also make it less restrictive and encourage more applicants for the board. Therefore, the Palm Springs Municipal Code Section 2.22.020, item (b) will be amended to read in its entirety as follows: (b) Members of the board shall have the following qualifications: (1) All members shall be either current retail merchants or have significant retail experience, or, in the alternative, one member may be a representative of the community-wide tourism industry. At its September 27 meeting, the VillageFest Board voted unanimously (4/0) to recommend that City Council amend Section 2.22.020, Item (b), of the Palm Springs Municipal Code, regarding certain qualifications for Villagefest Board members as stated herein. AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SUBSECTION (b) OF SECTION 2.22.020 OF THE PALM SPRINGS MUNICIPAL CODE, RELATING TO QUALIFICATIONS FOR MEMBERSHIP ON THE VILLAGEFEST BOARD. City Attorney Summary The Municipal Code currently establishes minimum qualifications for membership on the VillageFest Board. The Code specifically requires that: (1) three members of the Board be current retail merchants or possess significant retail experience, (2) one member be a retail merchant with experience in the jewelry business, and (3) one member represent the community wide tourism industry. This ordinance modifies the requirements so that the members are required to be current or experienced retail merchant or, in the alternative, one member may be a representative of the community wide tourism industry. The City Council of the City of Palm Springs ordains: Section 1. Subsection (b) of Section 2.22.020 of the Palm Springs Municipal Code is amended to read: (b) Members of the board shall be either current retail merchants or have significant retail experience, or, in the alternative, one member may be a representative of the community-wide tourism industry. Section 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
