A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, SURRENDERING THE
PERMIT FOR THE COACHELLA VALLEY FRINGE-TOED
LIZARD HABITAT CONSERVATION PLAN AND
REPEALING THE FRINGE-TOED LIZARD MITIGATION
FEE.
The City Council of the City of Palm Springs finds:
A. The Coachella Valley fringe-toed lizard (Uma inornata) is a species listed as
"threatened" under the Federal Endangered Species Act of 1973.
B. The Coachella Valley fringe-toed lizard (Uma inornata) is a species listed as
"endangered" under the California Endangered Species Act.
C. A habitat conservation plan developed for the Coachella Valley fringe-toed lizard
received a federal permit (PRT-698685) ["Permit"] in 1986.
D. The City of Palm Springs was a signatory to the implementing Agreement for the
Coachella Valley Fringe-toed Lizard Habitat Conservation Plan ["FTL Plan"] and has
faithfully executed all of its obligations under the agreement and the plan.
E. The Coachella Valley fringe-toed lizard is covered under the Coachella Valley
Multiple Species Habitat Conservation Plan / Natural Community Conservation Plan
["MSHCP"].
F. The MSHCP provides superior biological protection of the Coachella Valley
fringe-toed lizard and its habitat.
G. The City of Palm Springs approved the MSHCP and thereby adopted a
comprehensive plan that provides protection to the fringe-toed lizard and its habitat in a
manner equal to or greater than the FTL Plan.
H. The MSHCP has been reviewed and permitted by the United States Fish and
Wildlife Services and the California Department of Fish and Game as an acceptable
conservation plan for the fringe-toed lizard and its habitat.
I. Maintaining the Permit and the FTL Plan would be redundant under the MSHCP.

The City Council of the City of Palm Springs resolves:
1. The City of Palm Springs approves the surrender of the Permit for the Coachella
Valley Fringe-toed Lizard Habitat Conservation Plan.
2. The Fringe-toed lizard mitigation fee, as set forth in the City's Comprehensive
Fee Schedule adopted by Resolution No. 21578 is repealed.

AYES: Councilmember Foat, Councilmember Hutcheson, Councilmember Mills,
and Mayor Pro Tern Weigel.
NOES: None.
ABSENT: Mayor Pougnet.
