CALIFORNIA, PROCLAIMING THE EXISTENCE OF A
LOCAL EMERGENCY BY THE CITY OF PALM SPRINGS
DIRECTOR OF EMERGENCY SERVICES (CITY
MANAGER).
THE CITY MANAGER AS THE DIRECTOR OF EMERGENCY SERVICES OF
THE CITY OF PALM SPRINGS, CALIFORNIA, HEREBY FINDS AS FOLLOWS:
A. Palm Springs Municipal Code Chapter 2.20 empowers the Director of
Emergency Services (City Manager) to proclaim the existence or threatened existence
of a local emergency when said city is affected or likely to be affected by a public
calamity and the City Council is not in session.
B. That conditions of extreme peril to the safety of persons and property have
arisen within said city, caused by excessive rainfall and prolonged flash flooding
commencing on or about December 17, 2010.
C. That the City Council of the City of Palm Springs is not in session, and
cannot immediately be called into session.
THE CITY MANAGER AS THE DIRECTOR OF EMERGENCY SERVICES OF
THE CITY OF PALM SPRINGS, CALIFORNIA, HEREBY DECLARES AND ORDERS
AS FOLLOWS:
SECTION 1. That a local emergency now exists throughout the City of Palm
Springs, California.
SECTION 2. During the existence of said local emergency the powers, functions
and duties of the emergency organization of the City of Palm Springs shall be those
prescribed by state law, ordinances, and resolutions of the City of Palm Springs, SEMS
and the Multihazard Functional Plan, as approved by the City Council, and the use of
the National Incident Management System (NIMS) approved by City Council Resolution
No. 21683.
THIS DECLARATION OF THE EXISTENCE OF A LOCAL EMERGENCY
ADOPTED AND APPROVED AT 11:30 A.M., THIS 23RD DAY OF DECEMBER 2010.

California, hereby proclaimed the existence of a local emergency pursuant to Palm
Springs Municipal Code Chapter 2.20 at 11:30 a.m., this 23rd day of December 2010.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, RATIFYING ACTIONS OF
THE DIRECTOR OF EMERGENCY SERVICES,
PURSUANT TO PALM SPRINGS MUNICIPAL CODE
SECTION 2.20, RELATING TO THE DECEMBER 2010,
WINTER STORM "STORM".
WHEREAS, preparations for the December 2010 Winter Storm began December
17, 2010; and
WHEREAS, a condition of extreme peril of life and property existed in the City of
Palm Springs due to the heavy rain and flooding created by the "STORM"; and
WHEREAS, Araby Road at the Palm Canyon Wash was destroyed due to the
"STORM"; and
WHEREAS, major debris removal was required at Indian Canyon, Gene Autry,
and Vista Chino due to the "STORM"; and
WHEREAS, removal of debris on Golf Club Drive was required due to the
"STORM"; and
WHEREAS, many roads were damaged and closed due to the "STORM"; and
WHEREAS, the cost due to "STORM" damages is estimated to be $302,000; and
WHEREAS, pursuant to Palm Springs Municipal Code Section 2.20, the Director
of Emergency Services, City Manager David H. Ready, proclaimed the existence of a
"Local Emergency" at 11:30 a.m. on December 23, 2010; and
WHEREAS, pursuant to Palm Springs Municipal Code Section 7.04.040, the City
Manager may authorize the procurement of emergency supplies and services when
there is a threat to public health, welfare, and safety; and
WHEREAS, on December 23, 2010, the City Manager awarded a contract to
Granite Construction in the amount of$52,000 for the emergency debris clearance.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The City Council ratifies the actions of the Director of Emergency
Services, City Manager David H. Ready, proclaiming the existence of a "Local
Emergency" at 11:30 a.m. on December 23, 2010.

Section 2. The City Council confirms the City Manager's action awarding a contract
to Granite Construction in the amount of$52,000 for the emergency debris clearance.
Section 3. David Barakian, Director of Public Works, is hereby designated as the
authorized representative of the City of Palm Springs for the purpose of receipt,
processing, and coordination of all inquires and requirements necessary to obtain
available state and federal assistance.
