Ready, City Manager BY: Department of Planning Services SUMMARY On September 28, 2005, the Planning Commission voted 7-0 to recommend that the City Council approve Case No. 5.1057 CUP (Nextel Communications) for construction of six commercial communication antennas concealed within a new 60 foot monopole and an equipment shelter on a 1,050 square foot lease area at 19345-65 North Indian Avenue. RECOMMENDATION: 1. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 5.1057 CUP, AN APPLICATION BY NEXTEL COMMUNICATIONS, TO CONSTRUCT SIX COMMERCIAL COMMUNICATION ANTENNAS CONCEALED WITHIN A NEW 60 FOOT MONOPOLE AND AN EQUIPMENT SHELTER ON A 1,050 SQUARE FOOT LEASE AREA AT 19345-65 NORTH INDIAN AVENUE STAFF ANALYSIS: According to Section 94.02.00.A.2, a commercial communications antennae may be permitted when such use is deemed by both the Commission and Council to be essential or desirable for both the public welfare and convenience and in conformity with the General Plan and its objectives. Staff and the Planning Commission found that the project as proposed is in conformity with the General Plan and its objectives and met the requirements of the Zoning Code. Item No. 1 . 1 City Council Staff Report October 19, 2005--Page 2 Nextel Communications at 19345-65 Indian Avenue Public testimony was submitted to the Planning Commission at the hearing by Maureen Mercury, Ph.D. Her concern was the health effects of exposure to low-intensity RF/MW (Radio frequency/Microwave) radiation by the public. According to Barbara Saito, Nextel's representative for this project, no official studies exist showing the effects a cell towers emissions might have on the public's health. According to Section 332(C)(7)(B)(iv) of the Telecommunications Act of 1996, "no State or local government may regulate the placement, construction, and modification of personal wireless facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the FCC's regulations concerning such emissions." Please see the attached Planning Commission staff report for details on the project, photo simulations, site plans and elevations. Planning Staff, the Architectural Review Committee, and the Planning Commission have all reviewed the proposal and recommend approval of this project y by your Council. The International Association of Fire Fighters Division of Occupational Health, Safety and Medicine, in August 2004, has banned cell towers on all Fire Department Stations. The U.S. Environmental Protection Agency stated, in a July 16, 2002 letter, "Federal health and safety agencies have not developed policies concerning risk from long-term, non-thermal exposures. The FCC's exposure guideline is considered protective of effects arising from a thermal mechanism (RF radiation from cell towers is non-thermal) but not from all possible mechanisms. Therefore, the generalization by many that the guidelines protecting human beings from harm by any or all mechanisms is not justified." There exists a body of literature citing epidemiological studies (see the documents submitted for Cases 5..0979 CUP, 5.0980 CUP, and 5.0985 CUP) as to cast doubt on the safety of such cell phone transmission towers. How many megahertz will they be emitting? What is the service radius? Remember when we thought that cigarettes were safe for consumption? Somebody knew they weren't. Remember how long it took for us, the consumers to get the information of their carcinogenic potential? Cigarette companies had that information long before we ever saw it. The same game is afoot here. I urge the Planning Commission to rescind their recommendation that these cases go to the City Council pending a more thorough environmental study that includes how people, not just landscape are affected by these cell towers. Indian Avenue, Zone HC, Section 15; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider Applicant's application for Conditional Use Permit No.5.1057 was given in accordance with applicable law; and WHEREAS, on September 28, 2005, a public hearing on the application for Conditional Use Permit No. 5.1057 was held by the Planning Commission in accordance with applicable law and recommended for approval; and WHEREAS, on October 19, 2005, a public hearing on the application for Conditional Use Permit No. 5.1057 was held by the City Council in accordance with applicable law; and WHEREAS, a Mitigated Negative Declaration of environmental impacts was drafted for this project pursuant to requirements of the California Environmental Quality Act (CEQA) and routed for the required 20-day public review period, which ended September 24, 2005. Although the project could have significant environmental impacts, mitigation measures were incorporated into the project as conditions of approval, and potentially significant impacts were reduced to less than significant levels; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Resolution No. Page 2 SECTION 1. Pursuant to CEQA, the City Council adopt the Mitigated Negative Declaration attached hereto, and incorporate the mitigation measures as conditions of project approval, thus reducing all potentially significant impacts to less than significant levels. SECTION 2. Pursuant to Zoning Ordinance Section 94.02.00, the City Council finds that: a. The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by the City Zoning Ordinance. Pursuant to the Zoning Ordinance, a communications antenna is authorized in the HC Zone pursuant to approval of a Type II Conditional Use Permit. b. The use applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna is in harmony with the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna will not have a significant visual impact on its surrounding because of the block wall surrounding the facility, palm trees screening the pole, and the non-glare surface on the monopole. C. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the communications antennae, a 1,050 square foot lease area at the rear corner of an industrial/warehouse development located at 19345-65 N. Indian Avenue, is adequate in shape and size to accommodate said use, including all features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. Location of and development of the lease area will not affect the functioning of the industrial/warehouse use. d. The site for the proposed use related to streets and highways is properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site for the proposed communications antennae will not have a direct or indirect impact on streets and highways and is properly designed in the subject area. Resolution No. Page 3 e. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards. Indian Avenue October 19, 2005 DRAFT CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the :satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PROJECT SPECIFIC CONDITIONS Administrative 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.1057. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 3. That the property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation sidewalks, bikeways, parkways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner's sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. Cultural Resources 14. Prior to any ground disturbing activity, including clearing and grubbing, installation of utilities, and/or any construction related excavation, an Archaeologist qualified according to the Secretary of the Interior's Standards and Guidelines, shall be employed to survey the area for the presence of cultural resources identifiable on the ground surface. 5. Given that portions of the project area are within an alluvial formation, the possibility of buried resources is increased. A Native American Monitor shall be present during all ground-disturbing activities. a) Experience has shown that there is always a possibility of buried cultural resources in a project area. Given that, a Native American Monitor(s) shall be present during all ground disturbing activities including clearing and grubbing, excavation, burial of utilities, planting of rooted plants, etc. Contact the Agua Caliente Band of Cahuilla Indian Cultural Office for additional information on the use and availability of Cultural Resource Monitors. Should buried cultural deposits be encountered, the Monitor shall contact the Director of Planning Services and after the consultation the Director shall have the authority to halt destructive construction and shall notify a Qualified Archaeologist to investigate and, if necessary, the Qualified Archaeologist shall prepare a treatment plan for submission to the State Historic Preservation Officer and Agua Caliente Cultural Resource Coordinator for approval. b) Two copies of any cultural resource documentation generated in connection with this project, including reports of investigations, record search results and site records/updates shall be forwarded to the Tribal Planning, Building, and Engineering Department and one copy to the City Planning and Zoning Department prior to final inspection. Final Design 6. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for approval by the Department of Planning and Zoning, Department of Public Works, and Department of Parks and Recreation, prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal. All landscaping located within the public right of way or within community facilities districts must be approved by the Public Works Director. 7. The surface of the entire monopole shall be covered in a non-glare coating to the satisfaction of the Department of Planning Services. The non-glare coating shall be clear of any color, and the monopole shall not be painted any color. 8. The block wall surrounding the lease area shall be of a color matching any existing block wall adjacent to the lease area or of a natural sand color to the satisfaction of the Department of Planning Services. 9. No exposed antennas shall be installed on the monopole, only antennas concealed within the pole shall be allowed. 10. Two palm trees of a minimum of 35 feet in height shall be planted within the lease area to best screen the monopole from public view. A water tank shall be installed within the lease area to keep the palm tress in a healthy living condition at all times. General Conditions/Code Requirements 11. The Conditional Use Permit approval shall be valid for a period of two (2) years. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. Once constructed, the conditional use permit, provided all conditions of approval have been complied with, does not have a time limit and runs with the land. 12. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal Code for specific requirements. 13. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance shall be shown and all disturbed areas shall be fully restored or landscaped. 14. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. (Building Department '15. Prior to any construction on-site, all appropriate permits must be secured. Fire '16. Provide one 2-A:10-B:C portable fire extinguisher for every 75' of floor or grade travel distance for normal hazards. 17. Building shall be clearly identified on the exterior. (904.1 CFC) ll8. If the equipment shelter is within 15 feet of an existing building, then the built-in fire protection (i.e. fire sprinklers)for that existing building shall be extended to the proposed shelter. RECOMMENDATION: That the Planning Commission recommend to the City Council approval of Conditional Use Permit No. 5.1057 for the installation of a communication facility to include a 60-foot tall monopole with stacked antennas concealed within the pole, a 230 square foot equipment shelter within a 1,050 square foot lease area at the northwest corner of a light industrial/warehouse building, located at 19345-65 N. Indian Avenue. Nextel's representative is Barbra Saito. The property owner is Dobson & Elliott. BACKGROUND: On June 6, 2005, Nextel Communications submitted an application for a Type II Conditional Use Permit to install a communication facility that will include a 60-foot tall steel monopole with antennas mounted completely within the pole, a 230 square foot equipment shelter, a six foot tall block wall surrounding the perimeter of a 1,050 square foot lease area, 60 square foot concrete emergency generator pad, and two 35-45 foot tall live palm trees. The property is located at 19345-65 N. Indian Avenue,just north of the Highway 10 intersection, and contains light industrial/warehouse buildings with automobile service uses, light manufacturing, and outdoor storage of materials and cars. The lease area will be located in the rear of the property within a fenced area of outdoor storage. The cell tower lease area will not be visible from N. Indian Avenue or Highway 10, only the monopole and live palm trees will be visible. No required parking will be removed to allow this project. The antenna array will be two three-sided antennae structures separated by four feet. All six antennas will be concealed within a 36"cylindrical steel 60-foot tall cell tower. No exposed antennas crfake palm leaves are proposed, as this type of pole will have the least visual impact.Also,two live palm trees at heights of 35 and 45 feet will help to screen the steel pole. Per the recommendations of the Architectural Advisory Committee,Staff has included a condition of approval requiring the pole to be covered with an anti-glare coating and not painted any color. The associated equipment will be housed in a 20'x 11.5'x 10' 1-hourfire rated state approved radio equipment shelter. The equipment shelter will be surrounded and screened by a six-foot tall block wall painted a natural earth tone color. Two 4' wide wrought iron gates will provide access to the shelter and monopole. An irrigation water tank will be included within the block wall lease area for watering of the palm trees. ANALYSIS: The proposed monopole is completely outside any compatibility zones of the Riverside County Airport Land Use Compatibility Plan, and as such, not subject to the requirements of the Plan. The site is surrounded by light industrial/warehouse uses, outdoor storage, and a new FexEx building. Further to the north and northeast are multiple windmills that are taller than the proposed E30'tall monopole. A monopole and cell tower facility is a compatible use with all surrounding uses. The idea of a monopole with no exposed antennas was the match the look of some of the windmill structures. The project went before the Architectural Advisory Committee on August 22, 2005. The AAC approved of the project's design and layout with the following recommendations: the block wall should be painted to match the color of existing block wall at the site or a natural sand color;and the monopole should not be painted any color, but should be coated with a non-glare material. These AAC recommendations have been incorporated into the resolution as conditions of approval. E=NVIRONMENTAL ANALYSIS AND NOTIFICATION: A Mitigated Negative Declaration of environmental impacts was drafted for this project pursuant to requirements of the California Environmental Quality Act(CEQA)and routed for the required 20-day public review period,which ended September 24,2005. No comments were received on this project. Although the project will have significant environmental impacts, mitigation measures were incorporated into the project as conditions of approval, which would reduce potentially significant impacts to a less than significant level. The Planning Commission should recommend that the City Council adopt the Mitigated Negative Declaration of environmental impacts pursuant to CEQA. CONCLUSION: Staff recommends that the Planning Commission recommend to the City Council approval of the Conditional Use Permit No. 5.1057, subject to the conditions set forth in Exhibit A of the resolution. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: _Section 1: Pursuant to CEQA,the Planning Commission recommends that the City Council adopt the Mitigated Negative Declaration attached hereto, and incorporate the mitigation measures as conditions of project approval, thus reducing all potentially significant impacts to less than significant levels. Section 2: Pursuantto Zoning Ordinance Section 94.02.00,the Planning Commission finds that: a. The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by the City Zoning Ordinance. Pursuant to the Zoning Ordinance, a communications antenna is authorized in the HC Zone pursuant to approval of a Type 11 Conditional Use Permit. b. The use applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna is in harmonywith the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna will not have a significant visual impact on its surrounding because of the block wall surrounding the facility, palm trees screening the pole, and the non-glare surface on the monopole. C. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks,walls or fences, landscaping and other features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the communications antennae, a 1,050 square foot lease area at the rear corner of an industrial/warehouse development located at 19345-65 N. Indian Avenue, is adequate in shape and size to accommodate said use, including all features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. Location of and development of the lease area will not affect the functioning of the industrial/warehouse use. d. The site for the proposed use related to streets and highways is properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site forthe proposed communications antennae will not have a direct or indirect impact on streets and highways and is properly designed in the subject area. e. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby recommends approval of Case No. 5.1057 CUP to the City Council, subject to those conditions set forth in the attached Exhibit A. Indian Avenue September 28, 2005 DRAFT CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the ;satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PROJECT SPECIFIC CONDITIONS Administrative 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 2',. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.1057. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 3. That the property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation sidewalks, bikeways, parkways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner's sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. Cultural Resources 14. Prior to any ground disturbing activity, including clearing and grubbing, installation of utilities, and/or any construction related excavation, an Archaeologist qualified according to the Secretary of the Interior's Standards and Guidelines, shall be employed to survey the area for the presence of cultural resources identifiable on the ground surface. 5. Given that portions of the project area are within an alluvial formation, the possibility of buried resources is increased. A Native American Monitor shall be present during all ground-disturbing activities. a) Experience has shown that there is always a possibility of buried cultural resources in a project area. Given that, a Native American Monitor(s) shall be present during all ground disturbing activities including clearing and grubbing, excavation, burial of utilities, planting of rooted plants, etc. Contact the Agua Caliente Band of Cahuilla Indian Cultural Office for additional information on the use and availability of Cultural Resource Monitors. Should buried cultural deposits be encountered, the Monitor shall contact the Director of Planning Services and after the consultation the Director shall have the authority to halt destructive construction and shall notify a Qualified Archaeologist to investigate and, if necessary, the Qualified Archaeologist shall prepare a treatment plan for submission to the State Historic Preservation Officer and Agua Caliente Cultural Resource Coordinator for approval. b) Two copies of any cultural resource documentation generated in connection with this project, including reports of investigations, record search results and site records/updates shall be forwarded to the Tribal Planning, Building, and Engineering Department and one copy to the City Planning and Zoning Department prior to final inspection. Final Design 6. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for approval by the Department of Planning and Zoning, Department of Public Works, and Department of Parks and Recreation, prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal. All landscaping located within the public right of way or within community facilities districts must be approved by the Public Works Director. 7. The surface of the entire monopole shall be covered in a non-glare coating to the satisfaction of the Department of Planning Services. The non-glare coating shall be clear of any color, and the monopole shall not be painted any color. 8. The block wall surrounding the lease area shall be of a color matching any existing block wall adjacent to the lease area or of a natural sand color to the satisfaction of the Department of Planning Services. 9. No exposed antennas shall be installed on the monopole, only antennas concealed within the pole shall be allowed. 10. Two palm trees of a minimum of 35 feet in height shall be planted within the lease area to best screen the monopole from public view. A water tank shall be installed within the lease area to keep the palm tress in a healthy living condition at all times. General Conditions/Code Requirements 11. The Conditional Use Permit approval shall be valid for a period of two (2) years. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. Once constructed, the conditional use permit, provided all conditions of approval have been complied with, does not have a time limit and runs with the land. 12. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal Code for specific requirements. 13. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance shall be shown and all disturbed areas shall be fully restored or landscaped. '14. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. Building Department 15. Prior to any construction on-site, all appropriate permits must be secured. Fire 16. Provide one 2-A:10-B:C portable fire extinguisher for every 75' of floor or grade travel distance for normal hazards. 17. Building shall be clearly identified on the exterior. (904.1 CFC) 18, If the equipment shelter is within 15 feet of an existing building, then the built-in fire protection (i.e. fire sprinklers) for that existing building shall be extended to the proposed shelter. The site and surrounding area are generally flat and do not contain any scenic vistas. This project is not located within a state scenic highway corridor. The site is currently being used for industrial storage. Wind turbines are located north of the project site. Scenic vistas are the distant San Gorgonio and San Jacinto Mountain ranges. Since this is an in-fill project in an existing industrial area, it is not expected to cause any significant impact to scenic vistas. c-d) Less than Significant. This project is located on a paved area with minimal scrub and boulder coverage. Numerous pieces of furniture and assorted garbage have been dumped along the roadways in the vicinity of the site. The site is currently used for industrial storage and has a poor visual quality. The proposed communication facility would be a single monopole that would be aesthetically similar to existing wind turbines located in the project vicinity. A 6-foot brick wall would enclose the proposed project, which would be an aesthetic improvement from the existing chain-link fence that surrounds the property on which the proposed project would be located. There is no nighttime lighting proposed as part of the project. The proposed monopole would extend approximately 60 feet into the skyline. The pole would be covered with a non- glare material to reduce glare from the sun. The pole would be of a color to blend into the skyline and to resemble the existing wind turbines in the project area. The skyline in the project vicinity is already permeated by wind turbine poles, which are significantly taller than the 60-foot monopole proposed. The addition of the proposed monopole would not significantly alter the existing visual character of the project site or project vicinity. This impact is considered less than significant. AGRICULTURE RESOURCES. In determining whether impacts to agricultural resources are significant environmental effects, lead agencies may refer to the California Agricultural Land Evaluation and Site Assessment Model (1997), prepared by the California Department of Conservation as an optional model to use in assessing impacts on agriculture and farmland. Furthermore, no Williamson Act Contracts are located in the immediate vicinity of the project site (Williamson Act Contracts) of the Palm Springs General Plan EIR (Palm Springs, 1992). Therefore, no impacts to Williamson Act Contracts would occur. c) No Impact. The proposed project site is located in an urban area surrounded by an existing industrial park. Implementation of the proposed project would therefore not result in conversion of farmland to non-agricultural uses. There will be no impact to agricultural land. AIR QUALITY. Where available, the significance criteria established by the applicable air quality management or air pollution control district may be relied upon to make the following determinations. The project is within the jurisdiction of the South County Air Quality Management District (SCAQMD). The SCQAMD Governing Board adopted the 2003 Air Quality Management Plan (AQMP) on August 1, 2003. The 2003 AQMP updates the attainment demonstration for federal standards for ozone and PM10; replaces the 1997 attainment demonstration for the federal carbon monoxide (CO) standard and provides a basis for a maintenance plan for CO for the future; and updates the maintenance plan for the federal nitrogen dioxide (NO2) standard that the South Coast Air Basin has met since 1992. The revision of the AQMP points to the urgent need for additional emissions reductions (beyond those incorporated in the 1997199 Plan) from all sources, specifically those under the jurisdiction of the California Air Resources Board and the US EPA which account for approximately 80 percent of the ozone precursor emissions in the Basin (www.aqmd.gov/cigmp/). The project is not anticipated to conflict with or obstruct implementation of 2003 AQMP. There will be no impact. The Federal and California State Ambient Air Quality Standards for important pollutants are summarized in Table 1 and described in detail below. The creation of ozone is a result of complex chemical reactions between hydrocarbons and oxides of nitrogen in the presence of sunshine. Unlike other pollutants, ozone is not released directly into the atmosphere from any sources. The major sources of oxides of nitrogen and reactive hydrocarbons, (mown as ozone precursors,are combustion sources such as factories and automobiles,and evaporation of solvents and I uels. The health effects of ozone are eye irritation and damage to lung tissues. Carbon Monoxide (CO) is a colorless, odorless, toxic gas formed by incomplete combustion of fossil fuels. CO concentrations are generally higher in the winter, when meteorological conditions favor the build-up of directly emitted contaminants CO health warning and emergency episodes occur almost entirely during the winter The most significant source of carbon monoxide is gasoline- powered automobiles, as a result of inefficient fuel usage in internal combustion engines. Various industrial processes also emit carbon monoxide. Nitrogen Oxides(NOx) the primary receptors of ultraviolet light initiating the photochemical reactions to produce smog. Nitric oxide combines with oxygen in the presence of reactive hydrocarbons and sunlight to form nitrogen dioxide and ozone. Oxides of nitrogen are contributors to other air pollution problems including:high levels of fine particulate matter,poor visibility and acid deposition. Sulfur Dioxide (SO2) results from the combustion of high sulfur content fuels Fuel combustion is the major source of 502, while chemical plants, sulfur recovery plants, and metal processing are mmor contributors. Sulfates result from a relation of sulfur dioxide and oxygen in the presence of sunlight S02 levels are generally higher in the winter than in the summer(when sunlight is plentiful and sulfate is more readily formed). Particulate Matter(PMIO and PM2.5) consists of particles in the atmosphere as a by-product of fuel combustion, through abrasion such as tire wear, and through soil erosion by wind. Particulates can also be formed through photochemical reactions in the atmosphere. PM10 refers to finely divided solids or liquids such as soot, dust, and aerosols which are 10 microns of less in diameter and can enter the lungs. Fine particles are those less than 2 5 micrometers in diameter and are also referred to as PM2.5. Lead is found in old paints and coatings,plumbing and a variety of other materials. Once in the bloodstream, lead can cause damage to the brain, nervous system,and other body systems Children are most susceptible to the effects of lead. The South County Air Basin ' and riverside County portion of the Salton Sea Air Basin are in attainment for the federal and State standards for lead The SCQAMD has established significance thresholds for operational and construction- related emissions. Daily and quarterly thresholds are established. Since a project's quarterly emissions are determined by averaging over a 3-month period (including only actual working days), it is possible to not exceed the quarterly thresholds while exceeding the daily thresholds shown in Table 2. The project site is also located within the Salton Sea Air Basin. This basin has been designated as a "severe-17" Ozone non-attainment area due to violations of the federal Nextel Communications Facility Site# CA-7282, Initial Study/Mitigated Negative Declaration September 2005 1.0-10 NEXTEL COMMUNICATIONS FACILITY SITE#CA-7282/INITIAL STUDY/MITIGATED NEGATIVE DECLARATION ambient air quality standards for ozone primarily due to pollutant transport from the South Coast Air Basin. This designation indicates that the attainment date for Federal ozone standards is November 2007 (17 years after the enactment of the Federal Clean Air Act). The project's proposed land use is consistent with the existing City General Plan and Zoning. When adopted in 1993, the City Council adopted a Statement of Overriding Consideration regarding air quality. This statement acknowledges that it is not feasible to reduce City-growth impacts to air quality to a level of insignificance at this time. The project would also be consistent with the South Coast Air Quality Management District CEQA Air Quality Handbook. Construction of the proposed project would result in the disturbance of the site that could generate dust. The project developer will be required to complete a Stormwater Pollution Prevention Plan SWPPP/PM10 Plan that must be prepared and implemented to the satisfaction of the City Building and Safety Department. The Plan must be consistent with the approved AQMD standards intended to minimize health hazards. The site is located within an existing industrial park. No sensitive receptors are located within approximately one mile of the project boundary nor is the creation of objectionable orders expected from the proposed project. The proposed project will have no significant air quality impacts. The proposed project site is located in a developed, industrial area of Palm Springs, and no sensitive habitat occurs onsite. Therefore, the project would not result in impacts to endangered, threatened, or rare species or their habitats. b) No Impact. The site is not identified as having any natural community that could be affected by the project. Therefore, the project would not have an adverse effect on any riparian habitat or other sensitive natural community. c) No Impact. Section 404 of the Clean Water Act regulates the dredge and/or fill of waters and wetlands of the United States, specifically relating to how these activities may cause an adverse effect to, or loss of, federal wetland/water resources. Regulatory responsibility falls under the jurisdictional authority of the U.S. Army Corps of Engineers (ACOE). The site does not contain any wetland areas or waters. Therefore, no impact to federally protected wetlands as defined by Section 404 would occur. d) No Impact. The project site is located within an existing industrial park and is currently paved. It may potentially be used by local wildlife as a corridor between the hills north of the site to areas along the Whitewater River. However, due to the proximity of industrial developments to the east and north, it is logical to assume that wildlife would use areas of less human habitation such as the wind generation parks west of the site as corridors. No impact is anticipated. e) No Impact. The project does not propose any removal or disturbance of sensitive biological resources or landmark trees. Therefore, no conflicts with local policies or ordinances protecting biological resources would occur. f) No Impact. The City of Palm Springs does not have an adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or State habitat conservation plan. Therefore, the project would have no impact on these types of plans. Nextel Communications Facility Site #CA-7282, Initial Study/Mitigated Negative Declaration 1.0-13 September 2005 NEXTEL COMMUNICATIONS FACILITY SITE#CA-7282/INITIAL STUDY/MITIGATED NEGATIVE DECLARATION Less Than Significant Potentially with Less Than Significant Mitigation Significant Impact Incorpmated Impact No Impact 1✓. CULTURAL RESOURCES. The site has been previously graded. As defined in CEQA 15064.5, no significant historic resources exist on this site. The General Plan for the City of Palm Springs indicates there should be no impact to prehistoric archeological resources as a result of this project. The Archeological Research Unit at the University of California, Riverside, conducted a survey in 1993 that included the proposed project site. At that time there were no rock shelters, lithic workshops, milling features or seasonal habitation areas noted within the vicinity of the proposed site. The Agua Caliente Band of Cahuilla Indians utilized a vast territory beyond the bounds of the existing reservation. The possibility of finding human remains does exist in this area. In accordance with Public Resources Code 5.097.94, if human remains are found, the Riverside County Coroner must be notified within 24 hours of the discovery. If the coroner determines that the remains are not recent, the coroner will notify the Native American Heritage Commission in Sacramento to determine the most likely descendent for the area. The designated Native American representative then determines in consultation with the property owner the disposition of the human remains. Due to the proximity of Tribal lands, there is the potential for previously undiscovered cultural resources to be discovered during project construction and site grading activities. Tribal interests in such previously undiscovered resources prescribes the following Conditions of Approval, which shall be incorporated into the entitlement process as mitigation measures. Mitigation 1. An archeologist qualified according to the Secretary of Interior's Guidelines shall perform a record search of the proposed project area, to be conducted prior to the initiation of construction. Nextel Communications Facility Site# CA-7282, Initial Study/Mitigated Negative Declaration September 2005 1.0-14 NEXTEL COMMUNICATIONS FACILITY SITE#CA-7282/INITIAL STUDY/MITIGATED NEGATIVE DECLARATION 2. A Cultural Resources Monitor, designated by the Agua Caliente Cultural Resource Office, shall be present during all ground-disturbing activities. Should buried deposits be encountered, the Cultural Resources Monitor shall have the authority to halt construction and notify a Qualified Archaeologist (Secretary of the Interior's Standards and Guidelines) to prepare a mitigation plan for submission to the City, State Historic Preservation Officer and the Agua Caliente Cultural Resource coordinator for approval and any repatriation of cultural materials be done in cooperation with the Agua Caliente Band of Cahuilla Indians. Implementation of the mitigation measures identified above will reduce potential impacts to cultural resources to less than significant. The majority of Riverside County lies within areas subject to seismic hazards. The subject site lies approximately one mile south of the Banning Fault, Mission Creek Strand. The site is not located within an Alquist- Priolo earthquake hazard zone and there are no known faults crossing the project site. However, the project site, as with virtually all sites within the state, would be vulnerable to ground shaking in the event of an earthquake. The project site and surrounding vicinity are relatively flat, eliminating the potential for landslides. The City of Palm Springs General Plan requires that the project be designed and constructed in accordance with the requirements of the Uniform Building Code (UBC). Adherence to the provisions of the UBC would reduce potential for structural damage in the event of an earthquake. Therefore, a less than significant impact would occur. Nextel Communications Facility Site#CA-7282, Initial Study/Mitigated Negative Declaration September 2005 1.0-16 NEXTEL COMMUNICATIONS FACILITY SITE#CA-7282/INITIAL STUDY/MITIGATED NEGATIVE DECLARATION it Less than significant impact. Any major earthquake damage in the City of Palm Springs is likely to occur from ground shaking and seisrnically related ground and structural failures. Local soil conditions, such as topography, soil strength, thickness, density, water content, and firmness of underlying bedrock affect seismic response. Seismically induced shaking and some damage should be expected to occur but damage should be no more severe in the project area than elsewhere in the region. Therefore, a less than significant impact would occur. iii) No impact. There are no known geological hazards caused by ground failure or liquefaction, which would prevent use of the site. Therefore, no impact would occur. iv) No impact. The ground is level and approval of the project would not expose people or structures to potential landslides.Therefore, no impact would occur. b) Less than significant impact. Existing codes regulate land grading and erosion control if and when construction occurs during winter months (November-March). A Storm Water Prevention Plan (SWPP) is required to be implemented as well. Therefore, a less than significant impact would occur. c-d) No Impact. See items a and b, above. e) No Impact. The proposed project would not generate any wastewater and no septic facilities are proposed as part of the project. Therefore, no impact would occur. The proposed project site is not within the Noise Impact Combining Zone (Palm Springs General Plan 1993).Therefore, no impact would occure g) No Impact. The Plan focuses on operational concepts relative to large- scale disasters, which can pose major threats to life and properly requiring unusual emergency responses. Therefore, no impact is anlicipafed. h) No Impact. Based on the site's location in an urban area, it would not be subject to wildland fire. No impact would occur. Nextel Communications Facility Site# CA-7282, Initial Study/Mitigated Negative Declaration September 2005 1.0-20 NEXTEL COMMUNICATIONS FACILITY SITE#CA-7282/INITIAL STUDY/MITIGATED NEGATIVE DECLARATION b) No Impact. The proposed project does not require potable water. Therefore, no impact would occur. c-d) No Impact. The project would not alter the course of any stream or river, as none are located on-site or in the immediate vicinity of the site.Therefore, no impact would occur. e) No Impact. The proposed project is a single structure that does not create water runoff nor contributes to water runoff since it would be constructed on a paved surface. It also does not produce any polluted runoff therefore, no impact would occur. f) No Impact. No additional impacts to water quality are anticipated. g-h) No Impact. The Federal Emergency Management Agency (FEMA) indicates in the Flood Insurance Rate Map for the project site area, that the site is in Flood Zone B. Flood zone B is defined as an area between limits of a 100-year flood event and a 500-year flood event; or certain areas subject to 100-year flooding with average depths less than one (1) foot or where the contributing drainage area is less than one square mile; or areas protected by levees from the base flood. Because the project site is not located within the 100-year floodplain, flooding impacts associated with the proposed project are not considered significant. i) No Impact. The Palm Springs General Plan Environmental Impact Report does not identify flooding as a result of levee or dam failure as having a potential to expose people or structures to a significant risk of loss injury or death in City of Palm Springs. Therefore, no impact would occur. j) No Impact. The City of Palm Springs is not located in an area subject to seiche, tsunami or mudflow. Therefore, no impact would occur. The proposed communication facility use is not specifically listed as allowable uses in the HC (Highway Commercial) zone, but may be allowed upon authorization by commission decision. The proposed project would seek approval of a CUP from the City of Palm Springs as required for consistency with the Zoning Code. No other land use plans or regulations are applicable to the proposed project site. Therefore, no impact would occur. c:) No Impact. The project would not conflict with an applicable habitat conservation plan or natural community conservation plan. No impact would occur. Green School Facilities Act of 1998, which governs a school district's authority to levy school impact fees, assists in mitigating impacts to schools. California Government Code Sections 65995(h) and 65996(b) note that payments of fees provide full and complete school facilities mitigation. The project does not propose any new residences or other facilities than would affect schools. Therefore, no impact would occur. d) No impact. The project site is located within the boundaries of the Palm Springs Department of Parks and Recreation service area. State law requires each new residential development to dedicate land for park facilities or pay an in-lieu fee to cover the cost of acquiring park land elsewhere. The City uses a dedication formula of 5-acres per 1,000 persons. The amount of population generated by the project does not reach the 1,000-person standard. The project does not include any development or uses that would lead to an increased demand for parks and recreation services. Therefore, no impact would occur. e) No impact. This impact is considered less than significant. c) No impact. The nearest airport is the Palm Springs International Airport, located on Gene Autry Trail. The proposed project is not within the airport land use planning area and would not impact air traffic patterns. Jeppessen (2003) conducted an aeronautical study for Sprint PCS for cell towers in the City of Palm Springs. The study was to determine if proposed structures have any effect on navigable airspace. The study was conducted in accordance with Federal Aviation Regulations, FAR (14 C.F.R. Subchapter E, Part 17) and Part 17 of the Federal Communications Commission, FCC Rules and Regulations (47 C.F.R. Part 17). The current design of the structure at 60 feet would be below the maximum structure height of 75 feet above ground level, and would not require further notice. Therefore, no impact would occur. d-e) No impact. The proposed project would not substantially increase hazards due to a design feature. Emergency access to the project site would comply with the requirements identified by the City Fire Department. The City of Palm Springs contracts with Palm Springs Disposal Services (PSDS) for solid waste collection services. Solid waste generated in the area is disposed of at the Edom Hill landfill or the Coachella landfill. As of the 1993 General plan, these landfills were anticipated to have a remaining life of 30 years and 26 years respectively. The proposed project would not generate a significant quantity of solid waste. Therefore, no impact would occur.
