Ready, City Manager BY: Department of Parks and Recreation SUMMARY Periodically,fees require adjustments to maintain market competitiveness and keep pace with the ongoing increases to operating expenses. The proposed fee increases and modified fee structure for VillageFest are expected to accomplish both of these goals. The new fee structure creates both annual and seasonal vendor fees and is expected to increase annual revenues to the VillageFest Fund by as much as 194,000, RECOMMENDATION: 1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, INCREASING USER FEES FOR VILLAGEFEST AND AUTHORIZING THE CITY CLERK TO INCORPORATE SUCH FEES IN THE COMPREHENSIVE FEE SCHEDULE." STAFF ANALYSIS: Over the past several months, the VillageFest Board has been evaluating the revenue and expense reports of VillageFest and believes that revenues need to be increased to allow for growth of the event. In addition to this, the board has been working on a variety of promotional and advertising ideas with the intent of increasing attendance and improving the overall quality of VillageFest. To accomplish these goals and keep pace with the ongoing increase in operating expenses, a newfee structure is being proposed. This new fee structure is expected to increase revenues by creating a standby category and offering existing vendors both annual and seasonal rate packages. Item No. . 1..� . DATE: October 19, 2005 SUBJECT: PROPOSED RESOLUTION INCREASING USER FEES FOR VILLAGEFEST PAGE: Two Staff has performed an internal audit of the various vendor types and their monthly participation in VillageFest. The audit revealed that certain vendors, such as the Farmers Market and perishable food vendors, participate primarily during the winter season while others participate year round. The proposed fee structure creates a more desirable annual rate for all merchandise vendors with the hope that this will extend their participation throughout the year. For those that choose to participate on a seasonal basis, the fees are slightly higher and will enhance revenues. In the new rate structure, clarity has been created in the definitions for nonprofit, political, commercial and sponsor vendors. This clarification is needed because the current fee structure is confusing in this area. Vendors in these categories are typically not of the seasonal variety and, therefore, the fees are based on weekly participation. Additionally, at certain times of the year, many vendor locations remain vacant due to a number of circumstances when vendors do not show up.The new rate structure creates the standby category to counteract this situation. Standby vendors will help reduce the void created by "no show" vendors and enhance the appearance of VillageFest. At its September 27 meeting, the VillageFest Board voted unanimously (4/0) to recommend that increase user fees for Villagefest and authorize the City Clerk to incorporate such fees in the Comprehensive Fee Schedule. FISCAL IMPACT: Finance Director Review: — If the fee structure alone is approved, the "best guess"6stimate is that revenue will increase by $62,000 per calendar year and the standby vendors will increase revenue by an additional $32,000 per calendar year, bringing the total projected increase in revenue to $94,000 per calendar year. WHEREAS, the City, under various statutory provisions under California Government Code, may set and collect fees for the costs of providing a particular service; WHEREAS,the City Council has previously established userfeesforVillageFest; WHEREAS, from time to time, the City Manager has recommended and the City Council desires to approve certain amendments to said user fees; WHEREAS, a duly-noticed public hearing was held in accordance with the provisions of California Government Code; NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY FINDS AND DETERMINES THAT: Section 1: Findings. a. City staff has completed an analysis of fees for VillageFest. b. The current user fees are insufficient to cover all the City's costs and expenses associated with providing the various public services. c. The cost of such services should be borne by those who are the special beneficiaries rather than the citizenry at large. d. There is a reasonable relationship between the amount of the fee and the estimated reasonable cost of providing the type of service for which the fee is imposed. e. The fees do not exceed the estimated reasonable cost of providing the service for which the fee is charged. Section 2. Fees Imposed. a. Each component of the fees and all portions of this Resolution are severable. Should any individual component of the fee or other provision of this Resolution be adjudged to be invalid, the remaining provisions shall be fully effective, and the fee shall be fully effective except as to that portion that has been judged to be invalid. Section 4. Effective Date. Upon adopted of this Resolution, the fees shall become effective on January 1, 2006 and the City Clerk is authorized to incorporate said fees and charges into the Comprehensive Fee Schedule.
