Additionally, we are scheduling a slurry seal of Sunrise Way from 'Vista Chino to Alejo Road. RECOMMENDATION: 1) Approve Minute Order No. "APPROVING AGREEMENT NO. WITH BOND BLACKTOP, INC FOR BID SCHEDULES A THROUGH D (INCLUSIVE), FOR THE 2005/2006 ANNUAL SLURRY SEAL, CITY PROJECT #05-19." 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: 'The Department of Public Works & Engineering oversees the maintenance of the City's street system. Each year, the Department assembles a capital project to continue its Slurry Seal Program on various City streets. This year's slurry seal program was scheduled to include streets within Section 25 (Bid Schedule A), streets within Section 30 (Bid Schedule B), streets within Section 34 (Bid Schedule C), Sunrise Way from Vista Chino to Alejo Road (Bid Schedule D) and Sunrise Way from Alejo Road to Ramon Road QBid Schedule E). The budget, however, does not allow for all of the Bid Schedules to be awarded. Staff is recommending that Schedule E (Sunrise Way from Alejo Road to Ramon Road) be eliminated from the award. This area will be re-scheduled for next year. Last year Section 34 was eliminated from the project due to the bid exceeding the budget, so it is being included this year. Item No. 5. 6. City Council Staff Report December 7, 2005- Page 2 2005/2006 Annual Slurry Seal, CP#05-19 'The specifications were prepared by Department staff, and on October 19, 2005, the City Council approved the specifications and authorized construction bidding. On October 25 and November 1, 2005, the project was advertised forbids, and at 2:00 p.m. on November 18, 2005, the Procurement and Contracting Manger received construction bids, (refer to Attachment 2). The Engineer's Estimate was$50,456 for Bid Schedule A; $71,729 for Bid Scheduled B; $107,781 for Bid Schedule C; $85,375 for Bid Schedule D; and $88,546 for Bid Schedule E, for a total estimate of $403,887. The low bid was submitted by Bond Blacktop, Inc. The company is a California corporation, and its principal officer is Edward Dillon, President/Secretary. FISCAL IMPACT: Finance Director Revi This project was budgeted as part of the 2005/2006 Capi�W Improvement Plan, with $400,000 in local Mesaure A funds budgeted for the project. The recommended award include those Bid Schedules with a total sum less than the allowable project budget. Sufficient funds are available in account 134-4498-50100 (Slurry Seal Program). David J. I appreciated the meeting with all the city personnel involved in the street repair issue. While I understand that you all feel the city policies are being followed, I came away not satisfied with the outcome and feel the matter should come to the attention of the city council. It seems as if the city standards are less than the citizens of Palm Springs deserve and expect. My main concern, as you will recall, is the awarding of the 2005-2006 slurry and seal contract to a company that has not done a quality or timely job in fulfilling their 2004 contract. I feel strongly that the inspection and overseeing of the former contact was not properly done. I did some preliminary research on the company in question and found that they are being investigated for work quality and wage issues in several Southern California cities. I provided the City Attorney with a list of cities and the contact persons in those cities that are currently engaged in disputes with this company. A professional inspector that works for several of these cities will substantiate my concerns. The fact that the City of Palm Springs has no policy concerning the consideration of women and minority owned businesses in the awarding of city contracts is also of concern to me. When many of these contracts involve state funds as well as city funds, it seems that a cosmopolitan city like ours should be a leader in inclusion of women and minority owned businesses. Taking the lowest bid is often good for the city and for our budget, but considerations of work quality, work done in a timely manner and inclusion of all should also be strong considerations. It simply is not sound business practice to award contracts to companies that have done sloppy and late work on prior contracts. In my former role as Director of the California Department of Fair Employment and Housing, I did not feel compelled to approve low bid contractors that had 2 performed substandard work. I'm hoping that the city can consider a policy that is fair to the bidding vendors and fair to the citizens of the city. Before awarding the slurry and seal contract for 2005-2006, the city should first examine the proposed awardees policies, practices and quality control procedures. Our expectations and standards need to be elevated. An analysis of contract procedures and the history of vendor selection needs to be performed.
