City of Palm Springs Attu: Mayor and City Council Members ci, j) �/�f/' Re: Tuscany Heights We live at 2223 Milo Dr Palm Springs, bordering Tuscany Heights development on the east side. When we first saw the plans, it had a buffer zone between our properties, which we understood would be used as a flood control, water drainage ditch,the length of the development, from the south to the north,then a wall and the homes. That is not how it has been done. They have built a retention wall on the property line, with tons of dirt brought in and piled up against it and higher than the wall with huge boulders stacked on top of this. Can this be done? Isn't there a grading code on height and isn't there also an easement requirement on this? We, the neighbors on Milo Dr., had no idea how this would affect us. We knew that we would lose some of our views to a house, but this is beyond ridiculous. To have a mountain of dirt and boulders put behind our homes, up against the property lines losing our views completely and our security. Please see photos attached. They are quite dramatic. Were the city planners and city council even aware of how it would impact the neighbors on Milo Dr? This is one big concern of ours. No one viewed it from our side of the wall. No one took us into consideration in these plans. Our immediate concern because of this wall is a security issue. We have three dogs we keep in our backyard. The concern is that a predator, raccoon, coyote, and we hear them every night, or burglar can easily jump down into our yard. We know this can happen because one of the construction workers dog did just that. Once in the yard the animal is trapped because it cannot jump back out. We are afraid every time we go out into our back yard for fear of what we might find. We are afraid every time we go out on errands, appointments and such, because of our pets being left alone in our back yard. We are also concerned about earthquakes and the tumbling of boulders into our property. We spoke to a city official, Herb Jackson, code enforcement, planning and zoning, three weeks ago. He came out and saw for himself and couldn't believe it. We gave him a photo to take with him. He said it would take some time to figure out what if anything can be done. This simply is not good enough. We were secure before this wall, dirt, and boulders were put there. We want our security and peace of mind back, now not after a disaster happens! We are in imminent danger. We do not want to sacrifice one or all of our pets or be harmed ourselves to get this resolved. This is very stressful to say the least. � �17 nz" e3 1 We have lived here for twenty-four years. We have always had a fence to keep ours in and anything else out. Not any more. We are afraid to leave our home. This construction has been going on since the end of April, seven months, Monday through Saturday, lam—4pm. The noise alone is nerve shattering_ The bulldozers, graders,trucks bringing in and hauling off dirt, water trucks, rock crusher, there are at least twelve vehicles up there causing noise, dirt, and fuel exhaust pollution. We cannot open our doors and windows, six days a week, to enjoy our lovely desert weather. Our homes are in earthquake mode with rattling and shaking, our patio furniture and patios are covered in dirt, can't keep them clean, it seeps into our homes and there is a layer of dirt on every surface. Our ceiling fans are now making noise and we suspect its from the dirt and grit blowing in. It has been seven months. They are still grading, and bringing in and hauling off dirt. They have the other side of the street yet to work on. The first of fifteen or sixteen homes has not even been started. We do not see an end in sight. The developer has built up his property in order to gain a view and higher prices for his homes and in the process he has taken away our views. But he has also taken away our security and safety to make a profit. He claims to be a good neighbor. This is not neighborly. Please, we need help. Dietrich of 2034 Chia. I am President of the Sagewood Homeowners Association and convener of the Sunrise Vista Chino Neighborhood Coalition. We have an ongoing interest in all development in our section of the city. We are opposed to any homeless shelter in this area as we have strongly expressed in 2004 regarding the proposed center at the location of the Desert AIDS Project. While I recognize that this is in the rumor stage, 11 also understand the most rumors have a basis in fact. We will use all means necessary to oppose such a project. It is also our understanding that there is a proposal in the revision of the master plan to allow for three storey apartments on Vista Chino. This we believe would not be in the best interest of the city. We would be even more concerned if this was to be low-income housing. As we have clearly identified this in our prior presentations before the Council that there is a preponderance of low-income housing in this section,which is approximately one square mile (Indian to Sunrise & Vista Chino to the north end of Sunrise). These changes will forever alter our village feeling and precious natural approach to the city. Key warning signs is the building of 15 Tuscany Heights homes atop Racquet Club Drive. A visit to this destructive progress shows the road in disrepair from heavy truck traffic. Boulder piles block once magnificent valley vistas. This will further be obliterated by the Crescendo development. Each project devours Palm Springs beauty, vanishing, leaving those who came before victims of an unabated process to degrade this wondrous landscape to boring proportions. I was at this project's review hearing. The developer objected what had been approved had to be changed. He'd consider legal action. The home designs were austere. John Wessman said he was insulted how known critics of his higher quality homes did not object to these. I agreed. John's are higher quality. I was mystified at the casual approval. It was a small project thus limited concern. Seeing this venture progress on a small space compared to larger Boulders, Crescendo and greater proportioned proposed Century Vintage Homes is horrifying. re SACKS, December 7, 2005 Page Two Giant leaps across this landscape is against human kindness of our natural heritage that greets everyone to this city. It only shows this process must stop, issues raised on what is truly best for the city and citizenry. Each project must have individual impact studies, not lumped together, pushed through approval, since each is different. For esthetic appreciation, we must not loose this vision. If we allow this we are all blind that once gone is gone, can not be re altered. Two weeks ago, returning from Los Angeles, I was greeted by that mystical winding #111 approach. In that last leg, dropping down into darkness, faint mountain shadows, I was assaulted by an almost blinding light, like some spaceship in the night. It was the new Mountain Gate streetlights. The subtle welcoming darkness gone by simple towering intersection lights two blocks further out than before. The famous Palm Springs dark skies gone. Not by an impending landscape of a thousand future homes. Jiust a simple street light. It is these subtleties that can also in the long run change our environment, one tiny step at a time, from one of beauty and tranquility to one for only profits, in the end, visually ruinous to this community. We must not allow this to happen or we will be awash in an altered sea of glaring lights, leaving the beauty of our past, lost in the darkness of our memory. McKinley, Palm Springs 12-07-05 We are here again, to speak to the issue of building in the hillside canyons of Palm Springs. in particular, the Chino Canyon. Again, we insist that you put the health and well-being of the current residents first, before the interests of mass developers. Hurricanes in the gulf states painfully showed that you must secure the infrastructure. You must be sure you have emergency personnel and equipment that can respond to the current population BEFORE you add more population. More people mean more burdens on our limited resources of water and energy. More people mean more crime, more air pollution, more water pollution, more noise and traffic, These health hazards must be addressed BEFORE these projects are implemented. Already,with one small development of 15 homes for Tuscany Heights, it has been shown what damage is caused by trying to mass-grade these boulder fields and ravines. Racquet Club Road is still an ugly mess from the sewer line installed for this project with no notice to the neighborhood, and all protests ignored. There was not a single response from anyone in the city regarding our written objections. A flimsy cinder block wall was constructed on the property lines of our neighbors on Milo Drive without the required setback. Just looking at it will tell you that it will not contain the dirt behind it, let alone the massive wall of boulders on top of that. We think that every member of the planning Department, Engineering Department, and the Council and Staff need to go take a look at the consequences of their decisions. There was no EiR for this project. We think that someone like the geologist Tania Gonzales, who spoke of land destabilization to the General Plan Steering Committee, should assess the situation, She recommends nothing be built on such terrain that is more than a 10% slope. Most of the Chino Canyon is greater than that.We also say that an independent and authoritative engineering analyst should assess the foreseeable dangers of the ruination of the natural water courses and percolation, and how this affects land destabilization. Rains can often seep down and trigger earthquakes. This happened twice about 5 months ago. Should that little wall give way, those boulders will come down through that neighborhood like freight trains.We pointed this out to you two years ago, Here's the diagram we showed you then. Reality is far worse. We actually moved because of it. Who is going to pay Mr. Kay's and our neighbors'property insurance?Their life insurance?The devaluation of their homes from the total obliteration of their once million-dollar views?Again,the health and safety of residents are ignored for the mass developers'pipe-dreams. Please do the right thing and get some experts to address these concerns. They felt the debate could be Settled through di5cu55ion and compromise. In that light, I am here tonight to present a preliminary copy of a downtown height limits initiative. The wording used 15 remini5cent of the 1993 General Plan which euggeots "one or two Story buildings downtown with the occasional third Story architectural feature". Thi5 language was repeated%oed throughout the campaign . . ..and many of the people of Palm 5pring5 responded to it positively. I have made no Secret of my preferences for the revival of our downtown but it was impre55ive to learn that many people agreed with me. Many also disagreed with the Emergency Guidelines which would allow developers to bulldoze projects through committees and thus hasten completion of unwanted, too-tall, too-denee buildings. However, before taking this initiative to the petition stage, members of our Steering committee wanted to be Sure that the City was properly notified as to our intentions 5o that we might enter a true and fruitful dialogue with the community. If the City does not feel there is room for compromise on the current Guidelines, we will take the petitions to the people in time to qualify for the November ballot.
