RECOMMENDATION: Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ABANDONING AND DISSOLVING ASSESSMENT DISTRICT NO. 155 OF THE CITY OF PALM SPRINGS, CALIFORNIA.- STAFF ANALYSIS: In 1989 the City approved the formation of Assessment District No. 155 for the benefit of property owners in and around Gene Autry Trail, approximately between Sunny Dunes Road and Vista Chino. The City issued $7.8 million in bonds to finance street and utility line improvements, and a levy was placed on the property owners benefiting from the public improvements, in accordance with provisions of the Municipal Improvement Act of 1913, codified in the Cal. Streets and Highways Code. The City has received a request representing property owners for the abandonment and dissolution of Assessment District No. 155. The City's Finance Department has reviewed the status of Assessment District No. 155 and has verified that the bonds for public improvements have been paid in full, all property owner assessments and delinquent assessments have been paid. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ABANDONING AND DISSOLVING ASSESSMENT DISTRICT NO. 155 OF THE CITY OF PALM SPRINGS, CALIFORNIA. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS HEREBY FINDS AND DETERMINES: A. The City Council of the City of Palm Springs ("City") has previously, on June 7, 1989, at a public hearing held for that purpose, adopted Resolution No. 16784. B. Resolution No. 16784 was adopted with the declared intention to order the construction of certain public works of improvement, pursuant to the terms and provisions of the Municipal Improvement Act of 1913, being Division 12 of the Streets and Highways Code of the state of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 155 (hereafter referred to as the "Assessment District"). C. The City caused to be recorded the ASSESSMENT DIAGRAM- ASSESSMENT DISTRICT NO. 155 ("Assessment Diagram") on June 9, 1989 as Instrument No. 1989-189895 in Book 26, Pages 99 et seq. of Maps of Assessment Districts in the Office of the County Recorder of Riverside County, California, which Assessment Diagram depicted the boundaries ("Assessment District Boundary") of the Assessment District and disclosed the properties included within such boundaries which were to be assessed for the public works intended to be performed by the Assessment District; those public improvements to the street and adjoining land within the Assessment District involved Gene Autry Trail, running from Vista Chino Road on the north to Sunny Dunes Road on the south (the improvements are referred to herein, collectively, as the "Improvements"). D. The City also caused to be recorded in the office of said Recorder a NOTICE OF ASSESSMENT as Instrument No. 189896 on June 9, 1989, which notice included identification of all Assessor's Parcel Numbers for properties included within the Assessment Diagram. E. The City has determined, after adequate investigation, the following: (i) The Improvements for which the Assessment District was formed have been completed and approved by the City for public use. 03 Resolution No. Page 2 (ii) The construction of the Improvements has been fully paid for and the Assessment District and the City owe no further debts or obligations regarding the construction of the Improvements. (iii) All assessments levied by the Assessment District against properties within the Assessment District Boundary, as shown on the Assessment Diagram, have been fully paid and collected, and no further debt is outstanding to the Assessment District, and all other duties and functions of the Assessment District, for which it was formed, have been satisfied and no longer exist. E. The City, having determined each and all of the facts above stated, has determined that there is no further need for the Assessment District or for the Notice of Assessment or Assessment Diagram to exist as potential liens on the properties within the Assessment Diagram, and that it would be in the best interests of those properties and the City to abandon and dissolve the Assessment District and to cause the effect of the Notice of Assessment and the Assessment Diagram to be removed from title of those properties. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS HEREBY RESOLVES AND APPROVES: SECTION 1. The above findings are all true and correct. SECTION 2. The construction of the Improvements has been completed; that all costs of such construction incurred by the Assessment District have been paid in full; and the Assessment District owes no further debt or obligation regarding the Improvements or the construction thereof. SECTION 3. All assessments levied by the Assessment District against properties within the Assessment Diagram have been paid and collected in full. SECTION 4. No further purpose exists for the Assessment District, it having fully satisfied the purposes for which it was originally adopted by the City. SECTION 5. It is appropriate at this time to abandon and dissolve the Assessment District and to cause to be removed the Notice of Assessment and the Assessment Diagram as liens on the properties within the Assessment Diagram. SECTION 6. The City Council of the City hereby does abandon and dissolve the Assessment District and further, directs the City Clerk of the City to cause the recordation in the Office of the County Recorder of Riverside County, California, the attached NOTICE OF ABANDONMENT AND DISSOLUTION OF ASSESSMENT DISTRICT NO. 155. 04 Resolution No. Page 3 PASSED, APPROVED, AND ADOPTED BY THE PALM SPRINGS CITY COUNCIL THIS 20TH DAY OF JULY, 2011. COYIRT OR RIVERSIDE, STATE 0f aALlIONN11 e .iNelm wR IaM , o A w i a © g ors im 5 0 1 f.,a feh n., IYF,M MI 12 REQUEST FOR THE ABANDONMENT AND DISSOLUTION OF ASSESSMENT DISTRICT NO. 155 OF THE CITY OF PALM SPRINGS AND THE CANCELLATION OF THE SPECIAL ASSESSMENT LIEN Honorable Councilmembers City of Palm Springs 3200 East Tahquitz Canyon Way Palm Springs,California 92262 Dear Councilmembers: This is a request (the "Request") (1) for the abandonment and dissolution of the assessment district designated as "Assessment District No. 155" of the City of Palm Springs (the "Assessment District'), which was established pursuant the Municipal Improvement Act of 1913, constituting Section 10000 et seq. of the California Streets and Highways Code (the "Act' , and (2) for the City Council (the "City Council") of the City of Palm Springs (the "City")to take the necessary action to cancel the assessment lien(the"Assessment Lien")of the Notice of Assessment, recorded in the Official Records of Riverside County on June 9, 1989, as document number 189896 (the "Notice of Assessment") encumbering the land within the Assessment District. 1. Assessment District Boundary.• Parcels Within Boundary. Pursuant to Resolution No. 16784 adopted by the City on June 7, 1989, attached hereto as Exhibit A-1, the City caused to be recorded the document attached hereto as Exhibit A-2. entitled "Assessment Diagram - Assessment District No. 155," on June 9, 1989 as Instrument No. 1989-189895 in Book 26, Pages 99 et seq., of Maps of Assessment and Community Facilities Districts in the Office of the County Recorder of Riverside County, California, depicting the Assessment District Boundary ("Assessment District Boundary"). Attached hereto as Exhibit A-3 is the Notice of Assessment identifying all of the Assessor's Parcels within that Assessment District Boundary. Attached hereto as Exhibit A-4 is a tabulation of all Assessor Parcel Numbers ("APNs") within the Assessment District Boundary,together with the corresponding name(s)of the current owners. 2. Purpose of Assessment District. The purpose for which the Assessment District was adopted was to finance the payment for, or reimbursement of, the construction of certain improvements ("Improvements") (as that term is defined in Section 10002 of the Act)to Gene Autry Trail, approximately between Sunny Dunes Road on the south and Vista Chino on the north, through the proceeds of assessments made by the City on behalf of the Assessment District. The assessments would be liens on the respective properties assessed within the Assessment District Boundary. As of this date, all of the Improvements have been completed and paid for, and all assessments and assessment liens have been satisfied. The Assessment District has fully satisfied the purposes for which it was adopted by the City pursuant to Resolution No. 16784 on June 7, 1989,and it serves no further legally authorized purpose. 3. Submission of Request. This Request is submitted by New Valley PS LLC, a Delaware limited liability company, and Standard Pacific Corporation, a Delaware corporation 1 p:aw,wiooaoiv.mmmarrwm a aaq�en nieoWeon oeno iss-oosax 13 (jointly, "Landowners"), as the owners of certain parcels of land identified in the Notice of Assessment and as shown on Exhibit A-4 (the "Property's in the Assessment District By submitting this Request, Landowners warrant to the City Council that Landowners are the owners of fee interests in the Property, that no other person or entity is the legal owner of any portion of the fee interest in any of such Property,and that Landowners are authorized to execute this Request 4. Other Landowners This Request is also made on behalf of the other landowners ("Other Landowners") who own land ("Other Property") within the Assessment District Boundary,all as shown on Exhibit B. 5. Proceedings Requested. Landowners hereby request that, based on the information set forth in Paragraphs 1 and 2 above, and the provisions in the Act, and other provisions in the Streets and Highways Code applicable to the act, including those set forth in Sections 2960 and 3117, the City Council adopt Resolution No. , attached hereto as Exhibit B and undertake proceedings under the Act to abandon and dissolve the Assessment District and take the action necessary to cancel the Notice of Assessment. 6. Findings by City Council. The provisions of the Act, and other provisions in the Streets and Highways Code applicable to the Act, including those set forth in Sections 2960 and 3117, provide that the City Council may, by resolution, abandon and dissolve the Assessment District upon making all of the following determinations: (a) that the Improvements for which the Assessment District was formed are complete; (b) that the Assessment District has (i) paid for all such Improvements and (ii) has collected all assessments,with no fiuther debts,obligations or duties outstanding;and (c) that all other duties and functions of the Assessment District, for which it was formed,have been satisfied and not longer exist. 7. Landowners' Request: Findings by City. Landowners hereby request that the City Council, acting as the legislative body of the Assessment District, abandon and dissolve the Assessment District pursuant to the Act and the other sections of the Streets and Highways Code applicable to the Act, based on the following facts: • the Assessment District is not obligated to pay any outstanding debt for the following reasons: o The Improvements have been completed and are fully paid for; o All required assessment made by the Assessment District on property within the Assessment District Boundary have been paid in full;and o There are no remaining unsatisfied or unreleased liens of the Assessment District,on property within the Assessment District Boundary. 2 Qi�nwiaoaoiv,aeo�vaabomnw��m�orno iss-aos.m� 14 • the City has no authorization under the Resolution to levy any further assessment for the following reasons: o Ali Improvements have been completed and have been fully paid for through sources authorized by the Resolution and the Act;and o There is not outstanding debt within the Assessment District that must be paid by assessments that were authorized by the Resolution or the Act that could be levied in the Assessment District 8. Landowners hereby request that, pursuant to the Act, and related Provisions in the Shads and lEghways Code, the City Council, as the legislative body of the Assessment District,adopt a Resolution,in the form attached as Exhibit B hereto,that abandons and dissolves the Assessment District and all associated liens,if any,of the Assessment District 9. WHEREAS, an initial environmental study has been completed for the project, indicating that the project shall not have a significant effect on the environment and that approval of a Negative Declaration would be appropriate. NOW, THEREFORE, IT 1S HEREBY RESOLVED AS FOLLOWS, SECTION I. That the above recitals are all true and correct. SECTION 2. That the public hearing on the Assessment District is hereby closed. .SECTION 3.
