SUBJECT: REPORT OF EMERGENCY CLEAN UP FROM DIESEL SPILL AT CITY
HALL PURSUANT TO PALM SPRINGS MUNICIPAL CODE SECTION
7.04.040.

SUMMARY
Pursuant to section 7.04.040 (2) of the Municipal Code, the City Manager exercised his
authority to approve the emergency clean up of the diesel spill at City Hall in the amount
of $90,962.36 by Filter Recycling Services Inc. ($88,322.36) and Brickley Environmental
($2,640) that occurred on July 23, 2010 to protect the safety of the city employees and
general public at City Hall. Section 7.04.040 (4) requires that a written report of the
circumstances for emergency purchases in excess of $25,000 be made to the Council
at the next regularly scheduled meeting after the emergency procurement is made.
RECOMMENDATION:

STAFF ANALYSIS:
On Friday, July 23, shortly after 5:00 pm, the City Fire Department responded to an
emergency call for services at City Hall and encountered a diesel fuel spill in a
mechanical room.
The cause of the spill was a faulty filter connection on the fuel line that supplies fuel to
the City Hall's emergency generator. The fuel line was promptly secured. The spill
consisted of approximately 15 gallons of diesel fuel.
Fire Department personnel who are trained hazardous materials First Responders
performed the initial clean-up effort which included spreading absorbent on the spilled

fuel, removing the soaked material from City Hall, and commencing ventilation of the
area with mechanical fans. Monitoring of the air in City Hall also commenced through
the independent services of Olin Safety.
City Hall, which had been closed all day on Friday due to the City's furlough program,
was secure through the weekend.
A comprehensively licensed Environmental Hazardous Materials Response and
Mitigation firm, Environmental Logistics (dba Filter Recycling Services) recommended
by the Riverside County Environmental Health Department was retained Friday evening
and commenced the clean-up on Saturday morning, July 24. All of this work was
performed by fully trained hazardous materials Technicians and Specialists.
On Monday morning, July 26, the Fire Department and the Environmental Haz Mat firm
determined that there was no health risk in City Hall. City Hall opened for business as
usual; however, there were some areas within City Hall where diesel fuel odors were
detectible. All of the City Hall air handlers were cleaned, along with all of the vents and
ducts in the affected areas. The exposed areas were monitored continually through the
first week of September to ensure no risks to employees.
FISCAL IMPACT:
Funds for this emergency repair were available and encumbered from account 540-
5904-48685 & 48622, Claims Expense, and Loss Containment.
