HomeMy WebLinkAboutA5211 - EXEMPT EMPLOYEES AND COUNCILMEMBERS MOU RETIREMENT HEALTH BENEFITS RESOLUTION NO. 22037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REPEALING RESOLUTION NO. 21575, COMPENSATION FOR THE MEMBERS OF THE GOVERNING BOARDS OF THE COMMUNITY REDEVELOPMENT AGENCY, THE FINANCING AUTHORITY AND THE HOUSING AUTHORITY, AMENDING RESOLUTION NO. 21962 TO MODIFY THE CITY COUNCIL. 'RETIREE HEALTH" BENEFIT TO A TWO-TIER STRUCTURE. WHEREAS, the City Council desires to modify the manner in which Councilmembers are compensated as members of other City boards; and WHEREAS, the City Council wishes to clarify the retiree health benefits for the Mayor and members of the City Council. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Resolution No. 21575 establishing compensation for the members of the governing boards of the Community Redevelopment Agency of the City of Palm Springs, the City of Palm Springs Financing Authority, and the Housing Authority of the City of Palm Springs, is hereby repealed and will no longer be in force or effect, as of December 1, 2007. SECTION 2. The following is added to Subsection 3(A)to Resolution No. 21962: "Any Councilmember, who is first elected or appointed after December 1, 2007, shall not receive nor shall be eligible for a City contribution for retiree health benefits other than for any mandatory CaIPERS costs. The City will, however, make a $50.00 per month contribution to an employee Retiree Health Savings Flan and the associated fixed dollar cost of administration for such." ABSTAIN: None. mes Thompson, City Clerk City of Palm Springs, California RESOLUTION NO. 22078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA APPROVING A MEMORANDUM OF UNDERSTANDING RELATIVE TO WAGES, HOURS, AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT FOR EMPLOYEES IN THE MANAGEMENT ASSOCIATION OF PALM SPRINGS (MAPS), REPRESENTING THE PROFESSIONAL AND MANAGEMENT UNIT, FOR THE PERIOD JULY 1, 2007 THROUGH JUNE 30, 2011, SUBJECT TO UNIT'S RATIFICATION AND EXECUTING THE MEMORANDUM OF UNDERSTANDING AND CLARIFYING RESOLUTION NO. 21962, WHEREAS, Resolution 16438 designates the City Manager (acting personally or through a delegee) as the Municipal Employee Relations Representative (MERR) who shall be the City's principal representative on all matters of employer-employee relations, with authority to meet and confer In good faith on matters within the scope of representation, including wages, hours, and other terms and conditions of employment; and WHEREAS, the City, through its Municipal Employee Relations Representative (MERR), has met and conferred in good faith on wages, hours, terms and other conditions of employment with the Management Association of Palm Springs (MAPS) representing the Professional and Management Unit; and WHEREAS, as a result of such good faith negotiations the MERR and MAPS have reached agreement on the terms and conditions of a Memorandum of Understanding (MOU) governing employees of the City of Palm Springs within such Professional and Management Unit, subject to ratification by the Unit; and WHEREAS, MAPS and the MERR jointly recommend adoption of such MOU by the City Council. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS; SECTION 1. That the Memorandum of Understanding between MAPS and MERR, for the period -July 1, 2007 through June 30, 2011, on file with the City Clerk and incorporated herein by this reference, is hereby approved upon ratification and execution of said Memorandum of Understanding in a form approved by the City Attorney. SECTION 2. The salary tables consistent with this Resolution attached and incorporated herein supersede and amend the Allocation Positions and Compensation Plan adopted by Resolution 21907 - Resolution No.22078 Page 2 j SECTION 3. Effective July 1, 2007, paragraphs 1, 2, and 3 of subsection B of Section 4 i of Resolution No. 21962, adopted June 27, 2007, is amended to read as follows- (1) After 7.5 years of full-time continuous service with the City, 50% of the cost of the health premium (single or two-party) based on the coverage type in effect at the time of ii retirement. (2) After 11.6 years of full-time continuous service with the City, 75% of the cost of the health premium (single or two-party) based on the coverage type in effect at the j time of retirement. I u (3) After 15-5 years of full-time continuous service with the City, 100% of the cost of the health premium (single or two-party) based on the coverage type in effect at the 1,-Jime of retirement. City Councilmember salaries were last adjusted in June, 2000. This ordinance adjusts salary for members of the City Council to $2,433 per month and the salary of the Mayor to $3,650 per month. This ordinance also provides an adjustment every two years following a Municipal Election based on median compensation paid to council members of charter cities in the Coachella Valley. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS ORDAINS: SECTION 1. Section 1.01.110 of the Palm Springs Municipal Code is amended by ' adding in alphabetical order the following definition of"Council Median." "Council Median" means an amount equal to the median of salary paid to council members of charter cities in the Coachella Valley as of January 1 of each year immediately following a year in which a regular municipal election is conducted, rounded to the nearest one dollar. SECTION 2, Section 2,04.020 of the Palm Springs Municipal Code is amended to read: 2.04.020 Compensation of City Councilmembers. Each member of the City Council shall receive a salary of two thousand four hundred thirty-three dollars ($2,433.00) per month for each full month in office, or pro rata portion thereof for a partial month in office. On January 1"of each year following a municipal election, the salary shall be automatically adjusted to equal the Council Median. SECTION 3. Section 2.04.021 of the Palm Springs Municipal Code is amended to read: 2.04.021 Compensation for Mayor The Mayor shall receive a salary of three thousand six hundred fifty dollars ($3,650.00) per month for each full month in office, or pro rata portion thereof for a partial month in office. On January 1t of each year following a municipal election, the Ordinance No. 1716 Page 2 ' salary shall be automatically adjusted to equal the Council Median plus fifty percent (50%) of the Council Median, SECTION 4. If any provision, clause, sentence, or paragraph of this Ordinance, or the application thereof to any person or circumstances, shall be held invalid, such invalidity shall not affect the other provisions of this Ordinance which can be given effect without the invalid provision or application, and, to this end, the provisions of this Ordinance are hereby declared to be severable_ SECTION 5. This Ordinance shall be in full farce and effect thirty (30) days after adoption. However, pursuant to Palm Springs City Charter Section 304, the increase in the members of the City Council and of the Mayor's compensation as provided herein shall not take effect until after the City Council declares the result of the November 6, 2007, General Municipal Election. An exempt employee, who is first retained, hired, or appointed after July 1, 2007, shall not receive nor shall be eligible for a City contribution for retiree health benefits other than for any mandatory CalPERS costs. The City will, however, make a $50.00 per month contribution to an employee Retiree Health Savings Plan and the associated fixed dollar cost of administration for each such employee. S. An exempt employee who is first retained, hired, or appointed before July 1, 2007 ' and who attains age fifty (50) and retires from active service as an employee of the City, or a member of the City Council who separates from service as a member of the City Council, shall be reimbursed for costs of health insurance as follows: 1) after 7.5 years of full-time continuous service with the City, 50% of the cost of two party health premium covered immediately prior to the date of separation; ` 2) after 11.5 years of full-time continuous service with the City shall be reimbursed for 75% of the cost of two party health premium covered immediately prior to separation; and 3) after 15.5 years of full-time continuous service with the City shall be reimbursed for 100% of the cost of two party health premium covered immediately prior to separation. C. Any person otherwise eligible for reimbursement pursuant to subsection B above shall not receive reimbursement until the date of separation or the person's 50'1' birthday, whatever date occurs last and so long as such person maintains continuous membership in a city approved health plan at their own expense. SECTION 5. Effective July 1, 2007, Resolution 21284 is amended to read as follows: "Section 2. The Management Pay for Performance Program is hereby established as provided in Exhibit"B" to this resolution and shall be applicable for the persons holding executive or 'management positions identified therein. The ' Management Pay for Performance Program shall beaextended effective July 1, 2007, until such time as terminated by the City Council. To the extent the Management Pay for AWL Resolution No.21962 Page 3 Performance Program is inconsistent with the provisions of Rule 5 of the City's Personnel Rules, the provisions of the Management Pay for Performance Program shall control." SECTION 6. Exhibit `A' of Resolution No. 21691 is amended by revising a certain portion of Section A thereof relating to Council approval of certain travel costs or expenses to read as follows: "Section A. MERR and Group III employees designated by City Council as exempt, and City Council members,have met and conferred in good faith and have reached agreements which are set forth in this Memorandum of Understanding. B. This Memorandum of Understanding(hereinafter called"MOU")shall be for the period commencing July 1, 1999,until cancelled. THE EXEMPT EMPLOYEES, COUNCIL MEMBERS AND MERR agree as follows: That effective July 1, 1999: a �e 1. A council member or exempt employee who attains age fifty(50)and retires from active service as a Palm Springs employee or Palm Springs Council member after eight ,kZ)years of full-time continuous service,the City shall reimburse the member for ttptc 50%of the cost of two party"retirees"health premium being covered at the time of retirement. 2. A council member or exempt employee who attains age fifty(50) and retires from active service as a Palm Springs employee or Palm Springs Council member after twelve (Jer years of full-time continuous service, the City shall reimburse the member fop-dpow 75% of the cost of we party "retirees"health premium being covered at the time of retirement. 3.
