SUMMARY
An application by the Stroke Activity Center for a one-year time extension from
September 18, 2005 to September 18, 2006 for Tentative Parcel Map 30581 (TPM
30581), located at the northeast corner of Alejo Road and Commercial Road, Zone M-1-
1', Section 12, APN 507-380-025.
RECOMMENDATION
'I. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A ONE-YEAR
TIME EXTENSION FROM SEPTEMBER 18, 2005 TO SEPTEMBER 18, 2006

TPM 30581 Time Extension
PRIOR ACTIONS TAKEN ON THE PROJECT
On September 18, 2002, the City Council approved TPM 30581.
On March 2, 2005, the City Council approved a one-year time extension from
September 18, 2004 to September 18, 2005 for TPM 30581.
On November 23, 2005, the Planning Commission voted 6-0 (1 absent) to recommend
that the City Council approve a one-year time extension from September 18, 2005 to
September 18, 2006 for Tentative Parcel Map 30581 (TPM 30681).
BACKGROUND AND SETTING
The applicant submitted a request for time extension of TPM 30581 on August 29,
2005, prior to the expiration date of the map on September 18, 2005. Section
66452.6(e) of the Subdivision Map Act states that,
"...Prior to the expiration of an approved or conditionally approved
tentative map, upon an application by subdivider to extend that map, the
map shall automatically be extended for 60 days or until the application for
the extension is approved, conditionally approved, or denied, whichever
occurs first..."
The project site consists of one lot and is designed IND (Industrial) on the General Plan
and zoned PD-158 with an underlying zoning classification of M-1-P (Planned Research
and Development zone). The parcel map creates two new parcels. Parcel 1 will be 2.72
acres in size and will have the existing Stroke Activity Center located on it. This parcel
meets all Zoning Ordinance requirements and the existing Stroke Activity Center
building will comply with all property development standards, including setbacks. The
small masonry storage structure located on the northwest corner of Parcel 1 will be
demolished as it was constructed on the future property line being created by this
proposal. The structure will need to be removed prior to approval of the final map.
Parcel 2 will be 2.02 acres in size and is vacant. Parcel 2 also complies with all zoning
requirements.

REQUIRED FINDINGS
The City Council may extend the map a maximum of one year pursuant to Section
9.63.110 of the Municipal Code. The applicant is requesting the time extension in order
to allow additional time to continue working with staff towards the completion of the final
map process.
There are no specific findings for extension of the map. In reviewing the request, staff
considered if the following circumstances have changed such that the map's approval
might need reconsideration:
1. The project's overall plan and lot configuration,
2. The uses and development of the surrounding area, and
3. The applicable policies of the General Plan, zoning ordinance and other
regulations.
No significant changes have occurred in these factors to warrant reconsideration of the
map's approval and staff recommends approval of the extension request. Further, no
new conditions are recommended to be added and no existing conditions are
recommended for revision or amendment.
ENVIRONMENTAL ASSESSMENT
This project is categorically exempt from environmental review pursuant to Section
15315 (Minor Land Divisions) of the California Environmental Quality Act (CEQA)
Guidelines, whereby this project meets the conditions for a Minor Land Division as
follows:
a) The parcel is located in an urbanized area zoned for industrial use;
b) The subdivision consists of dividing one parcel into two parcels;
c) The subdivision is consistent with the General Plan and zoning;
d) No variances or exceptions are required for the subdivision;
e) All services and access to the proposed parcels are available;
f) The parcel was not involved in a division of a larger parcel within the previous 2
years; and
g) The parcel does not have an average slope greater than 20 percent.
NOTIFICATION
Requests for time extensions do not require public notice.

On behalf of the Stroke Activity Center we are requesting an extension on the Tentative
Map for Parcel Map No. 30581. The map is in final plan check at the City Engineers office.
We had hoped that we could make the September 7th City Council meeting but the map was
not ready for final approval. We are hoping to have the map on the second City Council
meeting in September.

WHEREAS, the Stroke Activity Center, (the "Applicant") filed an application with the City
pursuant to Section 94.02.00 of the Zoning Ordinance and Section 9.60 of the Municipal
Code for Tentative Parcel Map 30581 to subdivide approximately four acres of land into
two parcels on the northeast corner of Alejo Road and Commercial Road, Zones PD-
158 and M-1-P, Section 12; and
WHEREAS, on July 24, 2002, the Planning Commission voted to recommend that the
City Council approve Tentative Parcel Map 30581, subject to the conditions of approval;
and
WHEREAS, on September 18, 2002, the City Council voted to approve Tentative Parcel
Map 30581 subject to the conditions of approval; and
WHEREAS, on March 2, 2005, the City Council voted to approved a one-year time
extension from September 18, 2004 to September 18, 2005 for Tentative Parcel Map
30581; and
WHEREAS, the Applicant has filed a request for a one-year time extension from
September 18, 2005 to September 18, 2006 for Tentative Parcel Map 30581 with the
City and has paid the required filing fees; and
WHEREAS, on November 23, 2005, the Planning Commission held a public meeting
and voted 6-0 to recommend that the City Council approve a one-year time extension of
Tentative Parcel Map 30581; and
WHEREAS, on December 7, 2005, the City Council held a public meeting to consider
the applicant's request for a one-year time extension of Tentative Parcel Map 30581;
and
WHEREAS, the proposed project is considered a "project" pursuant to the terms of the
California Environmental Quality Act (CEQA); and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the
staff report and all written and oral testimony presented.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1: Pursuant to the California Environmental Quality Act (CEQA) Guidelines,
the project is categorically exempt from environmental review per Section
15315 for Minor Land Divisions because the parcel: is located in an
urbanized area zoned for industrial use, consists of dividing one parcel
into two parcels, is consistent with the General Plan and zoning, does not
require variances or exceptions, has all services and access available to
the proposed parcels, was not involved in a division of a larger parcel
within the previous 2 years, and does not have an average slope greater
than 20 percent.
Section 2: Approve a one year time extension from September 18, 2005 to
September 18, 2006 for Tentative Parcel Map 30581.
