A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, CONDITIONALLY
APPROVING TRACT MAP 34165 FOR PROPERTY
LOCATED AT THE SOUTHEAST CORNER OF AVENDIA
CABALLEROS AND ALEJO ROAD, IN SECTION 14,
TOWNSHIP 4 SOUTH, RANGE 4 EAST, AND APPROVING
A SUBDIVISION IMPROVEMENT AGREEMENT WITH O &
M, LLC,.
WHEREAS, the Planning Commission, at its meeting of March 24, 2010,
recommended approval of Amended Tentative Tract Map 34165, prepared by Alan C.
Hillwig of Hillwig-Goodrow, Inc., representing O & M, LLC, a California Limited Liability
Company, for the above described property; and
WHEREAS, the City Council at its meeting of April 7, 2010, approved Amended
Tentative Tract Map 34165 subject to conditions; and
WHEREAS, the owners offer for dedication to the City of Palm Springs,
easements for public utility purposes with the right of ingress and egress of emergency
vehicles over Lots "A" and "B"; an easement for street and public utility purposes over
Lot "C"; and abutters rights of access to Avenida Caballeros and Alejo Road.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
1. That Final Map 34165 is in substantial conformance with approved Amended
Tentative Tract Map 34165; and
2. That requisite conditions associated with Amended Tentative Tract Map 34165
have been satisfied; and
3. That Final Map 34165 is in conformance with the General Plan; and
4. That Final Map 34165 conforms to all requirements of the Subdivision Map Act of
the State of California; and
5. That all offers of dedication to the public on Final Map 34165 shall be accepted
by the City Clerk of the City of Palm Springs; and
6. That the City Manager, or the City Manager's designee, is hereby authorized to
enter into a Subdivision Improvement Agreement with the subdivider and to
accept subdivision improvement security in conformance with the requirements
therein for construction of required public improvements, in the event the
subdivider does not install and construct the improvements prior to recordation of
the subdivision map, or to enter into such other agreements as the Public Works
Director and the City Attorney determine or necessary or appropriate to ensure
the timely installation and construction of all or a portion of the required
subdivision improvements prior to recordation of the map; and

7. That the City Clerk shall cause to have the final map, and if appropriate the
Subdivision Improvement Agreement or such other agreements as described in
Paragraph 6 of this Resolution, recorded with the Riverside County Recorder
upon the Public Works Director accepting as complete all subdivision
improvements and/or the subdivider providing an executed Subdivision
Improvement Agreement and related security consistent with the requirements of
the Subdivision Map Act and the City's Municipal Code; and
8. That Final Map 34165 is hereby conditionally approved for purposes as herein
defined.
ADOPTED THIS 1ST DAY OF DECEMBER, 2010.

meeting of the City Council of the City of Palm Springs on the Vt day of December,
2010, by the following vote:
AYES: Councilmember Weigel, Mayor Pro Tern Hutcheson, and Mayor Pougnet.
NOES: None.
ABSENT: Councilmember Foat, and Councilmember Mills.
ABSTAIN: None.
