December 7, 2005 Presented to the City Council of the City of Palm Springs RE: Undergrounding District West Side of Sunrise Way John Bush 801 S. Sunrise Way Palm Springs, Ca 92264 1. California Public Utilities Commission Rule 20A provides in whole or part: a. Prior to forming a utility district an election of the Property Owners resulting in majority endorsement of 60%to form such an assessment district. In addition, city council must also approve the district, but only by a simple majority. b. Council will inform property who are elderly, retired or indigent property that fiind ng assistance may be made available to them to offset their required participation. These funds may directly come from city funds, charitable or philanthropic sourse. The council must consider this element into their planning for any such improvement district. c. Properties not currently proposed for the utility district which are served directly by the offending surface transmission lines but not listed in the proposed must be reviewed and may also be included in the utility district. d. The PUC provides that the sponsoring utility companies determine if the "subject properties" are served directly by the utilities poles which are to be undergrounded. If a proposed utility district has included properties which are not served by those utility poles then those property owners may opt out of participation in that utility district. e. Visual inspection will confirm that many if not all properties in the proposed district are not serviced fiom transmission poles proposed to be undergrounded. f Upon proper investigation the sponsoring utilities will determine that the properties on the EAST side of Sunrise are directly served by those utilities poles. The properties on the East of Sunrise should be at least included or the district switched over in its entirety to the East side of Sunrise Way. II. State of California Environmental Protection Laws & Traffic Codes provide: 1 / z -; 1a e _ a. Prior to the setting contracts an environmental survey must be provided to insure that the subject property owners and the public will not suffer from damage or loss to the value of their properties. i. Noise abatement evaluations prior to and preceding the placement of undergrounding vaults must be preformed. This is to ensure that property owner's values are not decreased by the placement of such construction, through a greater conduction of vibration and noise into the properties nearest the vaults. ii. Palm Springs Traffic Department must show specifics: studies, surveys and state reporting records of how it is following California Law and City ordinances in limiting the current traffic to that which is lawful under the `Residential Collector' status assigned to Sunrise Way, by the master city plan. This will strengthen proponent's justification that indeed this plan is necessary as "the traffic corridor is burdened with sufficient traffic to warrant the undergrounding". However,they need also demonstrate that they are following; signing requirements to limit through commercial traffic along this route. iii. City Traffic Department must also determine the replacement style of streetlights (with numbers no greater than currently in place). Hopefully, moving those lights to the East Side of Sunrise so that their proximity is further decrease properties detraction of light pollution. III. Competent stewardship of planning the costs of an Undergrounding Project. a. There are many law court contests which have accompanied Utility Assessment Projects in the State of California: b. The major reason for those suits has been ineffectual planning on the part of the respective city councils. c. One single element stands out as the subject of these poor planning conditions: who is going to pay for the replacement of the roadways, sidewalks and driveways which are demolished in the process of undergrounding. d. Under Rule 20A replacement is the responsibility to the individual property owners, however if the estimated restoration of these items in included in the assessment district the difficulties of one property suffering huge damage, while another group does not; unequal justice is avoided. Holding of the public hearing and approving the resolutions will establish the districts. All affected Palm Springs property owners within the two districts have been notified in writing about this public hearing. RECOMMENDATION: 1) Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA ESTABLISHING A RULE 20A UTILITY UNDERGROUNDING DISTRICT ON THE WEST SIDE OF SUNRISE WAY FROM EAST PALM CANYON DRIVE TO SUNNY DUNES ROAD." 2) Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA ESTABLISHING A RULE 20A UTILITY UNDERGROUNDING DISTRICT ON THE EAST SIDE OF SUNRISE WAY FROM VISTA CHINO TO SAN RAFAEL DRIVE." Item No. City Council Staff Report December 7, 2005-Page 2 Resolution of Intention for Rule 20A Utility Underorounding Districts STAFF ANALYSIS: On November 16, 2005, City Council approved two resolutions of intention to conduct public hearings for both Rule 20A utility undergrounding districts on Sunrise Way. Written notices were mailed to all property owners along Sunrise Way within the limits of the two districts, as authorized by said resolutions of intention. Attached for City Council's consideration are the two resolutions which would form the districts, the staff report and resolution of intention passed on November 16, 2005, maps and legal description for each proposed district and the cost estimate for each proposed district. Using Rule 20A funds for these two districts will "mortgage" the City's Rule 20A monies for a period of approximately five years, meaning that for five years subsequent to this project the City will not have a positive balance of Rule 20A funds. Another Rule 20A undergrounding project will not be possible for a minimum of five years. Should Council pass these resolutions forming Rule 20A districts, staff will begin the process of calling covenants from the property owners within these two districts. These covenants provide that those property owners are responsible for their fair share of the costs of the utility undergrounding across the 'Frontage of their respective properties. Covenants exist for one property totaling 100 front feet along the portion of Sunrise Way from East Palm Canyon to Sunny Dunes Road, and along sixteen properties totaling 1,324 feet along the portion of Sunrise Way from Vista Chino to San Rafael Drive. There will be no cost to the remaining 53 properties. FISCAL IMPACT: Finance Director Revie All construction costs are being paid by SCE and reimbursed fro ule 20A allocations, except for property owner contributions as required by covenant a no local general funds are required for the work. WHEREAS, by Resolution No. 21461 a public hearing was called for December 7, 2005 at 6:00 p.m. at City Council Chamber in City Hall located at 3200 East Tahquitz Canyon Way, Palm Springs, California to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service in the area on the west side of Sunrise Way From East Palm Canyon Drive to Sunny Dunes Road; and WHEREAS, a notice of such hearing has been given to all affected property owners as shown on the last equalized assessment role and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons have been given an opportunity to be heard. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. THE CITY COUNCIL FINDS AND DETERMINES that the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service for the west side of Sunrise Way from (East Palm Canyon Drive to Sunny Dunes Road as depicted on attached District Boundary Map, the boundaries of which are described on the attached legal description. Both of which are hereby referred to and made a part of as fully as if it were set out at length herein. Section 2. City Council further finds that; a)the street right-of-way is extensively used by the general public and carries a heavy volume of vehicular traffic and b) the street is considered a major thoroughfare on the City's General Plan. Section 3. That service laterals shall be financed through the Rule 20A Underground Utility District Funds and that Staff is directed to begin the process of calling all existing covenants for utility undergrounding currently recorded against properties within this proposed District. That all poles, overhead wires and associated structures shall be removed and underground installations made in said underground utility district within the following times; 1)underground installation by utility companies and reconnections not later than December 2007. 2) removal of poles, overhead wires and other associated structures not later than December 2008. Section 5. DEFINITIONS; Whenever in this Resolution the words or phrases hereinafter in this section defined are used, they shall have the respective meaning assigned to them in the following definitions: a) "Commission" shall mean the Public Utilities Commission of the State of California b) "Underground Utility District'or"District'shall mean that area in the City within which poles, overhead wires, and associated overhead structures are prohibited pursuant to the provisions of this Resolution. c) "Person"shall mean and include individuals,firms, corporations, partnerships, and their agents and employees. d) `Poles,overhead wires and associated overhead structures"shall mean poles, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers,insulators,cutouts,switches,communication circuits,appliances, attachments and appurtenances located above-ground within a district and used or useful in supplying electric, communication or similar associated service. e) "Utility" shall include all persons or entities supplying electric, communication or similar associated service by means of electrical materials or devices. f) "Non-Utility"shall include all persons orentities supplying communication,T.V. cable or similar associated service by means of cable materials or devices. Section 6. UNLAWFUL ACTS, Whenever the Council creates an Underground Utility District and orders the removal of poles, overhead wires and associated overhead structures, it shall be unlawful for any person or utility or erect, construct, place, keep, maintain, continue, employ or operate poles, overhead wires and associated overhead structures in the District after the date when said overhead facilities are required to be removed by such Resolution. EXCEPTION, EMERGENCY OR UNUSUAL CIRCUMSTANCES, Notwithstanding the provisions of this Resolution, overhead facilities may be installed and maintained for a period not to exceed ten (10) days, without authority of the City Engineer in order to provide emergency service. The City Engineer may grant special permission, on such terms as the City Engineer may deem appropriate, in cases of unusual circumstances,without discrimination as to any reason or utility,to erect, construct, install, maintain, use or operate poles, overhead wires and associated overhead structures. Section 8. OTHER EXCEPTIONS, The following are exempted: a) Any municipal facilities orequipment installed under the supervision and tothe satisfaction of the City Engineer b) Poles, or electroliers used exclusively for street lighting. c) Overhead wires (exclusive of supporting structures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a District, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited. d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. e) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. f) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. g) Equipment appurtenant to underground facilities, such as surface mounted equipment, pedestal mounted terminal boxes, transformers, switches, and meter cabinets, and concealed ducts. h) Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. Section 9 NOTICE OF PROPERTY OWNERS AND UTILITY COMPANIES, Within ten (10) days afterthe effective date of a resolution adopted pursuant to Section 1, hereof, the City Engineer shall notify all affected utilities and all persons owning real property within the District created by said Resolution of the adoption thereof. Section 10 RESPONSIBILITY OF UTILITY COMPANIES, If underground construction is necessary to provide utility service within a District created by this Resolution,the supplying utility shall furnish that portion of the conduits, conductors and associated equipment required to be furnished by it under its applicable rules, regulations and tariffs on file with the Commission. Section 11 RESPONSIBILITY OF CITY, City shall remove, at its own expense, all City- owned equipment (if any) from all poles required to be removed thereunder in ample time to enable the owner or user of such poles to remove the same within the time specified in this Resolution. The City shall waive all permit fees, and study costs required by this project. Section 12 EXTENSION OF TIME, In the event that any act required by this Resolution thereof cannot be performed within the time provided on account of shortage of materials, war, restraint by public authorities, strikes, labor disturbances, civil disobedience, or any other circumstances beyond the control of the actor, then the time within which such act will be accomplished shall be extended for a period equivalent to the time of such limitation. Section 13 PENALTY, It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this Resolution. It is a misdemeanor to violate any provision of this Resolution or fail to comply with any of its requirements. ADOPTED THIS day of 2005. David H. Item No. 3A City Council Staff Report November 16,2005-Page 2 Resolution of Intention for Rule 20A Utility UndeMrounding Districts STAFF ANALYSIS: On April 21, 2005 Staff met with representatives of the Southern California Edison Company (SCE), regarding undergrounding of existing overhead utilities. Rule 20 is the Edison Company's tariff rule approved by the California Public Utilities Commission (CPUC)for the conversion of overhead electric facilities to underground facilities. Rule 20 specifies the circumstances and the role of general rate payer versus applicant involvement in the payment for the conversion of overhead electric facilities. Rule 20A criteria was established in order to maintain a general public benefit,while recovery of the costs of an undergrounding project are included in electric rates. An allocation concept was developed in order to ensure equitable treatment for every local government as well as a fair division of SCE funds. The formula was developed by SCE along with the League of California Cities and was approved by CPUC. In 2002 the CPUC approved a decision which modified the ability of local governments to mortgage their annual allocation up to a five year amount. Staff's meeting with SCE staff yielded the information that the City of Palm Springs was eligible for an approximately$2.2million utility undergrounding project. In order to qualify a project for Rule 20A funding,there must be 1) a heavy concentration of electric facilities, 2) a heavy volume of pedestrian or vehicle traffic or 3) civic areas, recreation areas and scenic areas, in addition to the lines being along a arterial or major collector roads. Meeting any one of the criteria qualifies the project for Rule 20A funding. Subsequent to the meeting with SCE, staff on July 19, 2005 proposed the following two projects for Rule 20A funding: 1)west side of Sunrise Way from East Palm Canyon Drive to Sunny Dunes Road 2) east side of Sunrise Way from Vista Chino to San Rafael Drive. Staff requested SCE to prepare a cost estimate to determine if construction of these two projects could be accomplished, given the approximately $2.2million project budget that the City of Palm Springs would be permitted to have. On October 17, 2005, Staff received an estimate from SCE. The estimate showed the East Palm Canyon Drive to Sunny Dunes Road portion has an estimated cost of$1.26million. The Vista Chino to San Rafael Drive portion was estimated to cost$1.9million. Although,the total of these project costs is approximately$3.1 million, the City currently is holding covenants on over 1400LF of property frontage along Sunrise Way. These covenants resulted from development which occurred in the past within these limits. And if called by the City as a part of this project, would result in the total cost being reduced to the City by approximately $450K. The covenants recorded against the properties at the time of development require the property owner to participate in their fair share of the undergrounding costs, as determined by the frontage of the particular property. The resulting project estimate would be reduced to approximately$2.6million, which SCE has informed us is within the range allowable for SCE to proceed with an undergrounding district based on five year mortgaging of allocation funds. The last City Rule 20A Undergrounding Project was completed in 1999 along East Palm Canyon Drive.
