SUMMARY
The appellant and applicant, Solar Power Inc, has filed an appeal of a decision of the
Planning Commission seeking relief from the imposition of the public arts fees on their
Conditional Use Permit (CUP) for a 4.96 Megawatt solar power generating facility. The public
arts fee was imposed pursuant to Municipal Code Chapter 3.37. The applicant is seeking
either full relief from the fee, or adjustment in the methodology of calculating valuation of
solar energy production facilities similar to the schedule used for wind energy production
facilities. A public hearing is required.
RECOMMENDATION:
Deny the appeal and uphold the decision of the Planning Commission. The Council may also
direct staff to return with a proposed policy for public art fees that would treat solar energy
production facilities similarly to wind energy production facilities.
BACKGROUND:
Municipal Code Chapter 3.37 establishes the public art fee, fund and program. As stated in
Section 3.37.010, "The purpose of the Palm Springs public arts program is to develop and
maintain a visual arts program for the residents and visitors of Palm Springs, to add to the
economic viability of the community, and to enhance the environment and unique character
of Palm Springs by providing for the acquisition and maintenance of quality works of public
art." Section 3.37.050 establishes that the payment of public art fees shall apply "...to all

works of construction and rehabilitation for which a building permit is required, including but
not limed to new commercial and industrial construction..."
Pursuant to Section 3.37.070, for commercial and industrial projects, fees for public art are
collected at a rate of one-half of one percent (0.5%) of the valuation of the building. For
projects in which there are structures, but no habitable buildings, such as solar power
generating facilities, the "valuation of the building" is deemed equivalent to "the cost of
construction". The exception to this is wind energy generating facilities. Valuation for
purposes of establishing building permit fees and other related fees for wind energy
generating facilities is based on kilowatts of energy produced, not cost of construction.
RELATED PRIOR ACTIONS:
On March 9, 2011, the Planning Commission voted 4-0-0-2 (Caffery, Hudson, abstained) to
approve Case 5.1253 CUP / 6.524 VAR; a Conditional Use Permit and Variance for
installation of a 4.96 Megawatt solar energy production facility.
On March 11, 2011 Solar Power Inc., filed a letter of appeal seeking relief from the imposition
of public art fees on solar energy production facilities. Solar Power Inc. submitted a
supplemental letter on March 18, 2011 proposing an alternative for the Council's
consideration on their appeal request (both letters attached).
ANALYSIS:
The imposition of public art fees on all projects for which a building permit is applicable
establishes a consistent means for generating funds for the purchase and maintenance of
public art. These fees, as well as building permit fees, are based on the building valuation.
As a means of encouraging development of "clean" alternative energy generating facilities
within the City, an alternative methodology for determining "value" was established in the
City's Comprehensive Fee Schedule in 1994 for large scale wind energy generating facilities
based on kilowatts of energy produced, instead of cost of construction. (see attached 1994
staff report and resolution).
The appellant has requested elimination of Condition of Approval ADM 9 and waiver of the
Public Art Fee requirement. The appellant has cited this fee as "...an extraordinary burden
and disincentive to clean renewable energy projects..." Alternatively, the appellant proposes
a more reasonable method of imposing public arts fees on solar energy production projects
would be "...to establish an approach for valuation of solar projects that is consistent with the
Wind Energy Conversion Systems."
Construction costs vary for solar power generating fields, but for purposes of this analysis,
they are assumed at $4 million per megawatt of power production. Thus, this project at

roughly five megawatts, would have a construction cost of roughly $20 million. At a rate of
0.50% on the cost of construction the applicant would be assessed a public arts fee of
roughly $100,000. Alternatively, using the wind energy valuation table, a five megawatt
project would be assessed roughly $243 in public arts fees plus a modest additional amount
for the valuation of the electrical equipment (transformers, inverters, etc.).
Section 3.37.070 of the Municipal Codes provides the following for consideration of waiver of
the requirements of public arts fees:
"Nothing herein shall restrict the city council from waiving the requirements of this
chapter, in whole or in part, with respect to any project otherwise subject to the
provisions of this chapter, provided that the city council determines that the
project applicant has entered into an agreement with the city providing for the
applicant's acquisition and installation of artwork in connection with the
development of the project which addresses the goals and aims of this chapter in
a manner equally or more favorable to the city than would be achieved by strict
compliance with this chapter. In such an event, the city council shall make
findings to this effect on the basis of substantial evidence.
Such conditions are not present, and thus staff is unable to make a recommendation in
support of the waiver of the public arts fees. Further, staff recommends that an adjustment to
the public art fee for solar power generating facilities should apply to all large scale solar
facilities, rather than exempting one request at a time
FISCAL IMPACT: The elimination or reduction of fees assessed to solar power generating
facilities for public art will reduce the amount of such fees collected for the purpose of
purchase and maintenance of public art. .

Dear Mr.Thompson:
The purpose of this letter is to request an appeal to the Palm Springs City Council regarding the
matter referenced above which was approved by the Planning Commission on March 9, 2011 by
unanimous vote. While we are very pleased to be able to move forward with this project,we believe
there is a necessity to appeal one of the conditions of approval. Our request is specifically to address
the appropriateness of a condition of approval item listed as ADM#9 in Exhibit"A"of the draft
Resolution imposing the requirement to either provide public art or pay the in lieu Public Art Fee at the
rate of%% based upon the total building permit valuation as calculated pursuant to the valuation table
in the Uniform Building Code.
Solar Power, Inc.views this fee as an extraordinary burden and a disincentive to clean
renewable energy projects that fulfill California's goal and mandate to achieve 30%clean energy by the
major utility companies. This is not an impact fee that mitigates or offsets necessary services or
infrastructure costs.
Solar Power, Inc. respectfully requests the elimination of the ADM#9 condition of approval and
waiver of the Public Art Fee requirement. Please contact the undersigned with any questions or to
advise regarding the schedule of possible City Council hearing dates. Enclosed is check number 006513
in the amount of$982.18 made payable to the City of Palm Springs to cover the appeal request and

Please let this letter serve as a supplement to my prior letter to you of March 11,2011 requesting an
appeal to the Palm Springs City Council specifically regarding the condition of approval item listed as ADM#9
in Exhibit"A"of the draft Resolution for the CUP referenced above. I would like to propose an alternative for
the Council's consideration that would address the manner in which the imposition of the condition and the
Public Art Fee might be applied to our project.
Currently,the Building Department provides a building valuation fee schedule for(WECS)Wind
Energy Conversion Systems based on kW produced. Solar facilities are not referenced in the building
valuation table,however,the Council may wish to adopt an approach to the Public Art Fee for solar projects
that is consistent with the Wind Energy Conversion Systems.

STRUCTURAL BUILDING PERMIT FEES - WIND ENERGY CONVERSION SYSTEMS
RECOMMENDATION:
It is recommended that the City council amend the comprehensive fee
schedule to provide a basis for determining Wind Energy Conversion
Systems (WECS) building permit fees.
BACKGROUND:
A significant portion of the area currently being proposed for
annexation to the City is utilized for the generation of electrical
energy by Wind Energy Conversion Systems. The comprehensive fee
schedule currently contains no provision for determining building
permit fees for these types of structures.
The system currently used for determining the cost of structural
building permits is based on the value of the finished building or
structure. Since Wind Energy Conversion Systems are somewhat
unique in that they are not directly comparable to buildings and
other types of structures for which building permits are issued, a
specialized system for determining a basis for permit cost is
recommended.
The County of Riverside has developed and is currently using a
system for determining the value of the work done to install a WECS
system which is based on the kilowatt output of the wind turbine
being installed. Although the use of the County system results in
lower permit costs than the City's current fee system, the
Department of Planning and Building feels that the County system
more accurately reflects the cost of providing permit related
services.
Permit costs for site grading, electrical and mechanical work, etc.
would be determined in the normal manner.

Comprehensive Fee Schedule for use when the wind energy areas are

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will
hold a public hearing at its meeting of April 6, 2011. The City Council meeting begins at 6:00
p.m., in the Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of this hearing is to consider an appeal of a Planning Commission decision
regarding the imposition of Public Arts Fees on a Conditional Use Permit (CUP) and a Variance
(VAR) application by Solar Power Inc. for a 4.96 megawatt solar energy conversion system
installation. The project is located on 24 acres of an approximately 98 acre parcel at the
southeast corner of 19th Avenue and Karen Avenue, Zone E-I (Energy Industrial). The appellant
is seeking removal of the imposition of the Public Arts Fees.
ENVIRONMENTAL DETERMINATION: An environmental assessment has been prepared
under the guidelines of the California Environmental Quality Act (CEQA) and a Mitigated
Negative Declaration has been proposed on the CUP.
REVIEW OF PROJECT INFORMATION: The staff report and other supporting documents
regarding this project are also available for public review at City Hall between the hours of 8:00
a.m. to 11:00 a.m. and 2 p.m. to 6:00 p.m. Monday through Thursday. Please contact the Office

Our office is in receipt of an appeal to the City Council from Solar Power, Inc.
In accordance to Palm Springs Municipal Code Section 2,05.050, the appeal shall be heard by the
City Council within 45-days after the appeal is filed. Friday, April 29, 2011, is the 45th day from
today; therefore, it is recommended that the hearing be scheduled for April 20, 2011, unless the
appellant consents to a later date.
2.05.050 Time of hearing--Notice. (a) The city
clerk, upon receipt of the notice of appeal, shall set a time
and place for the hearing of such appeal by the council.
The appeal shall be heard no more than forty-five days
following the filing of the notice of appeal unless the
parties waive such time limits. (b) Notice of the time
and place of the hearing shall be mailed or otherwise
delivered by the city clerk to the appellant, respondent
and all other persons, if any, to whom notice of the initial
application or action was required, not less than ten days
prior to hearing. If publication of the initial application or
action being appealed was required, the notice of appeal
shall be published in like manner. (Ord. 1233 § 1, 1985:
Ord. 1226 § 1 (part), 1984)
